日本語: 警察官職務執行法第2条に基づき、警察官が異常な挙動その他周囲の事情から合理的に判断して何らかの犯罪を犯し、若しくは犯そうとしていると疑うに足りる相当な理由のある者又は既に行われた犯罪について、若しくは犯罪が行われようとしていることについて知っていると認められる者を停止させて質問する行為。職質（しょくしつ）やバンかけとも称される[1]。第二次世界大戦前の日本では不審尋問（ふしんじんもん）と称されていた[2]。
日本国憲法第34条により不当な抑留・拘禁を禁じている。刑事訴訟に関する規定によらずに身体を拘束したり、連行したり、答弁を強要してはならないことが、警察官職務執行法第2条3項に規定されている。そのため、強制的な捜査や逮捕には令状が必要である。 |
