state to abolishthe common law forms of pleading, and to permit the plaintiff to setforth his cause of action, and the defendant his defense, without refer-ence to form. If not the first, we were among the very first, in 1856, to enact apenal code and code of criminal procedure, and to declare thereby thatin order that the system of penal law in force in this state may becomplete within itself, and that no system of foreign laws, written orunwritten, may be appealed to, it is declared that no person shall bepunished for any act or omission, unless the same is made a penaloffence, and a penalty is affixed thereto by the written law of this state. Neither this chapter nor this volume pretends to behistory.
