This work is in the public domain in the United States because it was published in the United States between 1929 and 1977, inclusive, without a copyright notice. This United States work entered the public domain prior to January 1, 1978. Under the Copyright Act of 1909, copyright to a phonorecord such as this can be secured by the act of publication with notice of copyright (See U.S. Copyright Office, Copyright Basics, Publication archive copy at the Wayback Machine). An act of publication occurred on May 22, 1964 when an album titled "Auburn High School Band" containing this recording was sold to the public, as attested to by the program to the "Auburn High School Band Spring Awards Concert" on that date, and by a copy of that album held by Auburn High School. No Notice of Copyright was given on that album, nor was this work published in any other form prior to January 1, 1978, as is attested to by the copy of album mentioned prior and discussion with the original author of the work, Tommy King Goff. As this work did thus not satisfy all conditions for securing federal copyright under the Copyright Act of 1909 it is considered to remain in the public domain under the 1976 Copyright Act.
