Lover, forskrifter, rettsavgjørelser og andre vedtak av offentlig myndighet er uten vern etter denne lov. Det samme gjelder forslag, utredninger og andre uttalelser som gjelder offentlig myndighetsutøvelse, og er avgitt av offentlig myndighet, offentlig oppnevnt råd eller utvalg, eller utgitt av det offentlige. Likeledes er offisielle oversettelser av slike tekster uten vern etter denne lov.

    Åndsverk som ikke er frembrakt særskilt til bruk i dokumenter som nevnt i første ledd, og som det siteres fra eller som gjengis i særskilt vedlegg, omfattes ikke av denne bestemmelse. Første ledd gjelder heller ikke lyrikk, musikkverk eller kunstverk.

This is also the case with proposals, reports and other statements which concern the public exercise of authority, and which are made by a public authority, a publicly appointed council or committee, or published by the public authorities. Similarly, official translations of such texts are not protected by this Act.

    Intellectual works ("åndsverk" as defined in § 1) which have not been produced specially for use in documents specified in the first paragraph, and from which parts are quoted or which are reproduced in a separate appendix, are not covered by this provision. Nor shall the first paragraph apply to poetry, musical compositions or works of art.

Per § 1 an intellectual work ("åndsverk") is defined as a literary, scientific or artistic work of any kind, and irrespective of manner or form of expression, such as

  1. writings of all kinds,
  2. oral lectures
  3. works for stage performance, as well as dramatic, musical and choreographic works and pantomimes, and also radio plays,
  4. musical works, with or without lyrics,
  5. cinematographic works,
  6. photographic works,
  7. paintings, drawings, graphic and similar pictorial works,
  8. sculpture of any kind,
  9. architectural works, drawings and models as well as the building itself,
  10. pictorial woven tissues and objects of artistic handicraft and applied art, the prototype as well as the work itself,
  11. maps, and also drawings and graphic and plastic depictions of scientific or technical nature,
  12. computer programs,
  13. translations and adaptations of the above mentioned works.

In the case for photographic pictures which are not defined as intellectual work ("åndsverk") per above, § 43 a applies. It is here specifically mentioned that § 9 applies to them too.
