Protection period of neighboring rights edit

I propose we add the following:

If a work went out of copyright before the 1986 act extended copyright terms from 30 years to 50 years, it does not regain copyright. Hence, works where all authors died before 1956 are out of copyright. (See Yunjeong Choi, Development of Copyright Protection in Korea: its History, Inherent Limits, and Suggested Solutions, Brook. J. Int'l L. 28 (2003), pp. 643-673.)

For audio files and broadcasts, the term of protection ends 50 years after creation. According to Chapter IV Section 5 of the Copyright Act:

The protection period of neighboring rights shall come into effect from the following date and continue to subsist for a period of 50 years from the next year of such date:

1. For stage performances when the stage performance takes place;
2. For phonograms when the first fixation of sounds is made; and
3. For broadcastings when the broadcasting is made.

2011 amendments edit

I have edited the text as this. Major amendments were enacted in 2011, where the protection period of copyrighted works will be extended from 50 to 70 years effective 1 July 2013. However, works of which copyrights expired prior to this date will not be affected by the amendments.[1] Since most of the commons files tagged with template will be still in the public domain, the original pre-2011 text should be informed to the public in order to avoid misleading deletion requests. Copyright of Photo published before 12-31-1976 in South Korea edit

In Copyright Act of South Korea in 1957, Copyright of Photo shall be effective during 10 years from the publishing date. And these clauses were amended after in Copyright Act of South Korea in 1986 commenced 1-1-1987. So, I believe the copyright of Photo published before 12-31-1976 in South Korea is now public domain. Then please write the exact source, i.e. the paragraph in the law that you refere too. Your reference http://www.wipo.int/wipolex/en/details.jsp?id=2743 above isnt helpful because thats not the source of what you try to say here. The part of the 1957 version (Korean) is as follows;

제35조 (동전[제29조의 저작권의 존속기간을 뜻함]) ① 사진저작권은 10연간 존속한다.

②사진술에 의하야 적법으로 예술상의 저작권을 복제한 자는 원저작물에 관한 저작권과 동일한 기간내 본법의 보호를 받는다. 단 당사자간에 계약이 있을 때에는 그 계약의 제한에 따른다.

제36조 (동전) 학문적 또는 예술적저작물중에 삽입된 사진으로서 특히 그 저작물을 위하여 저작하였거나 또는 저작시켰을 때에는 그 사진저작권은 학문적 또는 예술적저작물의 저작자에 속하고 그 저작권은 그 학문적 또는 예술적저작권과 동일한 기간내에 존속한다.

제37조 (동전) 사진에 관한 규정은 사진술과 유사한 방법에 의하여 제작한 저작물에 준용한다.

제40조 (동전[제39조의 존속기간의 시기를 뜻함]) 사진저작권의 기간은 그 저작물을 처음으로 발행한 해의 익년부터 기산한다. 만일 발행하지 않을 때에는 원판을 제작한 해의 익년부터 기산한다.

And here is translation of them by myself.

Article 35 (the same) [note: it means “period of existence of copyright] ① The copyright of photograph exists for 10 years.

② Person who has reproduced the copyright of arts legally by photography shall be protected by this Act during the period of existence of original copyright thereof.

Article 36 (the same) [note: it means “period of existence of copyright] As the photograph inserted into a work of study or art, especially when it is produced only for the work thereof or let the works thereof produced, the copyright thereof shall devolve the owner of the work thereof and the copyright thereof shall exists during the same period of the copyright of works thereof.

Article 37 (the same) [note: it means “period of existence of copyright] The provisions related to photograph shall apply to other works by in the similar form to photography mutatis mutandis.

Article 40 (the same) [note: it means “start point of reckoning of period of existence”] The period of coryright of photograph shall be reckoned on the next year when it is published or, if it is not published, on the next year when the negative thereof is produced. I cannot find that Korean text in the link provided, neither can I find the fragment "10연간" (presumably translating as 10 years). All I can find are:

제35조(미술저작물등의 전시 또는 복제) ① 미술저작물등의 원본의 소유자나 그의 동의를 얻은 자는 그 저작물을 원본에 의하여 전시할 수 있다. 다만, 가로·공원·건축물의 외벽 그 밖에 공중에게 개방된 장소에 항시 전시하는 경우에는 그러하지 아니하다.
②제1항 단서의 규정에 따른 개방된 장소에 항시 전시되어 있는 미술저작물등은 어떠한 방법으로든지 이를 복제하여 이용할 수 있다. 다만, 다음 각 호의 어느 하나에 해당하는 경우에는 그러하지 아니하다.
1. 건축물을 건축물로 복제하는 경우
2. 조각 또는 회화를 조각 또는 회화로 복제하는 경우
3. 제1항 단서의 규정에 따른 개방된 장소 등에 항시 전시하기 위하여 복제하는 경우
4. 판매의 목적으로 복제하는 경우

제35조의2(저작물 이용과정에서의 일시적 복제) 컴퓨터에서 저작물을 이용하는 경우에는 원활하고 효율적인 정보처리를 위하여 필요하다고 인정되는 범위 안에서 그 저작물을 그 컴퓨터에 일시적으로 복제할 수 있다. 다만, 그 저작물의 이용이 저작권을 침해하는 경우에는 그러하지 아니하다.

The Article 35 which I quoted is from the Copyright Act of 1957 and the article 35 which you quoted is from current Copyright Act of 2013. Where do the dates 1976 and 1963 come from? edit

I wrote my analysis of Korean copyright at User:Piotrus/KoreaCopyright but I came up with different, more restrictive dates, i.e. I could only find support for public domain applying for pictures of authors who died before 1957 and were not anonymous. Just note that prior to 2013-07-01 the copyright was death+50years, which means it may be more permissive in some cases. — regards, Revi 11:15, 11 December 2016 (UTC)Reply
Based on the discussion archived in the VP above, I can see Copyright act (No. 432, 1957-01-28) article 35 gives photos only 10 years of copyright, and it was valid until Copyright act (No. 3916, 1987-07-01) article 36 says, so since 1987-10=1977, and rounding up for months, this gives us 1976, yes? But what about 1963?Also, what about anonymous works? Did you ever hear back from that lawyer you were going to contact? The best I found so far from my lawyer friend is that we have to ask Korean Ministry, which means by default any anonymous work published in Korea would be not free after 1976).
