Hi there. If you look at User talk:Pharos and my talk page, you will see we are discussing NTWTS photos from the LOC. An example is Image:Muhammad Ali NYWTS.jpg. But we are wondering where you got the hi-res photo. Did you e-mail the LOC or get it from somewhere else? We are thinking of doing a license tag template for the PD NYWTS pics and looking through them to find useful ones to use (though some are already here on Commons). Looks good. I personally would upload edits under separate names, just to make it clearer if there's more than one edit done, but it's not really a big deal, so either way is fine. en:Darwin's tubercle (and other references) certainly supports the notion that it's Thomas Woolner. --dave pape 15:19, 21 February 2008 (UTC)

Hi! A long time ago you uploaded some pictures relating to the Miss America pageant from the Library of Congress. I'm wondering where you got the actual hi-res digital image from, as all I can get is a tiny thumbnail. The presence of people's names should not be a problem. However, depending on when the signs were installed, their text may be copyrighted, and hence the photos would be copyright violations (given that the signs are in the U.S., where there's no freedom of panorama other than for architecture). --dave pape 14:03, 25 March 2008 (UTC)

Most of what you have written there is a "fair use rationale". Fair use is not allowed on Commons - see Commons:Licensing. If it were true that "Ensemble Studios has released any such images to the public domain", such images would be allowed here, but you'd need some convincing evidence to support it. Sorry, I don't speak Russian. But I'll guess that you're asking about the deletion of Image:Oktyabrskaya Railway Museum.jpg. I deleted it because it was a derivative work - the museum display itself is copyrighted; furthermore, Freedom of Panorama in Russia is non-commercial only according to COM:FOP, so it could not be kept under those grounds.
User:Alex Spade might be able to help explain, since he speaks Russian and was the person who tagged the image as a copyright violation. --dave pape (talk) 21:17, 12 June 2008 (UTC)

You're quite right! I've always had difficulty in understanding why museums should claim copyright on photos of objects in the public domain (except curiously for supposed two-dimensional creations like paintings or drawings - you have to see the thickness of paint to doubt that some paintings can be called two-dimensional - illogically, coins with a thickness less than that of the paint are categorised as three-dimensional). Most museums have a strict policy of not permitting photographs of the public domain objects that were entrusted to them. They will however for profit sell you postcards that they have made of those same artifacts. I think the time is ripe for a class-action lawsuit against museums and galleries! The difference is that the Bulbasaur image was not uploaded to Commons, but to the English wikipedia as "Fair use". Fair use images are not permitted here on Commons - see Commons:Licensing. Hi, thanks for noticing the copyright problems with the Image:Donna Cox.jpg and some of here images. Although I am not happy about it, I am going to check myself.

It seems your much more of an expert in this field. Now I wonder if you could take a look at the Category:Scientific visualization. Most of the image I got from the https://wci.llnl.gov/codes/visit/gallery.html website. Could you tell me if these website is ok, and these image are PD-USGov or not!?

Work of DOE labs is a bit of a tricky question - in general, the labs are run by Universities under contracts, so they can potentially claim copyright. See en:Template_talk:PD-USGov-DOE. The LLNL disclaimer doesn't completely say things are copyrighted, but implies they are. --dave pape (talk) 20:01, 22 July 2008 (UTC)

Missing information on Pakistani currency notesEdit

Hi Dave, I was going through some Pakistani currency notes you tagged under Category:Unknown - July 2008, and its a copyvio, but not for long. The currency notes issued by the Reserve Bank of India with the tag Government of Pakistan were issued in April-July 1948. As of 2008, they are a copyvio, but from 1 Jan next year, copyrights expire. If you're confident they'll be PD next January, then either keeping or deleting temporarily seems fine - keeping them wouldn't be a big worry. My problem with them was that the uploader gave completely inadequate information - there's no mention of the date, one had to guess that "SBP" means something like "State Bank of Pakistan", and he gave them an inappropriate {{PD-self}} tag. @Davepape: I just received a deletion request notification initiated by you, the reason given was "derivative work". I'm not sure what to do to address this, but I am the photographer, the person who processed the photo, and the person who gave it a Commons license. Please explain why you consider Image:Make_Art_Not_War.jpg to be a derivative work and what steps must be taken to restore its status.

Image:Master System 3Edit

Hi! This image was taken from the product's Downloads section at Tectoy(the manufacturer)'s website. (http://www.tectoy.com.br/downloads_interna.php?idproduto=25)

I submitted the image as a derivate work of Master System II, because Master System 3 uses a slighly modified version of the Master System 3 hardware and a brand new design, and black painted versions of the Sega Genesis 6-buttons controllers. —Preceding unsigned comment added by Alexkidd099 (talk • contribs) {{{2}}} (UTC)

On the Image:Master System 3.JPG page, you listed the source as Image:Master System II.jpg, stating that your image was derived from it. What that is supposed to mean is that you created the Master System 3 image by editing the Master System II image; it has nothing to do with the creation of the object in the picture - that sort of thing can just be mentioned in the "Description" field. I don't know why Herby reverted your addition of the actual image source - he probably just assumed it was vandalism because it came from an IP. I should note that I don't immediately see anything on tectoy.com.br [5] mentioning a GFDL license, so I'm going to re-tag the image as "no permission". If it really is GFDL, you'll just need to point to the part of the source web site that says that, or follow the method at COM:OTRS. --dave pape (talk) 16:54, 12 August 2008 (UTC)

Dave, I am having a lot of trouble understanding the different licenses. Could you please explain to me when it is appropriate to use the fair use licensing? I noticed that other contemporary artists' pages use this license to upload their works (for example, Ashley Bickerton. Also, when uploading and editing images, who exactly is the author? Is it the photo credit or the artist? I was told to use the phrasing, "Courtesy of the artist and Gering & López Gallery" (the gallery I'm in contact with); where should I place this information? Thanks for clearing that up. Now here's another mystery. I have put quite a lot of work into Leslie Ward and noticed today that Image:Leslie Ward01.jpg uploaded 2 May 2007 by Paul Venter had been deleted. Looking at the deletion log I see that User:Samulili deleted the image on 10 July 2008 giving as reason Not in the public domain in the country of origin (less than 70 years since the author's death). The PD-old-50 tag is ill-placed here. Botev 11:16, 12 May 2008 (UTC)- Deleted. No valid license. Samulili (talk) 08:20, 10 July 2008 (UTC). Now this is patent nonsense Leslie Ward, the artist died in 1922 (86 years ago). How can users like Botev and Samulili be given free rein to do this sort of thing without any checks or balances? No, that's not a useful site. Maybe buried in there somewhere are some properly free images, but it's clearly full of copyrighted material taken from the Web ("recopilados por la red") or other sources without proper license. I readily found the photo of the drummer on Goldfinger's Myspace page, and wouldn't be surprised to find the rest there as well. James Young imageEdit

I noticed that you raised a question about the image of chemist James Young, which I uploaded in early October. According to this Cornell University web site the picture is in the public domain in the US since publication was before 1923. That same site says that public-domain status in the US is not altered by the fact that the picture may have been first published outside the US. The PD-US tag apparently applies. - I'm certainly no expert on this stuff, so any additional insight on such matters is welcome. Astrochemist (talk) 00:24, 25 October 2008 (UTC)

Guadalupe Salcedo and Dario Silva Silva's portraitsEdit

Hi Dave Pape. About the Guadalupe Salcedo´s picture (deleted since a few days), this picture was download from Biblioteca Luis Angel Arango's web site. The Luis Angel Arango Librery is the most important public library from Colombia, so documents, books, pictures, images and all material posted in this site, is public domain.

Anyway, like the user fefogomez indicates about the legal use of portraits in Colombia --copyright about portraits: Every portraids in Colombia are the public domain because it's covered by 36th article from Law 23 of 1982 and I quote: "copyright regulations, according to which the publication of a portrait is free, when related with scientific, didactic, or cultural purposes in general or with facts or events of public interest or that have been performed in public" (Spanish version: "Artículo 36. La publicación del retrato es libre cuando se relaciona con fines científicos, didácticos o culturales en general, o con hechos o acontecimientos de interés público que se hubiesen desarrollado en público").

The portraits and pictures posted in Guadalupe Salcedo: Image:Guadalupe_Salcedo.jpg, Image:Ninos asesinados.jpg, Image:Entrega guerrilla liberal.JPG, and Image:Guadalupesalcedo y Dumaraljure.jpg are public domain, because was first published in Colombia and I'm used for didactic, educative and cultural purposes at Wikipedia.

This also applies to Image:Dariosilva.jpg, and Image:Rev Dario Silva Silva.jpg posted in Darío Silva Silva article.
