Anders Behring Brevik's photographs edit

Hello Herby; seeing the way you closed the vote on Breivik's photograph - don't you consider that all the files in the same category (i.e. Category:Anders Behring Breivik ought to go as well following the same argumentation (which I posted in my deletion rationale)? All the files (except the PDF of Breivik's detention report) have been copied from his manifesto, so these follow the same restrictions and copyright issues. We cound try to consider each of the pictures a self-portrait... everything could be achieved with a delayed-timer shutter release and a good light. The rationale I see behind all the pictures in question is the license, since they all come from one source - Breivik's manifesto - and all, as the whole content of his work, have been made available freely to all the Europeans (not the exact wording, but you'll find the original in deletion discussions for sure). Considering the legal status, especially lack of clear permission, I would remove them all (per the argumntation above), but naturally, community discussion is appreciated, as long as it is not emotional. You deleted the image with the argument that you have not seen anything that would convince you that the owner has legally released it. However, there have been a nunber of arguments in the discussion why it is very likely that the image was indeed legally released by the owner. And you fully disregarded all arguments that nothing about a copyright infringement has been proved or even seemed likely. I think you should have considered BOTH sides, not just one, as you did. And that has nothing to do with "emotional discussion", just, obviously, with the weighting of arguments. The copyright infringement was, and is, just an allegation and no evidence for the truth of it has been unearthed or forwarded throughout the discussion. Frankly I am insulted to think that you would believe I did not consider both sides of the argument however I see your experience on Commons is limited so maybe I should ignore that aspect.

The issue for Commons is solely "has an image been validly freely licensed?". As we are not even sure of the actual copyright holder of this image then equally we cannot be sure that is it has been validly licensed and that is that. If wrongdoing, such as copyright infringement is alleged, proof is, of course, needed. That's the way justice goes - if someone is sent to jail it's because his wrongdoing was proved and not because his innocence couldn't be. Commons Delinker question edit

Hello Herbythyme,

is there any way to automatically replace a file across several wikipedia versions if that file has already been removed by Commons Delinker? It's about those Avaya images, now deleted, which Geek 2003 wants to replace with new images. Most of them were used only once, on the English wikipedia, but File:1140E-7.JPG was used several dozen times across several projects, if I remember correctly. I am not ignoring Copyright requirements, it is because I am not used to such requirements. It is too complicated. Myself I am a professional photographer and I have worked many many years for AP and Time Life, if you know what I mean. You dont need to tell me all that nonsense. And another thing, if you as an administrator dont estimate my work uploading pictures for WP Commons, I feel sorry for you. Please calm down and stop making accusations. Remember that while you may have worked for Time Life and the AP, here you are simply an anonymous user, about whom we know nothing other than that you have a beautiful image of Freiburg on your user page, and you have uploaded 129 images on Commons, some of which have had licensing problems.
There is a simple problem here. The image is the cover of a magazine, which is certainly copyrighted. There is no evidence that the magazine, Veja, has given the necessary license for the cover to be kept on Commons. Please have the magazine do this using the procedure at Commons:OTRS. No, I can't, I'm afraid. I am always online at my work computer on weekdays anyway and do look at my watchlist, so when that Brazil flag got edited, I couldn't unfortunately, revert the first one, but I reverted the second piece of vandalism. I am not contributing much at the moment, because of what's been happening, but that person whom I believe is the same one editing my talk page, I like to keep a look out for them. You always seem to be around conveniently when such vandalism occurs. There are links between you and the vandal edits and it is far more likely that it is you than someone else all in all. The possibly that someone else would edit in such a way is extremely low - it is not the first time I have seen such behaviour.

User CriciumaSC edit

Hello Herbythyme, is it possible to check if User:Pseudo is related to CriciumaSC case? As I have explained to Martin, like previous sockpuppets, an ip (the same one) has inserted the image to pt:Criciúma article just after it was uploaded here. HelitonEsteves has just added to Wikipedia a photo uploaded by Webmast here. This time, he wait some time to use the image, what may be an evidence it's not the same person or maybe just and strategy, since it would not be easy to find this uncategorized media. I need advice and, perhaps, action. I'm going to give you all the threads involved, read what you choose:

in which the uploader is not involved.

At the DR and on my talk page, there has been nothing but support for my decision, and I have no doubts that it was correct -- we would need OTRS permission from Lucasfilm to keep the image. At the Featured Picture nomination, however, it's about even, which is sort of scary. Since I never frequent those parts, I have no sense for the activity there.

The uploader, User:Tomascastelazo has made it clear that he does not respect our rules on copyright:

"In this case, the picture is that of a public event, where the object in question is shown within a context. If someone is to use the image as a copyright violation, then let the owner hash it out against the offender, why should the community defend a private individual who chooses to display his goods in public? That is the risk he takes!"

I have not looked at all his other files -- except File:Leon hot air balloon festival 2010.jpg, about which I was specifically asked, but I would guess that there are other problems.

I'm tempted to close the FP nomination as vandalism, go through the rest of his files for other problems, and then block any further reaction, but I think that's probably an over-reaction. I'm also aware that, save for these and maybe a few other problems, he has given us a wide variety of perfectly beautiful images. That doesn't excuse the problems, but it does make dealing with them harder than a simple vandal who we can just blow away.

These are just thoughts for now though
Tomascastelazo has behaved badly and seems to wish to ignore copyright when it suits him. However the timing of the DR etc was at best unfortunate. We cannot ignore copyright to suit FP folk I'm afraid.
I profoundly dislike this aspect of copyright issues because at the outer edges of the outcomes I don't see as much clarity as I do in other copyright issues. However this is clearly derivative (as is Jebulon's edit of the same image) to me.
All in all I fully agree with your logic and actions - I would ask you to maybe take a breath for now rather than take any further action though. In the end FP folk are a different genre to most folk on Commons - although I rarely visit the area now I do know that - and sometimes logic goes out the window.
Maybe post on an admin board just to broaden it out but if Tomascastelazo does not behave better there may only be one outcome available sadly. --Herby talk thyme 13:11, 10 August 2011 (UTC)Reply

    • Simple - you created that file not to attack the dilemma between copyright law and the photographer (which would have been valid as others said there) but to attack Commons adherence to the law and the work of the admin concerned. That is bad behaviour in my book. Your block of Dendrolo edit

In July, you blocked Dendrolo here with a block reason of (Abusing multiple accounts: cross wiki), even though the account had only edited here but once, last November. I have extensively researched the issue of Brox/Dendrolo/Redegavimas (all acknowledged socks) and it appears that a transient problem with the Dendrolo account (one day of arguably disruptive editing) on nl.wiki was conflated, though what appears to be a set of nl checkuser errors, compounded by an unclear meta checkuser report, into a claim of "cross-wiki" abuse. The meta issue has been cleared up.[7] Dendrolo is an active user on de.wiki, and may need to edit commons under that name. I will suggest to Brox that he explicitly link the accounts here, but will you please consider unblocking? I'm seeing no reason for the block that applies to commons, at all. Reviewing this I see the user is blocked on other wikis so I personally see no need to revisit the block currently. If the situation changes than there might be a need.
As with any rights mine were granted by the community to serve the community so it would probably be best if you were to ask the community via the pump or the admin boards if you feel this is wrong. Checked into Commons again - it's been a while. I had a good look around, I even followed a link from Mattbucks talk to COM:AN/U (which I unwatched a long time ago...)- that was depressing I also saw some very nice new uploads, and a lot of sensible and patient comments on talkpages, so I realise that this project is in good hands even though a lot of the people most active a couple of years ago aren't around any more. Do you think it would now be at last possible to get some kind of formal, documented, citable ban decision on the puppetmaster? The last few times he's popped up with new socks, it's been rather frustrating trying to get Commons admins to take rapid Block-Revert-(Delete)-Ignore action, which is the only thing that helps, in the absence of something analogous to the formal community ban we have on en-wiki on other projects. And every time it becomes necessary to discuss this case and try to persuade admins to act, that is always an occasion triggering a stream of follow-up disruption, just as we saw with the multiple throwaway socks this time, which were created purely in order to disrupt that process. Weird (& shows how things change) - generally the Commons admins I know would do just that - block with no fuss. There shouldn't be any need to persuade folk to act in my opinion. Commons doesn't do "formality" but if you have issues and I am around I'm happy to help.

Yes I found some of those. He just seems like part of a normal day's work for a Commons admin. His behaviour is quite obvious. I know, range-blocking him is a pain. One "cosmetic" factor that may have contributed to the feeling of uncertainty in communicating the situation to admins unfamiliar with the case may be that the local instantiations of his original account names Wikinger (talk · contribs) and CBMIBM (talk · contribs) aren't currently even blocked. Hey, We have a serial socker creating hoaxes on en.wiki en:Wikipedia:Sockpuppet investigations/Akshata Sen/Archive, I found that some of the accounts were created on Commons too, one of them (User:Dispota 123 uploaded a copyvio File:Roshni Mukherjee.jpg (a real actor under a hoax name/role!). Would it be possible to block the socks here or would I need to file a local CU for that? Request review of deletion edit

Hi, this morning you deleted the file 63279_1756390757966_1484893223_1843282_2986581_n.jpg with this log entry. The user User:Maxikray added that image to en:Wetsuit on 12 May 2011 where it remained as a useful addition to the article until today. Maxikray removed the image from the article at 06:14 UTC this morning before requesting its deletion as "unused". You deleted the image an hour later. This did not give anyone else time to consider whether the deletion was warranted and I object strongly to contributors "taking back" their contributions without good reason. Unless there is an overriding reason not to do so, I'd like you to restore the image so that it can be returned to the en:Wetsuit article. Many thanks Herby, I agree it's not a great pic, but it's of historical interest - you don't see many wetsuits with a 'beavertail' and fasteners these days, so it's not so easy to replace. If I may, can I beg one more favour of you? The file name is so useless that I can't even add the file to a category because the wikimedia software complains about the name. Do you think you could rename/move the file to File:Beavertail wetsuit with fasteners.jpg or something similar (no redirect needed!). Actually it was re-uploaded and another admin caught it. Fortunately we are not en wp so we don't have those kinda rules and base judgements on behaviour on Commons (mostly) and at present I'm fence sitting which is uncomfortable but saves making big mistakes sometimes. Message from Circo M+T edit

Hello Herby, We have received the message that you left us in the User talk:Circo M+T titled "copyright violations".

First of all we would like to apologize if we surpassed or infringed or broke the terms and policies of wikimedia commons, we are inexperienced and weren't conscious of the messages left in the User talk: Circo M+T until there were too many.

On the other hand, We are really confused about the application of the terms for uploading images. We can't understand the reason why we are violating the copyright because we are the copyright holders, the owners of the original pictures, and the authors of many of them. But also we are the architects, therefore also the authors of the buildings depicted in those pictures. Some of those pictures had been uploaded before to several websites, but under our permission and we had always kept the copyright.

Now, because of the trobles we are finding in wikimedia, we are uploading this images as "public domain", renouncing to the sharealike creative commons licensing or even the copyright. They mean a gift or a present from us to wikimedia commons and wikipedia as a way to contribute to the common project of free encyclopeding. So we are really sorry if we have disturbed you, but we haven´t been able to transmit this in any other way to anyone until now.

We would appreciate if you could help or guide us with some advises about this issue.

Major Flickr review bot crash edit

As an Admin,

Can you ask other Admins to try to mark images in the flickr review needed category which is now very high at c.200+ images. I'm trusted but I'm busy on weekdays to mark images. Lymantria knows the situation as does MGA73 and Denniss...but it seems that no one else does and so, the backlog grows and grows. MGA told me Here he tried to contact Bryan but so far without success and the flickr bot only marks 1 image per hour. It has done this since November 11. I can only mark some images on weekdays, as I said. Maybe you can notify other Admins on a noticeboard somewhere...just this once please? Thanks. Have a feeling my essay will probably be a case of TL;DR for most people here. I think the lack of interest in galleries is root cause of the problem, as we don't have that many users and they are much more interested in uploading and categorising. A good gallery is hard to create, took way too long to select that sample and Shaldon only has ~300 images (compared to thousands for more important subjects).
Still I think the end result adds significant value to Commons over the category, and its definitely nice to see a gallery that isn't spam :)--Nilfanion (talk) 09:57, 20 November 2011 (UTC)Reply

It's not fair, what I have to do to be licensed?. You have me crazy, go for the vandalism, not people who are collaborating on Wikipedia.

Link placement on Commons edit

You have removed my link on the information about my image. As the manufacturer and owner of the photo I am sharing I would expect credit for my work.

How do I add an attribution "You must attribute the work in the manner specified by the author or licensor" that this product was manufactured by my company so it is not used in websites that will imply that this is their work (product). You granted permission to reuse files with the attribution to Canvasgirl. A far as I see Wikimedia Commons is reusing your uploads under this requirement. Imposition of further requirements is not supported by the license, therefore you must not change the attribution requirement. This not limits your ability to publish your work elsewhere with different licenses or different attribution requirements. --Martin H. (talk) 22:23, 26 December 2011 (UTC)Reply
Certainly your deletion request suggests to me that you only wished to contribute your images in order to promote the business you seem to be involved with.
While on Wikipedia you point to the fact that I have a link to a blog on my user page you should bear in mind I contributed many images to this project without any links and I still only have one link on my page despite the fact that I could place links on each of my images - my aim is to assist this project not promote my website. --Herby talk thyme 09:09, 27 December 2011 (UTC)Reply

Fae edit

Herby, I was curious as to why you changed your mind on Fae's RFA. Your comment "ho hum, leave it for now" - this is Wikipedia Review, they won't leave it alone, ever - they are a witchhunt if ever I saw one. I guess I am all drama'd out really. These days most of the folk who I knew and trusted have gone (with a few honourable exceptions). Some folk don't even reply to mails or whatever these days - nostalgia ain't what it used to be...
Hadn't realised it was the [[fill in appropriate expression]] folk from WR - almost makes me want to revert my change. However if there is that level of drama now it is just another step in the slide towards en wp style play where the arguments take precedence over the project (IMHO). It does seem to be going that way. I've been in the trenches of the porn wars, trying to stop people with fatuous reasons (and fat heads) deleting high quality images on the rationale of OMGAPENIS... it's really wearing me down :/ -mattbuck (Talk) 10:48, 28 December 2011 (UTC)Reply
Yeah I understand and sympathise (tho we are not quite on the same side!). In the end junk is junk and should be dealt with like that. However I would also argue that we do not need unlimited images of big ben or any other large upright objects that are out of focus, identical to every other one etc etc.
