Hello,

At OTRS we had determined that the permission was not sufficient. It did not say, as it should have, I release this image under the terms of the GFDL, but just you can use them. That is something totally different, and implies that the copyright holder gives permission for use by you on Wikipedia. (Also note that permissions like I allow the image to be used on Wikipedia under the GFDL are dubious. Although it might be legally correct, it implies that the copyright holder did not understand that anybody can use the image if it is GFDL.). To avoid these kind of dubious permissions, we encourage to have the copyright holder send an email using the example on Commons:Email templates. -- Bryan (talk to me) 19:46, 18 August 2007 (UTC)

Hi, Bryan, thanks for your message. However, read in the context of my e-mail, to which the copyright owner of the image replied, isn't it clear that the photograph was intended to be licensed under the GFDL? Hello and thanks for your message. The images are photographs of two-dimensional "works of art" and thus the original copyright applies. You are right to say that the Flickr uploader licensed them under a free license but didn't have the right to do so since we generally consider photographs reproducing live large-screen transmissions to be derivative works of the transmission (which is subject to the producer's copyright).
