Image:WhigJournal.jpgEdit

Please, upload it again with VALID SOURCE, to proof that it is really in the public domain. MesserWoland Dyskusja 08:51, 15 March 2007 (UTC)

I guess my concern wasn't about valid source... I was told it was deleted because it didn't have any categories. Well, I was told after it was deleted without warning, even though I had actually started a discussion page asking for help with proper tags for the image. Thanks for your help now, though. If you happen to come across these new versions I've just uploaded, let me know if I've done everything all right. They clearly display their 1840s publication date. I don't mean to be snippy, but I thought this Wikimedia stuff was more collaborative. I'm new to Commons but I've been on Wikipedia for quite a while. Anyway, that's all. Fair useEdit

Hi Midnightdreary. Here on Wikimedia Commons Fair Use is not allowed. Please see COM:L (section). Thanks. FrancoGG ( talk ) 02:24, 27 March 2007 (UTC)

Thansk for the heads-up... It makes sense now that you mention it!! Midnightdreary 04:07, 29 March 2007 (UTC)

Deletion requested by The Daguerreian SocietyEdit

A deletion request has been made on behalf of The Daguerreian Society for the image you uploaded to: en:Image:NPWillis.jpg The creator of the digital file contacted the Website Committee of the Society to report the file was taken from the Society's site without permission. Images appearing on the Daguerreian Society website may be covered under US and International copyright law and must not be copied or re-published without permission. For more information on this policy, please visit: http://www.daguerre.org/fairuse.php

Okay, so why was the new version, which was very different from the first file, removed? It was not taken from their digital scan (to my knowledge) and is found on several other web sites. There was no discussion, no warning, and no reasoning left for its deletion within moments of its upload. <sigh> -Midnightdreary 15:26, 26 May 2007 (UTC)
In a sense I have no problem undeleting the file BUT it had previously been deleted as a copyvio and frankly there is no real difference between the two images. I suggest you contact daguerre.org or User:Zzyzx11 the original deleting admin. I merely saw a re-upload of a very similar file & deleted it --Herby talk thyme 07:15, 30 May 2007 (UTC)
It's a very similar file? It's just a scan of a page from a 19th century journal... regardless of who scans it, it's going to look pretty similar. :) I'll keep trying to figure this one out though. Thanks for the reply! -Midnightdreary 17:35, 30 May 2007 (UTC)

My understanding of copyright is that if someone takes a photograph or a scan of something that is public domain, they can create a new, copyrighted work. That is why The Daguerreian Society can assert a copyright of their scan of a page from a 19th century journal. Any derivative work of that particular scan, including cropping the image, would be a copyvio.

Therefore, you are going to have to find someway to prove that someone else directly scanned an image from that 19th century journal. The best scenario would be for you yourself to obtain a copy of that 19th century journal and make the scan yourself. Images from other web sites may be suspect because they might not prove that someone else made the scan other than The Daguerreian Society.

That is far as I know. If you have any other questions regarding how this image should be licenced, you can post a message on Commons talk:Licensing. Thanks. Zzyzx11 23:34, 30 May 2007 (UTC)

That links actually says that works in the public domain can't have copyright on its derivative works (in reference to paintings, but I'm sure an engraving in the PD is just the same). It says, "You can also use scans from other web sites - they're not copyrighted, as long as they do not show the frame. Frames are 3-dimensional objects, so the photo may be copyrighted. Remove the frame (via cropping) and everything is fine." So, even policy says that daguerre.org has not real say in this manner (no offense to them). Even so, I'll try to find a copy of the original 19th century work and scan it myself. I'll upload it and I'm sure it'll be immediately deleted again without discussion or warning. I've been in publishing for about 7 years, and I've never seen such a complete confusion and bastardization of copyright law as I see here on Wikimedia Commons. Oh well, at least we're trying.  :) -Midnightdreary 03:06, 31 May 2007 (UTC)

Your questionsEdit

What is the image in question that you want checked out? There are many ways to delete files ... As for tranferring files, I always use: CommonsHelper. ttfn Evrik 17:25, 11 July 2007 (UTC)

Re: copyrightEdit

Thank you for your concern. I have changed the licensing tag so it should be fine now. Cheers, -- RedCoat 18:41, 26 August 2007 (UTC)

There seems to be a problem regarding the description and/or licensing of this particular file. It has been found that you've added in the image's description only a Template that's not a license and although it provides useful information about the image, it's not a valid license. Could you please resolve this problem, adding the license in the image linked above? You can edit the description page and change the text. Uploading a new version of the file does not change the description of the file. This page may give you more hints on which license to choose. Thank you.

Old Ship Church consolidationEdit

Hey, thanks for consolidating all those Old Ship Church images under one banner. Much appreciated. Also, I've enjoyed your ongoing work on the Ralph Waldo Emerson page. Have a lovely summer. Regards, MarmadukePercy (talk) 02:27, 25 May 2009 (UTC)

No problem! And thanks! --Midnightdreary (talk) 11:56, 25 May 2009 (UTC)

RenameEdit

I've approved your request for a file rename on the incorrectly identified 'Hartford House'. If you need any other images renamed, feel free to foward the link to me (along with justification for the move) and I'll take care of them. Sarcastic ShockwaveLover (talk) 17:38, 10 July 2009 (UTC)

Women's Rights National Historical ParkEdit

Thanks for providing more information on the source of the image File:WesleyanChapel.JPG. However, I went to the site you linked, [1] and the image is not on that page. We usually prefer to link the precise page on which the image appears, so that others can easily verify the copyright status. Powers (talk) 01:55, 23 September 2009 (UTC)

Looks like the page is gone now so I did the best I could. --Midnightdreary (talk) 02:36, 23 September 2009 (UTC)
Never mind; I found it for you and added the correct source information to the image description page. Powers (talk) 20:59, 23 September 2009 (UTC)
Great! Thanks! --Midnightdreary (talk) 11:41, 25 September 2009 (UTC)

US Stamp IssueEdit

Greetings, I was told by another editor to submit photos for stamps as 'my work' because I took the photos. Also 'Images' of stamps issued before 1978 are in the public domain.

~ Hello again, As must be evident, I am new to Wiki' editing, uploading, etc. The Wiki-Commons upload menu is a bit different from the one found at this address:

http://en.wikipedia.org/wiki/Wikipedia:Upload

Here I found this choice, or licensing tag:

# The work of someone else, who has given permission to release it under a free license or it is already under a free license

I don't quite understand why this choice is not available in the other comonns' upload menu. Also, when I chose 'Federal Government Source, it offered no Public Domain choice in the Licensing selection window. I certainly want to comply and do what is appropriate. If you know of the appropriate tag that covers images of government stamp issues in the public domain I would certainly employ it. Any and all help greatly appreciated. Gwillhickers (talk) 22:22, 23 February 2010 (UTC)

===============================================================

-- After a little 'exploring' I found the right procedure and tag. By selecting 'From a Federal Gov Source' it automatically tags the image as in the public domain. No insertion of any other template is needed. See my last couple of uploads to wiki' commons. (Battle of Saratoga 1777 Oriskany 1927 Issue-2c.jpg) and (La Fayette 1957 Issue-3c.jpg) -- Thanks for pointing me in the right direction.
