We know that this photo was published in Sweden in 1964, and the Swedish copyright has expired. Yet it was deleted after Commons:Deletion requests/File:Townes.jpg with the fuzzy reasoning that there is no proof that this had not been published somewhere else before - which we can apply to all photographs. There is nothing to support this. I now copmared with the chemistry prize portrait of the same year - similar background, likely same photo studio in Stockholm. /Pieter Kuiper (talk) 15:26, 4 November 2010 (UTC)[reply]

The "fuzzy reasoning" put forth by Blacklake, Justass, Jeff. G, and myself (the closer), is that this man had been a full professor at Columbia for ten years and was, at the time of his Nobel award, Provost (#2 or #3 in the administration) at the Massachusetts Institute of Technology. In those positions he certainly would have had a studio portrait, such as this one, available for various uses. There is no evidence that the subject portrait was not supplied by Townes or MIT to the Nobel Committee and others. There is certainly no reason to insist that the portrait was taken and first published in Sweden just because it appears on the Nobel web site - it also appears on at least nine other sites. We have these images:
both of which can be dated to 1964 and both of which show an older man than the subject.
Finally, this image, of Dorothy Hodgkin, which Pieter cites above may or may not be shot at the same place -- I count a different number of pleats in the drape -- but Getty images credits it to Keystone so, far from confirming that the subject was taken in Sweden, it confirms that the Nobel committee did not use a photographer in Sweden.      Jim . . . . It does not matter where the photo was made. This photo was published in Stockholm. And the photo that EB credits to Columbia is clearly not from the original negative. /Pieter Kuiper (talk) 23:24, 10 November 2010 (UTC)[reply]
You are correct that it does not matter where the photo was taken, just whether it was first published in Sweden. My point, again, is that these were very notable people long before they received the Nobel and would have had studio portraits taken and published in various places. Given that these photos were not taken in Sweden, it is a stretch to assume that they were first published there.      Jim . . . . Jameslwoodward (talk to me) 23:53, 10 November 2010 (UTC)[reply]
You are making it up! There is no evidence that File:Townes.jpg was not made in Sweden. /Pieter Kuiper (talk) 22:08, 22 November 2010 (UTC)[reply]
Oppose undeletion. There is pretty good evidence, as explained by Jameslwoodward, that this photo was not taken or first published in Sweden - to be conservative, we should exclude it. Dcoetzee (talk) 07:28, 12 November 2010 (UTC)[reply]

Kept deleted Dcoetzee has the gist of it. There is no evidence that this image was made/published in Sweden, so we cannot assume that it is free. -- Avi (talk) 05:38, 1 December 2010 (UTC)[reply]

undeleting of photo edit

Dear Sir/Madam

Please undelete the file FeldmanPM, since it's the file from my private albom and I don't need to provide any lisence. The photo is of my grandfather, who died 73 years ago.

Thanks in advance, Sergey

I have looked at the file File:FeldmanPM.jpg. There are two issues
  • Who is he? Is this photo within Commons:Project scope by serving some educational purpose? Although File:FeldmanPM 1930.jpg appears to show notable people (Stalin?), it does not identify your grandfather and I find no Russian Feldman in WP:EN.
  • Although you may own the actual photograph, the photographer, or his heirs, owns the copyright. It seems unlikely, if your grandfather died 73 years ago, that you are the photographer. Therefore we need to know who the photographer was and when he died in order to establish the status of the image.

Please see my comments at your previous request. I note that File:FeldmanPM 1930.jpg appears to have a photographer's signature in the lower right corner. We will need to know who that is and when he died.     Jim . . . . Jameslwoodward (talk to me) 14:25, 15 November 2010 (UTC)[reply]
