Audiencia Pública del 153 Período de Sesiones de la Comisión Interamericana de Derechos Humanos (CIDH) Martes, 28 de octubre de 2014 → Extracto del informe sobre el 153 Período de Sesiones de la CIDH http://www.oas.org/es/cidh/prensa/comunicados/2014/131A.asp La Comisión recibió información sobre la presunta falta de imparcialidad de las Salas Constitucional, Político-Administrativa y Electoral del Tribunal Supremo de Justicia como consecuencia de la modificación en 2004 de su ley orgánica que determinó el incremento en el número de magistrados que integran dicho Tribunal y su nombramiento por mayoría simple, en vez de calificada, por parte de la Asamblea Nacional. Los peticionarios informaron que en un estudio que realizaron de más de 40.000 decisiones, la vigencia del referido sistema de nombramiento así como del control político ejercido por altas autoridades del Estado, habría ocasionado que entre los años 2005 y 2013 se fallara consistentemente a favor del Estado. El Estado afirmó que los jueces y juezas fallarían de conformidad con lo establecido en el marco normativo e indicó que la investigación presentada por los solicitantes no representaría una evidencia en sentido contrario. La Comisión manifestó que el estudio presentado por los solicitantes sería cuidadosamente analizado y reiteró que los sistemas de selección y nombramiento de operadores de justicia deben revestir garantías que aseguren su imparcialidad. Public Hearing on the 153rd Session of the Inter-American Commission on Human Rights (IACHR) Tuesday, October 28, 2014 → Extract from the report on the 153rd Session of the IACHR: http://www.oas.org/en/iachr/media_center/PReleases/2014/131A.asp The Commission received information concerning the alleged lack of impartiality of the Supreme Court’s Constitutional, Political-Administrative, and Electoral Chambers as a result of a 2004 change to its organizational law, which increased the number of justices on the Supreme Court and determined that their appointment by the National Assembly would be by simple majority rather than qualified majority. The petitioners reported that a study they had done of more than 40,000 decisions showed that this appointment system, as well as the political control exercised by high-level State authorities, meant that from 2005 to 2013 the Court consistently ruled in favor of the State. The State asserted that judges’ decisions were based on the provisions established in the legal framework, and indicated that the research presented by the petitioners did not constitute evidence to the contrary. The Commission stated that it would carefully analyze the study presented by the petitioners, and it reiterated that systems for selecting and appointing justice operators must include guarantees of impartiality. In this regard, the IACHR expressed its concern over the continuing appointment of judges with an indefinite provisional status, and the failure to open up posts for competition. |
