Description
Português: ​A Terceira Seção do Superior Tribunal de Justiça (STJ), em julgamento de recursos especiais submetidos ao rito dos repetitivos (Tema 1.218), decidiu que não é possível aplicar o princípio da insignificância no crime de descaminho quando o acusado já foi processado pelo mesmo delito, ainda que os outros processos não estejam concluídos e seja qual for o valor dos tributos que deixaram de ser pagos. O colegiado, entretanto, deixou aberta a possibilidade de aplicação da insignificância se o julgador entender que ela é socialmente adequada para o caso.
