パリ条約優先権の説明図（自作）。甲は、X国において発明aについて特許出願Aをした（2008年4月）。さらに甲は、Y国において、X国でした特許出願Aを基礎として優先権を主張し、同一発明aについて特許出願Bをした（2008年12月）。一方、乙は、甲とは独立に同一発明aを考えついたので、2008年6月に発明aについて特許出願Cをした。このとき、Y国では、甲の出願Bが乙の出願Cの後となるが、出願Bは、出願Cの存在を理由として拒絶されず、逆に出願Cは出願A（出願Bではない）の存在を理由として拒絶される。
