Description

Long before the US Food and Drug Administration was given regulatory authority over tobacco products in 2009, the FDA was compelled to move against various tobacco products for violations of existing food and drug laws. One of the most notorious of these occurred in 1958, when the FDA seized 2,671 bulk cartons (containing 26,710 packs of cigarettes) of Trim Reducing-Aid cigarettes on the grounds that they were misbranded and unlawfully introduced into interstate commerce.

Trim offered a double-your-money-back guarantee that smoking at least 3 cigarettes a day would help consumers lose up to 20 pounds in as little as 8 weeks without modifying their diet. The Cornell Drug Corporation, which manufactured Trims, claimed that their special patented formula of flavored tobacco treated with tartaric acid was an “absolutely harmless,” “clinically tested and medically approved” method of decreasing appetite by causing sensations of “drying,” “puckering” and “tissue-shrinking” in the mouth.

Yet, following FDA’s action against the company, four different district courts held that by claiming therapeutic efficacy Trim cigarettes presented themselves as a drug, and were therefore subject to the Food, Drug and Cosmetic Act’s prohibition of false and misleading statements. Moreover, the courts determined that the patented formula constituted a new drug that required pre-market approval. As a result, Trim’s sales, much like their claim about weight, went up in smoke. Today, the FDA not only protects the public from such deceptive therapeutic claims, but fulfills its mandate under the Tobacco Control Act of 2009 to reduce tobacco-related health problems through pre-market review of products and public health education.
