This Helen Keller photo is likely not in the public domain, and won't be until 1/1/2009. I went through this earlier today. Basically, the rule is this: If the photo was created less than 120 years ago as of the end of this year, AND it is by an unknown creator, THEN the copyright expires on 12/31 of the year in which the work turns 120. This photo was taken in July 1888. The 120-year anniversary is this July.
