Is Hans Thijs the copyright holder? edit

This file was posted on Flickr by Hans Thijs with a cc-by-2.0 license. Considering the date of the picture (1949) and the profile picture of the Flickr stream owner, it seems that Hans Thijs is too young to have taken the picture himself. If he is not the author, is he the copyright holder? Therefore I looked at his photostream on Flickr.

  • The file is part of "B&W", a set of 104 black and white pictures, amongst a huge collection of 13,593 files posted on Flickr by Hans Thijs. On the B&W-page, he writes: I don't have a working scanner for now, but I have a lot of B&W negatives of old in a box waiting to see the world ;-) Looking forward to post them all... This is all I have for the moment.
  • The file was posted in January 2008 together with four other pictures of Dutch soldiers in Indonesia, all dated 1949. One of the pictures has the caption Our boys on patrol near Lake Toba, 1949. These five pictures were made by a good photographer and since their captions do not reveal a personal link, it may be possible that they were made by a professional photographer. On the other hand, e.g. his dad could be a good photographer as well. However, since Hans Thijs seems to have all the negatives, it is not very likely that the pictures belong to a professional photographer. Consequently, it is more likely that Hans Thijs inherited these pictures from someone who took them (while on active duty?) in Indonesia, possibly his dad.
  • The other B&W pictures Hans Thijs scanned have captions like: Dads new car (the license plates of the car were issued in 1989); Drive way holidayhome Hungary 1988; Dad, sis and I on the go in Vaals '69. The captions indicate that these are family pictures only, probably inherited from his parents.

All in all, it seems that all these B&W pictures are old family pictures, underlined by the fact that Hans Thijs says he has the negatives. Though it is still possible that someone else is copyright holder, I think it more likely that Hans Thijs inherited these negatives and that he is the copyright holder. Therefore I suggest we use the file based on Hans Thijs' cc-by-2.0 license until someone else can submit that he is the rightful copyright holder. Encyo (talk) 20:11, 9 April 2011 (UTC)Reply
