The pictures edit

Thanks for your message on my talk page. I see that you erased it, but it had the same information as your other messages. You can definitely write the links to the pictures that way when you ask for more advice at the OTRS noticeboard COM:ON. It's better to wait until you have rested. Don't worry. I will cooperate as much as possible with you, and there is plenty of time. Thanks for your courteous messages. But if you could tell me more about the suggested declaration of consent given to you at Wikipedia, that would help a lot. I have no idea what that could be. Hi Dontreader, yeah i took it down from your talk page because we had already started a conversation about it elsewhere (i had sort of responded to the copyright thing in a few places during a brief period of not knowing what to do about it, so i deleted it from your talk page because it seemed to me to be pointless to have that discussion in multiple places...). anyway, i'm going to try and work out the process i went through when i uploaded the pics and type it up here shortly (hopefully). Hi Dontreader, okay, firstly (i think) i identified myself as the source by typing "Own work" in "Original source". Then i think i did the same thing for "author". Under "Licensing" i'm pretty sure i selected:
"Own work, copyleft, attribution required (Multi-licence GFDL, CC BY-SA all versions" which i think also had "recommended" after it in brackets, which is why i selected it, although the word "recommended" does not appear now when i try to do the same thing with a test file... I just tried to recreate the process but was unable to complete it. So.. how to proceed? Should i delete the pictures and attempt to re-upload in a different way? Is there something else i should do re copyright questions (I do own these pics, i just don't know how to prove that over this exchange on the internet). Please advise. Thanks, Arigateau
Hello, Arigateau. Thanks for your reply. Now I understand better. You did the right thing when you uploaded the files, but two important details are missing: you should have sent in the declaration of consent COM:CONSENT email after you uploaded the files, as soon as possible, and then you should have added an OTRS pending tag to each file page. This is because the picture can be found on the Internet. If I simply take a nice picture of a mountain, for example, and I upload it to Commons (here), then I don't have to send in a letter or place the OTRS pending tag because my picture won't be on the Internet, and no one will suspect that there might be a copyright violation. This is how a file page looks when an OTRS pending tag is added: like this. Notice the yellow triangle and the message. If I had seen that on your files, I would have moved on to other files (I go through lists of files that I believe should be nominated for deletion).
At some point an OTRS volunteer removes the OTRS pending tag and permission is formally given to use the file (the file page will show an orange OTRS symbol). But in your case, keep the files on the Wikipedia page. I will help you with the declaration of consent. I can also add the OTRS pending tag to the file pages when you have sent in the letter. The big problem that I see is that you are the writer and the director of the movie, right? If that is the case, then you might have difficulty making the volunteers believe that you own the pictures. They might think that the producer owns the pictures, not the director and the writer. Or they might think that the company that released the movie owns the pictures. What would you say if they tell you that? Thanks in advance for your reply. Hi Arigateau. I found this page, and I think you should read it to see if you are able to release those screenshots under a free license: Commons:Screenshots. Maybe this issue is more problematic than you expected. If you believe it's impossible for you to give permission to use the screenshots, then maybe a fair use "rationale" could be used, but that is not allowed on Commons. It is allowed on Wikipedia, where you can also upload pictures, especially if a fair use argument is needed. Please let me know what you think. Here is an example of a fair use argument on a file page uploaded to Wikipedia instead of to Commons: HERE. Please study it carefully. It might be your best choice. Hi Dontreader, yes, how complicated this has become. In brief: 1/ I have amended (correctly i think) and emailed the declaration of consent form. 2/ I have kept the files on the Wikipedia page. 3/ Yes, please add the OTRS pending tags to the file pages (i have no idea how to do that). 3/ What would i say to a volunteer who doesn't believe that i own the pictures? I'm not sure what more i could possibly say to someone who might be determined not to believe me. I am the writer, director and owner of the film. The film has two listed producers (and two listed executive producers) but none of them are the owners. In the case of a big-budget studio film it might be possible that the producer might be the owner, or represent the owner, but this is a low-budget short film under ten minutes duration and i am the owner of it. I don't have a contract with myself about that. I'm not sure what more i can say about it. 4/ The two jpegs are indeed screenshots which were captured in Final Cut Pro towards the end of the edit nearly ten years ago. Is it a problem that they are screenshots? They are the two pictures (apart from the poster image i suppose) which are most associated with the film, one of them (i think, off the top of my head), for example, also appears on the British Council web page for the film. There are some location stills (ie not screenshots) which sort of show the same visual kind of information (though much blurrier) which i think i have somewhere on an old external hard-drive.. How to proceed? I'm not ordinarily a Wikipedian. I am the sole owner of the images. I am happy for them to go into Commons and onto Wikipedia under whatever licence is appropriate and least complicated... I don't think i have much more to add. If after all this you still want to delete them then i guess you just go ahead and delete them. I don't mean to suggest that i am in some way unusual but i kind of just have too much other stuff to do this week and don't have time to defend every nuanced possibility that they're not my pictures. They're my pictures, i'm happy for them to be used, i've filled in and emailed the consent form (which i had no idea that it even existed before you mentioned it). If you can add the OTRS pending tags (again, i had no idea about that) then i would be very grateful. If after all this the pictures are deleted then so be it and i will come back another time to it. Hello Arigateau. Thank you for your reply. I have added the OTRS pending tags to the files. It is very easy to do. You will see the yellow triangles now and a message next to them. All I did was click on edit page, and I added {{OTRS pending}}. As you have probably noticed, I have also mentioned on the request for deletion pages that you have sent in the declaration of consent, and that I added the OTRS pending tags. This should protect the pages from deletion.
I think you are in a very good position to defend ownership of the screenshots. If they ask you the question that I asked you, just copy and paste what you wrote to me above.
Please, did you send in the letter using this address: bonjour [at] dominicthackray [dot] org ? That is the proper way because the images are on that website (http://dominicthackray.org). It's important to use an email address that is associated with the website that is the source of the pictures. If not, just copy and paste your letter into a new letter and send it from that email address.
Also, did you include this link? http://dominicthackray.org/?page_id=52 Of course you know that's where the pictures are. If not, just wait and they will ask for that. Or else you could send a second letter just adding that information, but including these links to the pictures on Commons: https://commons.wikimedia.org/wiki/File:GirlfriendInaKimono_Pistol.jpg and https://commons.wikimedia.org/wiki/File:GirlfriendInaKimono_PennyRimbaud.jpg
Those three links (the link to the pictures on your website and the two links of the files here at Commons are essential, and also the email address that I mentioned). If you have done all of that, I think you will not have any more problems. I apologize for taking up your time. I know that you have many important things to do. And of course I don't get paid to patrol Commons either or to give advice. The sad thing is that there are countless people who commit copyright violations here, people who just try to fool the system, and I can't know who is authentic (like you) and who is a liar until later. Most people never challenge my deletion requests because they know I have caught them. But obviously your case is very different. I do wish you all the best, and I hope you sleep well. Hello once again, Arigateau. If you used a different address but it's associated with that website then that's all that matters. For example, info@dominicthackray.org, contact@dominicthackray.org or anything that ends in @dominicthackray.org. And as you said, just mention your website's URL if they ask for that information. I'm glad you included both links to the pictures on Commons. I have noticed that there's a severe delay with responses and with processing letters, so please be patient. I have been waiting for over half a month for my latest uploaded file to be approved. There are very few volunteers in that department (it's a very difficult and technical job, and they don't get paid). It's amazing to me that anyone is a volunteer here, or an administrator here or on Wikipedia. Very admirable. Anyway, in the worst of the cases, if your pictures get deleted, they will automatically be restored once they process your letter. My picture is in theoretical danger of being deleted too, until the declaration of consent is processed. Thanks for being so courteous. Have a good night, and let me know if you need any more advice. Hi Hi Dontreader, i received an email this morning from permissions-commons which said "I have made the necessary modifications to the file page" and notice that "Hi, I charge an email from Dominic Thackray, and has provided the corresponding ID ticket. Sincerely. --minhhuy (talk) 10:39, 18 April 2015 (UTC)" appears now on the nomination-for-deletion page for each picture ad that the OTRS on each picture's actual page has changed to "The permission to use this work has been archived in the Wikimedia OTRS system. Full documentation is available only to OTRS volunteers as ticket #2015041410000063. If you wish to reuse this work elsewhere, please read the instructions at COM:REUSE. If you are a Commons user and wish to confirm the permission, please leave a note at the OTRS noticeboard." but that each picture's page also still says "This media file has been nominated for deletion since 13 April 2015. To discuss it, please visit the nomination page. Do not remove this tag until the deletion nomination is closed."... so is everything alright or are they still up for deletion? Please advise. Hi Arigateau! Yes, I saw that information because those deletion discussions are on my watch list. If you look again, you will see that I have withdrawn my nominations for deletion. Even if I had not withdrawn my nominations, the discussions would have ended soon with a "keep" vote in each case because of what you said: permission has been given to use the pictures. I'm very happy for you, and I'm grateful to you for cooperating with me to solve this problem. Now nobody else can come in the future to nominate your pictures for deletion. They are safe forever. The Asian volunteer worked very quickly for you, so maybe you should go to his talk (discussion) page and thank him. One way to thank people on their talk page is to click on the red heart button (near the top pf the page) and choose a type of food, for example, or a star, and include a message, but don't sign it with ~~~~ because it will sign your message automatically.
