La foto di Sommariva di Davide Campari non è libera perché Sommariva è morto nel 1956, quindi bisogna attendere almeno altri dieci anni ;-) Ellin è stata un po' troppo prudente, ma in realtà la regola del 1923 si applica per le opere statunitensi e solo in casi particolari su quelle non statunitensi. Su Commons un'opera deve essere in pubblico dominio per la legge USA, ecco perché ha parlato di 1923. In realtà per essere in pubblico dominio negli Stati Uniti un'opera italiana deve essere:
  1. creata da un autore morto prima del settantunesimo anno precedente all'attuale (per quest'anno, fino a tutto il 1945) oppure
  2. qualora fotografia di scena, pubblicata prima del cinquantunesimo anno (per quest'anno fino a tutto il 1965) oppure ancora
  3. se opera non artistica e senza indicazione di copyright, prodotta in Italia prima del 31 dicembre 1976 e pubblicata per la prima volta in Italia non oltre il 31 dicembre 1978 (in questo caso bisogna indicare con i tag {{PD-Italy}} e {{PD-1996}}. Questo perché l'URAA protegge negli Stati Uniti qualsiasi opera non in pubblico dominio al 1° gennaio 1996 (ovvero: se era in PD prima di tale data, allora resta in PD negli USA, se non lo era invece l'opera è protetta per 70 anni dalla morte dell'autore, se noto; normalmente dovrebbe altresì essere 70 anni dalla prima pubblicazione se autore ignoto; qualora pubblicata fino al 1923 e l'autore è ignoto è sicuramente in PD anche negli USA).

Comunque se si fa la foto di un quadro si ha il diritto di carcarla come lavoro proprio?
Nì. Se il quadro è di autore morto prima di 70 anni no. Altrimenti sì.
Se si trova una "vecchia" (più di 70 anni dalla pubblicazione) foto su internet e non si conosce l'autore (dunque autore ignoto) si ha diritto di caricarla giusto?
Nì. Ovvero, è , ma devi essere sicura che l'autore sia effettivamente ignoto. Anche se in quel caso, per risolvere il problema, fai prima ad appellarti a PD-Italia e non a PD-Copyright scaduto.
