  • The Arai helmet is very recognizable   But physically, not the driver. It would be any stuntman dressed up in the same clothes, like a movie double, no one would never detect the trick -- Basile Morin (talk) 07:20, 27 October 2022 (UTC)[reply]
I think the template is quite suitable in this case. Even if you think that the person is not recognizable here – The number on the motorcycle allows the driver to be assigned quite unambiguously. The person depicted still has the right to prevent himself from being misused for promotions etc. Of course, the personality rights applies here in a more broadly understandable sense. I did not write that. Please do not interpret such nonsense into my statements. My statements referred to the clearly recognizable person (who also wears a number on the racing suit btw), whose personal rights are the focus of this discussion. However, your associations unfortunately show that your knowledge of personal rights seems to be rather rudimentary. Sandro Halank (talk) 11:14, 27 October 2022 (UTC)[reply]
  •   Comment I have to second Julesvernex2’s second point. In Germany, where this photo has been taken, some politicians and lawyers propagate an extreme interpretation of the GDPR and of “personal data” – for example, that a photo which shows a license plate or similar identifiable features of a car or motorcycle injures the personal rights of the owner of that vehicle. As German politicians seem unwilling to demarcate the exact limits of personality rights and GDPR by law, we are still waiting for the Courts of Justice to bring more light into these questions. Until that, photographers in Germany are in an uncomfortable position, and I agree that it may be wise to use the {{PR}} rather too often than too rarely with photos taken in Germany. --Aristeas (talk) 16:15, 28 October 2022 (UTC)[reply]
The problem is this template tends to be used indiscriminately for so many uploads. The previous nomination was a snow hut with personality rights warning. Even photographs that have no connection whatsoever with any person display this message, like cameras with personality rights warnings, street signs with personality rights warning, banners, buildings, stadiums, bottles, etc. Under the same precautionary principle, {{Trademark}} is missing for the "Arai" helmet, {{De minimis}} for the "Pirelli" logo, and we would need a big red sign: "Don't do the same, this position is dangerous" :-) Basile Morin (talk) 07:04, 29 October 2022 (UTC)[reply]
Oops, I agree with Basile that personality rights warnings on (unmodified) cameras, street signs and bottles seem a bit too much, even in Germany. ;–) --Aristeas (talk) 17:27, 29 October 2022 (UTC)[reply]
