Wikimedia Commons does not accept fair use content.

We do this because Commons is a shared media repository. Downstream wikis have different policies based on local laws. Uses that are acceptable under US law, for example, may not be acceptable in many other countries with more restrictive rules.

In addition, fair use is not compatible with our aim as a collection of freely distributable media files.

Therefore, Commons cannot legally rely on fair use provisions.

Non-free content that may be used with reference to fair use may be uploaded locally if your project allows this.

Voilà ce qu'il en est : L'auteur (le propriétaire) du fichier n'est pas vous, mais Gallica. Mais la zone auteur a renseigner correspond encore à autre chose : à l'auteur de la photo, et ce n'est pas vous non plus. Si l'auteur de la photo peut être identifié alors cette image ne sera dans le domaine public que 70 ans après son décès. Si cette photo n'a pas d'auteur reconnu alors elle est dans le domaine public puisqu'elle a été publiée il y a plus de 70 ans. On peut aussi considérer que cette photo ne donne pas droit à propriété intellectuelle car la qualité est très mauvaise et la posture n'a rien de particulier.--Trouverunpseudoesttropdifficlesurcesite (talk) 22:08, 27 October 2019 (UTC)Reply

Bonjour, Vous avez associé à cette image une licence creative commons. Mais cette image est dans le domaine public, et le scan d'une image du domaine public ne donne naissance à aucun droit de propriété intellectuelle. Vous n'avez aucun droit de propriété intellectuelle sur cette image et par conséquent l'utilisation de cette licence ici est un copyfraud. Cette image doit être définie comme étant du domaine public. Merci pour ces explications. Je ne maîtrise pas vraiment les notions de droit et de licence. J'ai indiqué que cette photo est la reproduction d'une carte postale éditée après la mort de l'écrivain et ne prétend nullement en être l'auteur , ni en avoir quelconque propriété intellectuelle. Mon but n'était que d'illustrer un article et si ces photos de plus de 70 ans ne sont pas utilisables pour cela, je me range derrière le droit et ne tient à léser ni frauder quiconque, vivant ou mort. J'admets parfaitement que Commons les supprime (ce sera plus simple) et m'abstiendrais, à l'avenir, d'intervenir dans un domaine qui requiert des connaissances juridiques qui décidément me dépassent. Bonjour. Si vous connaissez l'auteur de la photo, peinture, texte etc et qu'il ou elle est décédé depuis plus de 70 ans alors vous pouvez la télécharger. Si l'auteur est anonyme ou qu'il s'agit d'une entité morale (agence de presse) et non d'une personne physique l'oeuvre entre dans le domaine public 70 ans après sa publication. L'image dont il est question ici semble entrer dans cette dernière catégorie, mais il est difficile d'en être certain.
