Notifying you of an image removal under the DMCA

An image that you uploaded to http://commons.wikimedia.org/wiki/File:Mistos1.jpg was removed based on the receipt of a takedown notice made pursuant to the Digital Millennium Copyright Act, 17 U.S.C. 512 (the “DMCA”). The Wikimedia Foundation (“WMF”) takes alleged copyright infringement very seriously and carefully examines each takedown notice received and the image in question for compliance with U.S. copyright law. This image was one of 59 photographs included in a DMCA takedown notice received by WMF of various publicly-installed sculptures around the world created by Claes Oldenburg and Coosje van Bruggen.

Some of these sculptures are located in countries that recognize “freedom of panorama” for sculptures, while others are not. Currently, U.S. copyright law does not recognize freedom of panorama for works of art, such as sculptures, and thus the copyright holder of a sculpture has the right to exclude others from publishing images of that sculpture, so long as it still enjoys copyright protection. While it is true that some of the sculptures in question here are located in countries whose copyright regime conflicts with the U.S’s regime, current U.S. conflict of law principles indicate that U.S. copyright law would apply in evaluating the scope of a copyright holder’s rights.

WMF strongly supports a change in U.S. copyright law that would extend freedom of panorama to artwork so that more people can experience beautiful and thought-provoking works of art that they would not otherwise be able to enjoy. However, WMF is a U.S.-based organization that must comply with U.S. laws as they presently exist, including U.S. copyright law, conflict of law principles, and the DMCA.

What can you do?

If you want to express your support for the extension of freedom of panorama to works of art (and you are a resident of the United States), you can write your U.S. senators and/or representative.

If you feel that this particular image does not infringe the alleged copyright holder’s rights, you can contest the takedown notice by submitting a “counter-notice” to us. Before doing so, you should understand your legal position and you may wish to consult with an attorney. If you submit a counter-notice, the alleged copyright holder can stop us from restoring the content by suing you. Please note that WMF will not be a party to any legal action that arises from you sending a counter-notice, and that WMF is unable to provide you with legal advice.

Tengo problemas con mis fotos subidas

Hola Carlos: Soy Adolfo; te pido ayuda porque no sé lo que tengo que hacer. Hace días subí unas fotos mias y me aparecen mensajes enormes en rojo lo cual me agobia un poco; más bien mucho ya que a los mayores (soy septuagenario) todo se nos hace un mundo. Se trata de [[File:C-16. Tte.Cnel Rovira en carro 001.JPG]] y las anteriores o siguientes. La verdad es que, ni siquiera leyendo las instrucciones -mi nivel de inglés es bajo- acierto a saber lo que tengo que hacer. Hace unas semanas subí otras, también hechas por mi y al utilizarlas en un artículo, Santuario de la Virgen de Bendueños, no hubo problemas, sin embargo a los pocos días no se cargaban y las hice a la vez que las demás. Con tanto ¡Warning! tengo un complejo de culpabilidad enorme. Te agradecería me echaras una mano a este viejo-novato. Muchísimas gracias. Mis fotos a punto de ser borradas

Hola amigo: Comprendo que puedan parecer que no sean mías pero las de B/N las hice yo con menos de 20 años y tengo casi 75. Las fotos de los dibujos las hice yo pues son dibujos de mi padre, ya fallecido, y que forma parte de un material que me dejó. Me dices que entras poco y yo tambien, y a este paso no se si me atreveré a poner alguna foto más. Todo lo que me dices de que has de ser fotos mías, etc lo sé aunque la primera vez que subí un par de ellas metí la pata. ¿Conoces a quien recurrir para que no las borren? ¿O a quien explicar este tema? Antes de marcarla con alguna plantilla quería consultarte. La imagen (que justo está hoy en la portada de es.wiki) no creo que tenga la licencia CC BY 3.0. En la web https://w33.bcn.cat/planolBCN/ca/ no está visible dicha licencia y en Avis legal tampoco dice nada. En caso de duda, si no se dice nada expreso no podría subirse con esa licencia. Me has puesto procede y he procedido así que no vale enfadarse. Sí, el aviso legal dice "L’Ajuntament de Barcelona permet la reutilització de totes les dades i informacions difoses per mitjà d’aquest web, sempre que no s’indiqui el contrari, amb les condicions següents: 1) no alterar el contingut de la informació; [...]" Esto es incompatible con la licencia CC BY que dices que tiene. Como alternativa los mapas de CartoBCN si tienen licencia compatible, que te animo que utilices. También OpenStreet Map o los mapas del Instituto Cartográfico Nacional, que supongo que ya conocerás. Parvis de la Sagrada Familia

Bonjour Cannan

La décision concernant le parvis de la basilique devait être prise en mai 2023, mais je ne vois rien de nouveau sur le sujet. (démolion de quelques bâtiments ou d'un quartier entier). Une décision a-t-elle été prise ou, comme je le pense, c'est toujours en suspens.

Les tours des évangélistes devaient faire 125 m et la tour de Marie 120 m, mais quand je regarde les photos prises de loin, il me semble voire clairement que la tour de Marie est plus haute. C'est peut-être une hauteur sans la croix et sans les sculptures des évangélistes. Aurais-tu une explication?. --Io Herodotus (talk) 17:09, 12 October 2023 (UTC)
