Tip: Add categories to your files

Thanks a lot for contributing to the Wikimedia Commons! Here's a tip to make your uploads more useful: Why not add some categories to describe them? This will help more people to find and use them.

Here's how:

1) If you're using the UploadWizard, you can add categories to each file when you describe it. Just click "more options" for the file and add the categories which make sense:

2) You can also pick the file from your list of uploads, edit the file description page, and manually add the category code at the end of the page.

[[Category:Category name]]

For example, if you are uploading a diagram showing the orbits of comets, you add the following code:

[[Category:Astronomical diagrams]]

[[Category:Comets]]

This will make the diagram show up in the categories "Astronomical diagrams" and "Comets".

When picking categories, try to choose a specific category ("Astronomical diagrams") over a generic one ("Illustrations").

広島県や長崎県の写真のご投稿ありがとうございます。File:Kyu_oonokobasyou002.JPGに説明文が写っていますが、これはどなたが書かれた文章でしょうか？こういった文章や絵のある説明板を大きく移した写真ですと、コモンズでは現作品に関して別個のライセンスが必要とされることが多いように思います。ja:Wikipedia‐ノート:屋外美術を被写体とする写真の利用方針#著作権法第４６条やCommons:井戸端/過去ログ5#屋外の看板（説明板）の画像は受け入れられるか？もご覧ください。ご同意いただけましたら、COM:OTRS/jaの手続きや即時削除をご検討いただければ幸いです。 --whym (talk) 13:28, 20 November 2013 (UTC)Reply

（上のコメントにインデントを付けさせていただきました）当該ファイルページ上に{{Speedydelete|uploader request}} という書式で（投稿からあまり日数が経たないうちに）投稿者として即時削除依頼を記していただけましたら、通常はそれを見た管理者が削除します。方針文書はCOM:CSD#General reasons に（ガイドラインですが）あります。今回はすでにご意思が明らかでしたので、削除させていただきました。 --whym (talk) 14:58, 23 November 2013 (UTC)Reply

三松正夫像の削除依頼について edit

Yasu です。首記の削除依頼でのコメントを拝見して、少々追加で説明させていただきたくやって参りました。

まず大前提として、ライセンスに関する方針により、コモンズに投稿されるファイルは商用利用可能なものでなくてはなりません。しかし、日本の著作権法第 46 条では、公共の場所に恒久的に設置されている芸術作品（彫刻・銅像・モニュメントなど。以下「屋外美術」とします）の利用を認めているものの、商業目的での利用は例外としています。すなわち、日本国内の「屋外美術」は商用利用ができないということになりますので、これらを撮影した写真はコモンズにはアップロードできません。この規定を説明したのが、上の削除依頼で引いた Commons:Freedom of panorama という文書なのですが、今回確認したところ、この文書の原文と、Opqr さんが参照された日本語訳版の間には内容の不一致がみられます。もしかするとこのために誤解されておいでなのかもしれませんので、以下に少し詳しく述べます。

日本語訳版にある「……野外に恒久的に設置されていていて、公衆が容易に見ることができる芸術作品を撮影したものに限っては非商業的目的……での使用を認めている。したがって下記の注1の著作権法の制約下にある作品でも、この条件を満たしたものは使用できることになる。」（強調は引用者による。以下同じ）という箇所は、原文では以下のようになっています。

Japanese copyright law allows the reproduction of artistic works located permanently in open places accessible to the public, such as streets and parks, or at places easily seen by the public, such as the outer walls of buildings, only for non-commercial purposes; therefore, such photographs are not free enough for Commons.
— （参考訳：日本の著作権法では、街路や公園など公衆が立ち入ることのできる開かれた場所、あるいは建物の外壁など公衆が容易に見ることができる場所に恒久的に設置されている芸術作品の複製は、非商業的目的でしか認められていない。従って、そのような写真はコモンズにおいては十分に自由利用が可能なものではない。）

また、その下の段落の「そのような条件の場所に建てられた芸術作品 （例えば建造物のようなもの）は撮影してもよい。そしてあらゆる目的のために撮影した写真は複写することが許される。」という部分は、明らかに誤訳を含んでいます。原文は以下のとおりです。

Architectural works (i.e., buildings) located in such places may be photographed and the photos may be reproduced for any purposes
— （参考訳：そのような場所に位置する建築作品（例：建物）は撮影してもよく、またその写真はいかなる目的のために複製してもよい）

つまり、「屋外美術」のうちコモンズにアップロードが可能なのは建築物だけである、ということです。制作から一定期間が経過して著作権が失効（パブリックドメイン）となったもの、画面の片隅に小さく写りこんだだけであってその写真の主要な構成物とは認められないもの（デミニミス）といった例外はありますが、原則的には建築物以外の「屋外美術」は削除対象になるとお考えください。参考までに、Category:Japanese FOP cases/deleted/3D artworks をごらんになれば、同種の「屋外美術」がこれまでにどれだけ削除されてきたかがお分かりいただけると思います。

ちなみに、著作権が失効してパブリックドメインになるまでの期間ですが、日本語訳版では「作者（または最後まで生存した共作者）の死後50年間」としています。この部分、日本国内では、という条件でいえば間違いではないのですが、コモンズはアメリカ合衆国にサーバを置いているため、ファイルは日本の著作権法に加えてアメリカの法令にも従う必要があります。アメリカではパブリックドメインまでの期間は 70 年と定められていますので、実際には作者の死後満 70 年経過していないとコモンズにはアップロードできません。従って、死後 50 年間経てば「以後は……コモンズで使用可能となる」という一文は誤りです（これに相当する記述は原文にはありません）。なぜ原文と日本語訳版の間にこれだけの齟齬があるのかは分かりませんが、コモンズの方針文書は英語版が正文であり、翻訳版はあくまで参考にすぎませんので、内容に相違がある場合は英語版の記述が優先することをご承知ください。

なお、削除依頼でのコメントを受け、Opqr さんのアップロード記録を拝見したうえで問題があると判断したものを追加で削除依頼に提出させていただきました。対象としたファイルについては以下の各節をご確認ください。コメント内で挙げられたファイルのうち、デミニミスが適用できうるもの (File:Ota bus terminal.JPG, File:Showashinzan and mimatsu masao statue.jpg)、制作年が不明で削除の根拠を証明できないもの (File:Sirotoriodori.jpg)、必ずしも芸術作品とは見なせないもの (File:Miyakomamoru.jpg, File:Sadosurume.jpg) は依頼対象から外しましたが、一方で「屋外美術」以外の理由で削除相当と判断したファイルをいくつか含めています。

最後になりましたが、ウィキペディア日本語版 (jawp) ではコモンズとは多少違ったライセンス方針をとっており、屋外美術を被写体とする写真の利用方針に従った形であれば、jawp へのアップロードは可能です。これらのファイルがコモンズで削除となった場合は、jawp への再投稿をご検討いただければと思います。以上、長文にて失礼しました。Yasu (talk) 15:18, 29 November 2015 (UTC)Reply
