he witness stand and asked as to whether hecould identify Durrant, he made the following statement, which showshow sure he felt in the matter, although he would not swear positivelyto it: I recognize him this much. Now, I am the claim adjuster of theSouthern Pacific Company, and if the paymaster should have told me,Durrant has a claim for $25 and it is subject to payment. I wish youwould take the money and give it to him, I should naturally have said:I do not know Durrant. I cannot give him the money because I donot know him. Then if the paymaster said, He knows you and saysyou were looking at him on the corner of Bartlett and 22nd streets lastFriday night. THE DURRANT CASE. 213 Friday night he saw a man waiting near the church and that presentlythe man was joined by a young lady and that the two proceeded tothe church, where they entered the side or rear door. In the neigh-borhood of 8 oclock a lad named Albert E. McElroy happened to bepassing the Emanuel Church, when he saw a man who looked likeDurrant met a girl on the sidewalk. Later on as he passed througha lot in the rear of the church he noticed a light in the lower backwindows and called the attention of his companion to the same. So far a positive identification of Durrant was lacking. After thepreliminary hearing there came forward one, Alexander Zenger, aRussian upholsterer employed by Friedman & Co., whose testimonyshowed to an absolute certainty that the couple seen to enter thechurch on that fatal Friday night were none other than Minnie Wil-liams and Theodore Durrant.
