  • Actually, US copyright law expressly allow interior photos of publicly accessible buildings, which is defined to also specifically include "garden pavillions". As for the Christmas decorations, I think they are arguably part of the building and de minimis anyway, but I will have to check to make sure. The interior wasn't the problem. The Christmas display, which cannot be considered de minimis in this image, is. It is artwork; it does not matter what the medium is. And per COM:FOP United States: "For artworks, even if permanently installed in public places, the U.S. copyright law has no similar exception, and any publication of an image of a copyrighted artwork thus is subject to the approval of the copyright holder of the artwork." To be fair, the problem isn't just this image—it's every image of Christmas lights we have in the US save those on federal government buildings.
