Morrison vs. Cregier, 138 Illinois Reports, p. 401:—While it is true that anterior to any statute on the subject, the rightto engage in the business of selling intoxicating liquors was a right rec-ognized and protected by the rules of common law, and stood substan-tially upon the same footing with other commercial pursuits, the rules ofthe common law in that respect have long since been abrogated by statute,and are no longer in force. The Dram-Shop Act, which so far as thismatter is concerned only took the place of similar legislation which hadbeen long on our statute books, declares the business of selling intoxicating:liquors in quantities less than one gallon to be criminal, except so far as itis expressly authorized and made lawful by license.
