Foto D'elia edit

Argumentas para hacerlo alguna contradicción en la información del propio file: (Copyright violation: the uploader has no rights over this picture. He clearly states that it was taken from Centro de Estudios de Historia de México, a research center, and then links it to a blog in Blogspot when a GFDL license is purpoted).

- Esteban Zissou (talk) 21:24, 11 December 2009 (UTC)Reply
Estimado Belgrano.

¡No te reconocía! :)

Al asunto, el mensaje lo enviaron el día 7 y decía "I hereby assert that I am the creator of the file http://commons.wikimedia.org/wiki/File:Bicicritica_abril_08.jpg and I agree to publish that work under the free license CC-BY-SA".

He llegado tarde. Ojalá encontremos una solución. ¡Muchas gracias!

Fotos, derechos, etc... edit

Hello. This is a reminder for you that it is important to address the identified issues instead of simply removing legitimate warnings and notices from your talk page.
Ferbr1 (talk) 12:23, 11 May 2010 (UTC)Reply

File:Malvinas spanish locations.svg edit

Hello! I removed the Category:Location maps of South America because location maps are empty maps (no names in it) for the use in a template to show a dot or other sign via coordinates. This map has got geographical names in it and it is not used in a template. There is no map like this one in Category:Location maps (2008 standard), so this one should not be there, either. It is the wrong category. NNW (talk) 13:15, 25 May 2010 (UTC)Reply

Sheet music edit

Hi Belgrano. I really think you're wrong here. A musical composition is a copyrighted work of art, and making sheet music based on the composition creates a derivative work. Therefore the sheet music cannot be freely licensed unless the composition is either in the public domain or released under a free license. May I ask where you got the idea that musical notes are not protected by copyright? Regards, Jafeluv (talk) 15:58, 6 June 2010 (UTC)Reply

I think you've misunderstood. The composition is not an idea, concept or a principle illustrated in the work (ie. the recording). It's an actual, original work of authorship in exactly the same sense a text, a painting or a sculpture is. I've uploaded quite a few sheet music pages here, and if you look at the pages they always specify the copyright holder of the composition. That's separate from the copyright of the musical recording. Jafeluv (talk) 16:52, 6 June 2010 (UTC)Reply
For the record, I've reverted your removal of the speedy tags. I have no intention to edit war over them, however. I'd just like another admin's opinion on this. Regards, Jafeluv (talk) 19:13, 6 June 2010 (UTC)Reply
I'm baffled to see that you think that there's nothing creative in selecting the order in which notes are played in a piece of music. A book is also a "list of universal concepts placed together" (a, b, c, d, etc.), but I don't think you'd argue that there's no creative input in which the letters are ordered in a work, or that the resulting text cannot be copyrighted unless it is read out loud by someone on record.
If you look at the section of US copyright law you cited, it clearly states that works of authorship include "(2) musical works, including any accompanying words" – note that sound recordings are a separate category (8) from this. Also, if you look at our licensing policy, it clearly states that the copyright of the composer as well as those of the lyricist, the performer and the recording company must all be respected. Jafeluv (talk) 06:37, 7 June 2010 (UTC)Reply
That's a very interesting reading of the copyright law. Apparently when you talk about the "song", you mean the musical recording. However, it is completely possible to compose a song and publish it without making any kind of recording. Let's take a concrete example: They Didn't Believe Me 1.jpg. That's a publication of a piece of sheet music from 1914. As you can see, there's a copyright notice at the bottom: Copyright MCMXIV, Performing rights reserved. This is before any kind of recordings were made of the song. We would not be able to host the file on Commons if it wasn't for the fact that its copyright has expired. But there was a copyright restriction, and for sheet music that was published after 1923, that copyright is in most cases still in effect. Of course, you don't need to trust my word on the matter; for example, we could ask for the opinions of copyright experts at Commons talk:Licensing, if you'd like. Re: File:Buenos_Aires-Recoleta-P2090056.jpg edit

Buenas!

Ferbr1 (talk) 07:09, 22 June 2010 (UTC)Reply

This seems like an object in the backstage, rather than a screenshot of a movie itself, so it's not unlikely (hard, yes, but impossible) for a common person to be aroun it and take a photo. In any case, it's speedy deletion if the source is provided, if the image may be a copyright violation it should go to deletion request Belgrano (talk) 19:10, 16 August 2010 (UTC)Reply
