Логотип Яндекса охраняется авторским правом, но фотография-то не логотипа, а офиса

Доброе утро. Я, собственно говоря в сомнении насчёт этого файла. С одной стороны я его снял фотоаппаратом с экрана телевизора. То есть это как бы моя фоторабота. Это копирайт? Доброе утро. Абсолютно всё, что передаётся по телевизору (за очень-очень-очень-очень редкими исключениями) защищено авторским правом и все манипуляции с ТВ-программами (кроме копирования для домашнего просмотра и добросовестного использования, по которому на Викисклад загружать нельзя) являются нарушениями авторского права. Аналогично нарушением АП будет фотография бутылки Кока-колы, но фотография офиса Яндекса, куда ЗАОДНО попал логотип Яндекса НЕ будет являться нарушением АП. А вот пример изображений, защищённых АП, но без которых никак нельзя обойтись: Радуев, Салман Бетырович, Эхо Москвы, Усама бин Ладен, поэтому они загружаются исключительно в рувики с обязательным обоснованием добросовестного использования. Thanks a lot for contributing to the Wikimedia Commons! Here's a tip to make your uploads more useful: Why not add some categories to describe them? This will help more people to find and use them.

Here's how:

1) If you're using the UploadWizard, you can add categories to each file when you describe it. Just click "more options" for the file and add the categories which make sense:

2) You can also pick the file from your list of uploads, edit the file description page, and manually add the category code at the end of the page.

For example, if you are uploading a diagram showing the orbits of comets, you add the following code:

[[Category:Astronomical diagrams]]

[[Category:Comets]]

This will make the diagram show up in the categories "Astronomical diagrams" and "Comets".

When picking categories, try to choose a specific category ("Astronomical diagrams") over a generic one ("Illustrations").

Т.к. в ВП и Викиновостях Вы не появляетесь, попробую написать здесь. 6 марта куча Ваших статей о передачах и персоналиях Эха Москвы были вынесены на удаление. Ну тогда вы можете переслушать все нерасшифрованные передачи и там найти что-нибудь интересное. Всё соответствует и даже без RTVi. Достаточно хотя бы посмотреть огромнейшую аудиторию радиостанции. Я это подсказывать не буду, пускай сами догадываются. Вы прочли пояснение на форуме? Это уже не раз комментировалось (например, по ситуации с БСЭ). Следует различать АП юр.лиц (1) первоначальные и (2) полученными ими по соглашениям (трудовым, авторским, лицензионным). ГК РСФСР. Статьи 484-486. Именно о этих первоначальных (а не приобретённых) АП юр.лиц говорится во втором абзаце статьи 6 федерального закона № 231-ФЗ

Более подробно о этом казусе можно почитать в комментариях Э.П. Гаврилова к Закону РФ "Об авторском праве и смежных правах" в части комментария к постановлению ВС о порядке введения в действие Закона, соот. норма статьи 6 федерального закона № 231-ФЗ является её "наследником".

Объясните почему это не применяется к фильмам. "Автору сценария, композитору, режиссеру - постановщику, главному оператору, художнику - постановщику и авторам других произведений, вошедших составной частью в кинофильм или телевизионный фильм, принадлежит авторское право каждому на свое произведение." "Авторское право на радио- и телевизионные передачи принадлежат передающим их радио- и телевизионным организациями, а на произведения, включенные в эти передачи, - их авторам." Надо ли развернуть кампанию по массовому удалению кинофильмов и тепепередач, выпущенных в 30-х и ранее? "Эти положения не распространяются на приобретение юридическими лицами авторских прав по договору." Может быть физлица были сотрудниками Огонька или Огонёк заключал договоры с авторами. Почему мы должны думать, что Семён Будённый оставил авторские права за собой, а не передал их Огоньку? Я думаю, что как и в случае с кинофильмами и телепрограммами мы должны думать, что все (не только составительские) АП принадлежат юрлицу, пока не доказано обратное (Огонёк заявит, что ему не принадлежат АП на произведение Будённого). Авторские права надо соблюдать, но тут уже идёт защита прав, которыми автор может быть уже и не обладает. Просто, если так действовать надо будет удалить половину Викисклада, половину фотографий Немецкого федерального архива. Викисклад же работает по одной схеме. Немецкий федеральный архив говорит, что права принадлежат ему и Викисклад, не зная что-либо точно, не зная были ли заключены договоры с фотографами, но имея разрешение, размещает фотографии. Эссе написано - см. комментарий Э.П. Гаврилова. Вы микшируете первоначальные и приобретенные авторские права юридических лиц. Через 70 лет после издания/публикации истекают лишь первые: т.е. в случае "Огонька" - редакция журнал "потеряла" права на составление сборника (первоначальные АП юридического лица), однако, если по-договору оно получило права на конкретные произведения (приобритенные АП юридического лица), то они истекут в соот. с данными об авторе. Инными словами: от того передал ли С.Будённый АП на свой рассказ "Огоньку" или нет, время охраны не зависит. Истечение АП всегда определяется по данным автора, даже если он передал их юр.лицо, просто в некоторых случаях (см. ГК РСФСР) юр.лицо само может быть автором.

А сравнивать с НФА некорректно, они как правообалдатель объявили что такие-то произведения распростарняются под свободной лицензией. "Огонёк" такого не сделал. Alex Spade (talk) 14:31, 13 April 2010 (UTC)

Фильм - не является сборником. Фильм - это аудовизуальное произведение. И проблема у фильмов не в этом, а в том, что соот. норма (для фильмов) появилась лишь в 1964 году и действовала до 1992 года. Не так. Фильм в ОД, и демонстрировать его можно свободно, но использовать музыку из него (в отрыве от видеоряда) в других произведениях - только с согласия наследников композитора, сценарий (например, чтобы снять новый фильм) - только с согласия сценариста и т.п. Не как с офисом Яндекс. Для начала, логотип Яндекса не является объектом АП, но если бы являлся пришлось бы руководствоваться соот. формулировками статьи о свободе панорамы.

Разница в следующем. "Огонёк" есть составное произведение (см. подробнее в ст.1260 Ч4ГКРФ). У составного произведения - есть АП составителя и АП авторов произведения - как собрали, так и разобрали. Волга-Волга есть аудиовизуальное произведение (см. подробнее в ст.1263 Ч4ГКРФ) - оно не является составным. Есть АП на фильм, и есть АП на музыку, сценарий и т.п. Нет, не значит ГК РФ. Это статьи даны как примеры, где ситуация (что такое сборник, а что такое фильм) расписана подробнее при сохранении сути, ибо развитие рос. законодательства идёт по-пути раскрытия тех норм, которые раньше подразумевались или постулировались в судебных решениях. Этот принцип относился не только к личным правам, но и к имущественным правам. Зачем было ставить шаблон быстрого удаления да ещё с комментарием "author of photo don't understand what is CC: on source page no jurisdiction and version of license therefore no legal license document". В шаблоне дана была ссылка на источник: http://fotki.yandex.ru/users/photomif/album/90408/, где чётко написано: "Условия использования всех размещённых в альбоме фоторафий лицензия Creative Commons Attribution-ShareAlike (by-sa) — Лицензия «С указанием авторства — Копилефт»".

В чём, собственно, проблема? Почему это автор не понимает и т.п.? Если там не указана версия CC, то из этого не следует, что фотку надо удалять как копивио--Ctac (talk) 21:31, 23 April 2010 (UTC)

Объясню мою точку зрения. Авторское право работает и в США, и в России так. Сначала всё запрещено к копированию. Разрешить копирование можно с помощью лицензионного договора, например, одного из таковых от Creative Commons. Для разрешения надо как-то связать фото и договор - можно либо поставить ссылку (самый лучший вариант), либо просто указать название лицензии, её версию и юрисдикцию (в этом случае можно будет отправить в CC письмо и получить полный юридический текст). На странце http://fotki.yandex.ru/users/photomif/album/90408/ даже этого не сделано. Там содержится всего лишь описание лицензии и это не позволяет установить конкретный юридический документ по которому вы имеете право распространять фото, а не являетесь маленьким пиратом. Таким образом, псевдоразрешение недействительно, фото по-прежнему полностью защищено авторским правом и запрещено к загрузке.

Вы поставили {{Cc-by-sa-3.0}}, но это совершенно неприемлемо. Почему не {{Cc-by-sa-2.0-uk}}? Может быть автор распространяет под CC-BY-SA-2.0 и не под Unported, а UK-версии? Это невозможно установить. Какой конкретно документ будут читать в суде если не в России, то хотя бы в США? 1.0? 2.0? 2.5? 3.0? Право копировать дают не значки, не иконки, не магические слова, не описание лицензии, а конкретный юридический документ.

Вот пример того как примерно должно выглядеть разрешение от автора: [6]. Оно позволяет однозначно установить конкретный юридический документ под названием «Attribution-ShareAlike 3.0 Unported», который даёт мне право копировать фото, не нарушая авторские права и который будут читать в суде где-нибудь в Аргентине.

Так что я думаю, что вам следует запросить удаление фото как загрузчику, а в случае, если автор определится с лицензией, восстановить. -- TarzanASG ⁺¹  18:07, 24 April 2010 (UTC)

Имхо, это придирки. Автором помимо указания CC-BY-SA дан текст, поясняющий, что он имел в виду: "Эта лицензия позволяет другим перерабатывать, исправлять и развивать произведение даже в коммерческих целях при условии указания авторства и лицензирования производных работ на аналогичных условиях. Эта лицензия является копилефт‐лицензией. Все новые произведения основанные на лицензированном под нею будут иметь аналогичную лицензию, поэтому все производные будет разрешено изменять и использовать в коммерческих целях." Текст полностью соответствует смыслу CC-BY-SA 3.0. Удалять фотографии из-за отсутствия версии лицензии, да её с пометкой копивио - это, мягко говоря, очень-очень странно. --Ctac (talk) 10:27, 25 April 2010 (UTC)

Нет, это не придирки и не странности. Если мы в Википедии и братских проектах соблюдаем законы, то соблюдаем полностью. Описание лицензии ничего не значит и не указывает на CC-BY-SA 3.0 и его вообще можно было не писать. -- TarzanASG ⁺¹  12:19, 25 April 2010 (UTC)

Повторю свою реплику из форума: В данном случае всем (включая гипотетический суд) совершенно ясны намерения оригинального автора использовать лицензию Creative Commons Attribution-ShareAlike без предпочтения конкретной версии. Поэтому использование текущей (3.0) версии неадаптированной (Unported) лицензии Creative Commons Attribution-ShareAlike здесь полностью оправдано. Так можно сказать и что поскольку блоггеры хотят, чтобы их сообщения перепостили, совершенно ясно, что посты не защищаются авторским правом. Но на самом деле же защищаются. В шаблоне {{Copyvio}} есть строка: Usage: This template should only be used for obvious cases. For non-obvious cases, use {{Delete}} and follow the instructions. Это невозможно юридически. Только автор может перелицензировать своё произведение или может быть особый случай, когда это разрешает действующая лицензия (как было с Википедией). Авто-категоризация включений шаблонов Creator

Здравствуйте! По поводу этой вашей правки. Авто-категоризация шаблоном Creator была сделана устаревшей где-то около года назад, {{Oleg Kozyrev}} -- последний оставшийся шаблон, работающий по этой схеме (см. Category:Creator templates using auto-categorization). Смысла в авто-категоризации этих включений уже нет никакой, т.к. все файлы с этим шаблоном уже явно категоризированы в Videos by Oleg Kozyrev. Добрый день, пожалуйста, не нужно создавать рекурсивные редиректы (когда Category:Districts of Moscow ссылается на Category:Administrative okrugs of Moscow, а Category:Administrative okrugs of Moscow ссылается обратно на Category:Districts of Moscow), это создаёт проблему для бота, он никак не может разобраться какая же из них правильная. Я пока убрал шаблон из Category:Districts of Moscow (т. к. в ней больше файлов), если файлы будут перемещаться в Category:Administrative okrugs of Moscow, то пожалуйста верните шаблон после того, как они будут перемещены (одновременно убрав шаблон из Category:Administrative okrugs of Moscow). — Ivan A. У меня к Вам деликатный вопрос насчет пяти фотографий, которые Вы загрузили в категорию Valeriya Guy Germanika. Так как они нигде не используются для статей, и сам автор фото – Антон Носик – их, скорее всего, делал исключительно для фотоотчета в свом блоге, а сама Валерия не хотела бы, чтобы именно эти репортажные фото представляли ее в вики-пространстве, то можно ли эту серию фотографий как-нибудь убрать из этой категории, если у Вас нет личных возражений? И есть еще один вопрос: в этой же категории есть еще одна фотография, которую загрузил участник M5 – с ней та же ситуация, но страницы этого участника нет, но я подумал, что это может быть Ваш старый аккаунт, как участника Википедии (у меня лично так у самого было, когда я написал одну статью под своим первым ником, и страницы того участника нет). Вы можете помочь с этим вопросом? То есть, это не принципиальный вопрос, а именно деликатный, с точки зрения только той вещи, что мы с Вами можем что-то изменить к лучшему, а для других людей это может быть не решаемой проблемой и предметом некоторого дискомфорта. Приветствую! Обо всём по порядку. Фотограф - Антон Носик, он и выложил фотографии у себя. Викискладу требуются свободные фотографии. С точки зрения авторского права фотографии загружены правомерно (согласно лицензии в picasa) и не могут быть удалены по причине их неиспользования в статьях. Убрать категорию "Valeriya Guy Germanika" скорее всего невозможно никак, и никто это сделать не позволит, потому что изображения должны быть как можно лучше категоризированы. Насчёт "представления в вики-пространстве" я понимаю желание, но формально Викисклад это такой же хостинг, как и многие другие. Хотя даже хуже - если я и загрузил эти фотографии, то ничего с ними я уже не могу сделать. Вы можете вынести эти фотографии на удаление, решение примет администратор после обсуждения. Я всё равно ничего не могу сделать, но возражать не буду. Я плохо знаю практику работы Викисклада, возможно деликатный вопрос можно решить через Фонд Викимедиа (другие контакты), сотрудники которго могут помочь своим вмешательством. Туркменская ССР и Узбекская ССР (включая Таджикскую АССР) были отдельными союзными республиками начиная с 1924 года. До этого существовали Бухарская и Хивинская народные республики, тоже не входившие в состав РСФСР. РСФСР никогда не существовала в границах, обозначенных на карте.

Не я создавал и называл эти две категории. Помещал я не в обе, а в одну на основе того, что быстро прочитал в статье. Your VFC installation method is deprecated

Hello TarzanASG, we are aware that using the old installation method of VFC (via common.js, which you are using) may not work reliably anymore and can break other scripts as well. A detailed explanation can be found here. Important: To prevent problems please remove the old VFC installation code from your common.js and instead enable the VFC gadget in your preferences.
