Hola Vmars. Me ha gustado tu mensaje. Resulta agradable que alguien se dirija con suavidad :-) Las más de las veces no hacemos más que dejar mensajes en vano o que la gente no se lee / no le importa. Al final acabas dejando mensajes de licencia incorrecta y esperando a que pase el tiempo para borrarlo. Muchas veces ni merece la pena el trabajo de buscar de dónde lo copió el usuario.

Sin embargo mensajes así me alegran, hacen que merezca la pena el esfuerzo. No tengo inconvenientes en explicar las cosas con calma y paciencia. La ignorancia no es delito. Pero también es necesario que la persona interesada muestre interés, que pregunte. Espero que lo entiendas.

Vayamos ahora a lo que te interesa. Cuando modificas una imagen/texto (en general, una obra) estás creando una obra derivada. Tú posees derechos sobre ella, pero también permanecen los de la obra original, a los que deben ceñirte. Un ejemplo de esto es la GFDL: Cualquiera puede modificar un texto que se encuentre bajo la GFDL, pero bajo los términos que esta establece: el texto modificado tendrá que estar asimismo bajo la GFDL. Cuando creas una imagen a partir de otras, las licencias del original restringen las del tuyo. Ayer mismo modifiqué la licencia que indicaba una imagen porque daba más licencias de las que permitía la original. Incluso siendo todas libres, y con un mismo espíritu, tenemos que ceñirnos a ello. Estoy completamente seguro que al autor no le importaría, pero sin su permiso no se puede hacer. Complejidades legales. Un ejemplo de ello es Image:Wikibaires.jpg. Tienen problemas con ellos hasta wikipedistas veteranos. Acostumbro a decir (o acostumbraba en la wikipedia, en commons creo que es la primera vez que me piden ayuda de novatos. En commons está también el problema del idioma, los usuarios no vienen al wiki con un cartel de babel) que las imágenes son de lo más complicado.

Si quiero hacer una imagen usando una Cc-by-sa y una GFDL no puedo. Son incompatibles. ¿A que suena absurdo? A fin de cuentas ambas licencias son casi iguales. Por eso en commons se recomienda licenciar doblemente con ambas. De ese modo se es compatible con ambas.

Concretando más a tu alquimista, como no tienes el permiso del autor original, no podrías haberlo modificado, por tanto tampoco publicarlo, licenciarlo... es una copia pirata :D Para que te hagas una idea, si modificando una obra, pudiera hacer cualquier cosa con ella, podría añadir una grabación donde aparezca hablando al comienzo de una película y venderla como mía ;-) (la gente lo compraría por la película, no por mi corto xDD).

Mi sugerencia es que envíes un correo al creador de la imagen, pidiéndole permiso para usarla bajo una GFDL, Cc-by-sa, Cc-by... Casi seguro que aceptará gustosamente. Puedes usar los modelos de es:Wikipedia:Autorizaciones. Conviene que digan expresamente "lo licencio bajo X licencia". Cosas como "Puedes usarlo como plazcas" resultan muy vagas para saber a qué están dando permiso realmente, qué entienden por ello. Una vez te den permiso, hay que reenviar ese correo a permissions arroba wikimedia.org, donde queda almacenado.

Gracias por subir esta imagen. Las políticas de Commons están pensadas para que este proyecto y el de las wikipedias perdure y no sea atacado por poderes a los que no les interesa nuestra presencia en Internet, a los que no les interesa que la cultura sea libre. Si no procurásemos ser estrictos con los derechos de autor, correríamos el riesgo de que el proyecto se tambalease y/o desapareciese. Por falta de datos obligados, que probablemente no has puesto por desconocimiento, la foto que has subido podría ser borrada en el plazo de una semana.

Paso a explicarte los datos que hacen falta y como incorporarlos

¿Qué debes indicar?

De donde procede la imagen

Si la imagen es de una página Web, es obligado colocar un enlace (link) al lugar exacto del que se recoge la imagen. Sea cual sea el origen de una imagen, en dicho origen tiene que poner que se permiten las obras derivadas y el uso comercial, a no ser que hayan pasado 70 años de la muerte del autor. Si en el sitio web no aparecen expresos estos conceptos la imagen podrá ser borrada por violación de los derechos de autor

Nota: La legislación internacional (apartado 5.2 do Convenio de Berna) indica que no es preciso ningún requisito para que cualquier obra de una página web tenga copyright. Por lo tanto sólo se pueden subir fotos de aquellos lugares que indiquen explícitamente que las imágenes están en el dominio público y permiten la realización de obras derivadas y el uso comercial.

si la imagen es de tu propia autoría, indícalo claramente. Si el objeto que fotografías tiene los derechos de autor restringidos (portada de un CD, de libros, programas de tele, pósters,...), tu foto también tiene esos derechos restringidos y no se puede subir a Commons (Commons:Derivative works).

si la has copiado de otra Wikipedia, coloca un enlace exacto a la página de información de la imagen original. No basta decir solamente que la imagen se tomó de "otra Wikipedia"; es necesario indicar el lugar exacto. Ten en cuenta también que algunas otras Wikipedias, como la inglesa, admiten imágenes bajo la cláusula de fair use que aquí no son aceptables por cuestiones legales.

¿Cuál es la licencia de la imagen?

Si la imagen la has hecho tú, debes utilizar una de las admitidas y expresadas en Commons:Selector de licencias y Commons:Sobre las licencias, por ejemplo {{GFDL-self}} o {{PD-self}}.

En caso de que sea copiada de algún sitio, debes poner la licencia que en ese sitio tenía.

Todas las imágenes que se suben a Commons deben permitir la realización de obras derivadas y el uso comercial. Pero hay más matices, de ahí que haya varias posibles licencias. La licencia PD-self coloca la imagen en el dominio público sin restricciones. En pocas palabras, la licencia GFDL-self obliga a que, si se utiliza la imagen se nombre al autor y el lugar de donde se obtuvo.

¿Cómo indicarlo cuando una imagen ya ha sido subida?

Accede a tus fotos.

Una vez que has accedido, haz click en la pestaña editar que está en la parte superior.

Añade los datos precisos escribiendo en la página que aparece. Recuerda que los datos precisos son el origen de la foto y la licencia. La licencia hay que ponerla entre e paréntesis: {{PD-self}}, {{GFDL-self}}

Guarda la página

¿Cómo indicarlo cuando vas a subir una imagen?

En el momento de la subida hay una caja en la que puedes escribir que pone Summary. Puedes poner ahí los datos y así no tienes que editar después la foto

La licencia de esta imagen no es válida. No puedes colocar licencias GFDL a imágenes porque sí, porque tú quieres, cuando las imágenes originales no presentan esa licencia y tú no realizas una obra derivada. Si no has creado tu mismo esta imagen entonces es necesario que argumentes porqué la imagen se puede usar en Wikimedia Commons (ver el enlace de etiquetas de derecho de autor abajo). Si no has creado tú mismo la imagen entonces debes también especificar donde la encontraste, por ejemplo, en la mayoría de los casos un enlace a la web donde la tomaste y los términos de uso del contenido de esa web.

Hola Vmars. He decidido entrar en contacto contigo especialmente para cambiar impresiones. Puede ser que esté confundido en mi manera de interpretar las licencias de las fotos de objetos tridimensionales. El caso es que no puedo entender que hayas borrado la etiqueta "no source" de las imágenes del título de este mensaje. PD-OLD es únicamente aplicable a obras bidimensionales. Para que esas fotos sean PD-OLD, las fotografías tendrían que haber sido hechas hace muchísimo tiempo (no las estatuas que representan), por lo que es necesario que se indique su origen, dado que en Commons se exige que las licencias sean comprobables.

Por ejemplo, si yo hiciese una foto del Partenón (siempre y cuando en Grecia haya libertad de panorama como en España), la imagen resultante tendrá el copyright que yo desee, por lo que para colocarla como PD-old es preciso aclarar cuando fue realizada la foto.

En caso de que no concuerdes conmigo, te agradecería que me explicases tu punto de vista. Siempre parto de que me puedo confundir, dado que este mundo de las licencias es muy complejo y me queda mucho por aprender.

Por todo lo dicho, vuelvo a etiquetar las imágenes, eso si, con la fecha de hoy, para que, si estoy confundido, tengas tiempo de "hacerme caer de la burra". Te agradezco que, antes de borrar la etiqueta que voy a colocar, te pongas en contacto conmigo, y te agradezco que en lo sucesivo eso sea lo habitual. El origen de la imagen tiene difícil explicación. Está presente en http://pettinato.hypermart.net/origens_na_italia.htm (origen que no has querido disponer durante semanas, aunque lo he requerido). Has etiquetado esa imagen como si fuese tuya (no lo es) y te has negado a todo diálogo: no has respondido a ninguna de mis comunicaciones. Procedo a bloquearte, aunque solamente sea para que se manifieste un precedente que permita un bloqueo mayor.
