Hello, @Fl.schmitt! Can we use PD-Art-old-100 or something similar for this case? If not, then you can delete it. Although I see this image on sites like pinterest and on some blogs, it looks like public domain. Askelladd (talk) 19:16, 1 June 2024 (UTC)Reply
@Askelladd: I think we need to distinguish between the ancient roman artwork and the picture (photograph). I'm quite sure that there are no copyright issues regarding the ancient artwork (but BTW there are restrictions regarding commercial use of such photographs, see {{Italy-MiBAC-disclaimer}}). But the photograph of the fresco is a work on its own, which may be subject to copyright. Regarding sites like Pinterest, it's simple: You can't rely on those sites regarding PD or copyright issues. Sites like flickr are better since users have to explicitly declare under which licence their content is published. If you've taken the picture yourself, you're the copyright holder - everything is fine. If you took the image from any other website, you'll have to declare the source, the author (original photographer) and the permission to use it under a CC license. That's difficult. I can't find any copyright-related notice, so we can't assume that the pics are released under a CC license. The page states "Quelle: Archäologischer Park Pompeji" but it's unclear to me if that relates to the pictures, too. So, there are two options: try to contact Luigi Spina and ask for permission to publish his work under a CC license (which is futile, i assume), or ask the Parco Archeologico di Pompei staff to do so. See also the wonderful PompeiiInPictures site with information and media regarding the recently excavated thermopolium at V.3 - obviously, they asked for and received the permission by the Parco Archeologico di Pompei to use their media. Realistically, we'll have to wait until someone takes its own pictures of that fresco and uploads it on commons (or on flickr, using a suitable CC license). Sorry, but i don't have such a template. And to be clear - it isn't my duty to request permissions for media uploaded by you. I can't delete the file myself because i'm no admin. So you'll have to decide - wait for the admin's decision, ask for deletion yourself (IMHO the pic qualifies for "speedy deletion"), ask the Parco archaeologico or search for a free (CC-compatible) replacement. Yes. I assume (!) that a PD license might be apt for frescoes shown in Museums, but not for photographs of frescoes in situ. For a decisive answer, i've filed a question at the village pump. Let's wait and see. Anyway, in the case you've mentioned i would prefer a different PD license, {{PD-Art}} instead of {{PD-old-100}} (since the photograph is clearly not 100 years old.
