Copyrights

Regardless of what you were told by Elsevier and the authors of the article (and we would need proof that you were actually told this), copyright is complicated. If you do not know the exact reason why an image is properly licensed, you should assume it is not properly licensed.

The copyright on the letter from Clara to Mussolini did not belong to Elsevier, or to Brenner or Lechner or De Caro. Therefore, they could not be the ones to release its copyright. It was copyright of Max Clara. Only his heirs could release its copyright; in the absence of such, it must be assumed to remain in copyright until 70 years after his death. Since he died in 1966, the image cannot be on Wikimedia Commons until January 1, 2037.
