Our first steps tour and our frequently asked questions will help you a lot after registration. They explain how to customize the interface (for example the language), how to upload files and our basic licensing policy (Wikimedia Commons only accepts free content).

You don't need technical skills in order to contribute here. Be bold when contributing and assume good faith when interacting with others. This is a wiki.

Getting help

More information is available at the community portal. You may ask questions at the help desk, village pump or on IRC channel #wikimedia-commons (webchat). You can also contact an administrator on their talk page. If you have a specific copyright question, ask at the copyright village pump.

Goodies, tips, and tricks

Put Babel boxes on your user page so others know what languages you can speak and indicate your graphic abilities.
You can find the files you have uploaded in your Uploads.
Please sign your name on Talk pages by typing ~~~~.
To link to an image page without embedding the image, type: [[:File:Foo.jpg]], which produces: File:Foo.jpg.
You may enable gadgets (custom features) for your account.
There are several tools to upload files.
Have you edited Wikipedia before? This guide might be useful.

Do you want to have a file renamed or moved? Use the move link and wait for an authorized user to rename it.

There seems to be a problem regarding the description and/or licensing of this particular file. It has been found that you've added in the image's description only a Template that's not a license and although it provides useful information about the image, it's not a valid license. Could you please resolve this problem, adding the license in the image linked above? You can edit the description page and change the text. Hola. Esta imagen está dentro de las obras publicadas anónimas, porque fue publicada por Revista Estadio y no sabemos quién fue el fotógrafo que la sacó. Según la legislación chilena las obras publicadas anónimas, seudónimas o cuyo autor es desconocido, la primera publicación tiene que haber sido hasta el 16 de Septiembre de 1962 para poder estar en Commons. La foto del superclásico es de 1959, por lo que entra dentro de la ley. Saludos. Carlos yo (Discusión) 15:33, 25 August 2023 (UTC)Reply

Lo otro, que no porque esté en Memoria Chilena se puede subir libremente acá. La misma página de Revista Estadio de 1967 cuenta que "Este documento es una obra protegida por ley de propiedad intelectual. Su uso y reproducción están sujetos a la autorización de su(s) autor(es) y/o titulares de derechos.". Saludos. --Carlos yo (Discusión) 15:57, 25 August 2023 (UTC)Reply

Efectivamente, la obra es de autor desconocido, pero acorde al convenio de Berna (ratificado por Chile en Decreto 266 de 1975), "Para las obras anónimas o seudónimas, el plazo de protección concedido por el presente Convenio expirará cincuenta años después de que la obra haya sido lícitamente hecha accesible al público."

Las demás leyes al respecto (Ley Nº 17.336 de 1970, Ley Nº 19.166 de 1992 y Ley Nº 19.914 de 2003) no son retroactivas, ni lo son sus efectos, por lo que no aplicarían a imágenes de 1959 y 1967. El convenio de Berna (1975), por su naturaleza, tampoco es retroactivo al ser un convenio internacional, y aunque lo fuera, el plazo estaría cumplido en ambos casos (50 años). Solo la ley de 2003 (protección 70 años) mantendría protegidas las fotos, aunque nuevamente, no tiene efecto retroactivo acorde a nuestra legislación.

Deseo consultarle la fuente de dicho plazo, el de 16 de septiembre de 1962, (de estar disponible la fuente, claro está), ya que, no se encuentra dicho plazo en las leyes referenciadas o en la historia de la ley. ¿Es un criterio de Commons? ¡Saludos y muchas gracias por pronta respuesta y aclaraciones!
