proszę o pomoc w rozwiązaniu zgłoszonego przez Pana problemu. File:Sławomie Biskupski 1944.jpg Zdjęcie z 1944 pochodzi z archiwum rodzinnego, nie było nigdy publikowane. Oczywiście autor jest nieznany, więc nie ma możliwości uzyskania jego zgody.

Czy to nie wystarcza:

To zdjęcie należy do domeny publicznej, ponieważ zgodnie z art. 3 ustawy z dnia 29 marca 1926 r. oraz art. 2 ustawy z dnia 10 lipca 1952 r. o prawie autorskim fotografie polskich autorów (lub fotografie, które ukazały się po raz pierwszy w Polsce lub równocześnie w Polsce i za granicą) opublikowane bez wyraźnego zastrzeżenia praw autorskich przed uchwaleniem ustawy z dnia 23 maja 1994 r. o prawie autorskim i prawach pokrewnych nie podlegają ochronie – należy domniemywać, że są własnością publiczną.
