File:Picture of Richard Van Evera Lovelace.jpg has been marked as a possible copyright violation. Wikimedia Commons only accepts free content—that is, images and other media files that can be used by anyone, for any purpose. Traditional copyright law does not grant these freedoms, and unless noted otherwise, everything you find on the web is copyrighted and not permitted here. For details on what is acceptable, please read Commons:Licensing. You may also find Commons:Copyright rules useful, or you can ask questions about Commons policies at the Commons:Help desk. If you are the copyright holder and the creator of the file, please read Commons:But it's my own work! for tips on how to provide evidence of that.

The file you added has been deleted. If you have written permission from the copyright holder, please have them send us a free license release via COM:VRT. If you believe that the deletion was not in accordance with policy, you may request undeletion. (It is not necessary to request undeletion if using VRT; the file will be automatically restored at the conclusion of the process.)

Warning: Wikimedia Commons takes copyright violations very seriously and persistent violators will be blocked from editing.

Own work

edit

Hi Marinaromanova55. You've uploaded a couple of files (File:Near Avachinsky volcano.jpg and File:Richard with Koryaksky volcano.jpg) that you're claiming to be your "own work". You then uploaded another file (File:Richard Van Evera Lovelace Kamchatka.jpg) which looks like it was taken at roughly the same time as the other two that you've stated was taken by someone else. I think you might be misunderstanding some important things about Commons:Licensing and how Commons treats copyrighted content. Generally, it is the person who takes a photo (not the subject of the photo) who is considered to be the copyright holder; so, when you claim a photo as your "own work", it means for the most part that you're actually the person you took the photo. Did you take those two photos of Lovelace? If you didn't, then you can't really claim them as your own work and you can't really uploaded them to Commons as such. If you can clarify whether you took the photos or where you got them from if you didn't take them, then perhaps we can figure out what to do next.

Regarding the third photo of Lovelace that you said was taken by his guide, once again it's generally the person who takes the photo (not the subject of the photo) who is considered to be the copyirght holder; so, the "guide" would be considered to be the copyright holder (not Lovelace) and it is the guide's COM:CONSENT which is going to be needed here. Now, there are cases where (as explained here) where the subject gives someone their camera and asks them to take their picture, but this can be a bit tricky and depends upon a variety of factors; in other words, even in such cases the subject of the photo isn't automatically going to be considered the copyright holder even if the photo is taken with their camera.

Since these photos don't appear to have been "published" (i.e. posted anywhere online or in any type of print publication) prior to their being uploaded to Commons, they're probably OK; however, it might be better to follow the instructions in COM:OTRS#If you are NOT the copyright holder and ask the copyright holder (assuming that is Lovelace himself) to send a consent email to Wikimedia OTRS for verification purposes. This will make it clear that he is the copyright holder of the photos and that he understands and agrees to COM:L and COM:LRV. Bascially, he needs to understand such an agreement means that he (as the copyirght holder) is giving his advance permission to allow the photos to be downloaded from Commons at any time by anyone anywhere in the world and to be re-used for any purposes (incuding commercial and derivative uses) and once he does that he can't change his mind at a later date. If you can get him to send that in an email to Wikimedia OTRS, an OTRS volunteer will check to make sure everything is in order and take care of the rest if it is. Of course, if he doesn't have to agree to such a thing if he doesn't want to, but Commons won't really be able to keep the photos if he doesn't. -- Marchjuly (talk) 00:43, 6 January 2021 (UTC)Reply

Photo of Lovelace

edit

Dear Marchjuly, Thank you for pointing to this issue. All these photos are from archive of Richard Lovelace and belong to him. Now, the section about his travels has been removed (personal info of alive person without proof), and most of pictures will not be incorporated into his wiki page. The photo which is placed now, as the main photo, has been taken by a random person (a guide in his brief trip to Kamchatka in 2004, there is no contact with him). The photo was taken by Richard's camera at Richard's request. Richard asked the guide to photograph him at the background of volcano and chose the pose and details of the background himself. The guide did not get a copy of the photo and was not interested in it. Thanks again. 67.249.143.166 04:43, 6 January 2021 (UTC)Reply

Hi IP 67.249.143.166. If you are Marinaromanova55, you should log in to your account when you edit because it makes things less confusing. By not logging in, you make it easier for other editors to see what your IP address is, which might be a way for someone to figure out your location.
As for the photo, thank you for clarifying things; however, unless Marinaromanova55 is Richard Lovelace, then Richard is going to need to send a COM:CONSENT email to Wikimedia OTRS so that the file's licensing can be verified. He should include the name of the file in his email and explain what you've explained above. -- Marchjuly (talk) 13:37, 6 January 2021 (UTC)Reply

Dear MarchJuly, I found a better picture of Prof. Lovelace which is my own work. I uploaded it with references to the picture:

Richard Van Evera Lovelace at Kamchatka in 2004.

To link to it in HTML, copy as https://commons.wikimedia.org/wiki/File:Richard_V_E_Lovelace_Kamch.jpg

I will ask Valereee to substitute picture.
