I strongly disagree with making up a likeness for a historical person if none exist! That is no different than making up details about a person just because it is not known. Misleading or wrong info is worse than no info. And this has nothing to do with culture. Your personal artwork is not important and significant in preserving Filipino cultural history. Surely, we are all entitled to our own opinions and perspectives. I am the source of all the images.The images which I draw digitally from scratch from my sketchpad to the computer. Respectfully, the idea is not to mislead or hoax people. The depiction of the images does not claim that those are the exact likeness of the people rather "idealized" or "conceptual" only.

I have updated the ownership info in all the files in question. If my research integrity is in question, I am a professional Scientist and artist

Isaac Richards photoEdit

Hi Ankry. The photo of Isaac Richards (the goalkeeper for Adelaide United FC) is not from the TV, but it is a screenshot from a live stream. I have been using camera sometimes for some player articles. So from now on, I'll just use my camera at stadiums.

I can confirm that the Isaac Richards photo can be deleted. However, I know that there is an image of Eugene Galekovic warming up with Adelaide United and it looks like that has been taken with a camera at a TV screen. So I'll think about the image and ask if it should be deleted or not.

Hi Ankry, you asked me an explanation about the reason I download files without EXIF data. It's mainly a matter of privacy. When I upload a picture on Commons with its EXIF data I show exactly where and when I took the picture. i.e.: my girlfriend could be unhappy to discover that the picture of the fish represented in this photo was taken at midnight, in the precise location of her best friend's house, right when she was out for her night shift at the hospital. @TheWizardsApprentice: There is no info there that Wikimedia user TheWizardsApprentice is the publisher. Any Wikimedia user is considered anonymous and it is not allowed by Terms of Use to check their identity. For any media that has alreadybeen available elsewhere to public, or that is professional, we need clear evidence of free license (which is a legal contract between the copyright holder and reusers). For media that were published without clear evidence of being initially published under a free license, we need free license from the actual copyright holder via email, as described on this page. On-wiki licensing is not possible in such cases.

I can only protest against this decision. Raphael Reischuk is not a professional photographer, but an academic who used to work at the same University as Reinhard Wilhelm, as you can easily figure out by google search. COM:PCP is not about the situation we have here. It talks about significant doubt, which I don't se here. We have someone who wanted to donate one of his photos of a fellow academic, to ensure his wikipedia page has one. We cannot turn the principle of Assume Good Faith upside down. Above you say "For media that were published without clear evidence of being initially published under a free license..." But the media was published initially under a free license here on commons. There is no other copy but the commons copy, it is the initial one published. It is thus not possible for someone else to have uploaded a copyright violation. Taken this, I cannot understand why this picture has to be deleted. Please reconsider the decision. I fully support COM:PCP, but it clearly does not apply here. @Rtc: If you know how to contact him, it is better to convince him to provide an OTRS permission instead of continueing a discussion that goes nowhere. Three admins have doubts here: Gbawden, Jim and me.
The simplified procedure of on-wiki licensing was intended to make it easier for users to publish images that were made by them primarily for Wikimedia and intended to be freely licensed. This image is used by prof. Reinhard without attribution and without evidence of free license. Of course, the author is free to grant a separate license to him, but it constitutes a doubt whether the image was intended to be freely licensed. Especially as we cannot be 100% sure that the free license declared at Wikimedia was indeed granted by the author. Our goal is to save reusers and, recently, we had cases when reusers were sued, so now we take much care if any authorship/copyright related doubt appears. While an on-wiki permission from an unidentified user is useless in a court, an email can be used there. Ankry (talk) 10:39, 16 November 2019 (UTC)
Sigh. The picture was not uploaded by the professor, but by Mr. Reischuk, the amateur photographer himself, on his own commons account under his well-known alias Ricona, which he also uses on other websites according to a google search. The original reason for deletion (which claimed signficant doubt because of a mismatch of EXIF info and username) therefore clearly does not hold. Email address and even phone number of Mr. Reischuk can be found at [1] so why don't you ask him before deciding that the picture must be copyright violation? --rtc (talk) 12:04, 16 November 2019 (UTC)

  1. That 2019 conference page obviously took its content from Commons (and Wikipedia), where the photo (and text) was added some years ago, obviously not the other way around. NB, that page is not one made by the professor, but by a conference and I can assure you they don't have a separate license (since the text they copied from wikipedia was written by me and I didn't give them one, certainly not different from the photo).
  2. Mr Reischuk certainly has more important things to do than to keep track of an account he didn't use for years, or fulfill overbeaurocratic requests. I will not support undeletion of this image unless a clear evidence is provided that (a) the Ricona account is operated by Mr. Reischuk or (b) a clear evidence is provided that the real Mr. Reischuk granted a free license. Neither can be made on-wiki AFAIK. The first requires OTRS due to our privacy rules, the second must be done on an extermal site, where Mr. Reischuk is an identified user or also through OTRS. The policy talks about significant doubt, not clear evidence of correct licensing. I propose you send an email to Mr. Reischuk to ask for the OTRS confirmation if that's what you want. I won't do that since 1) given the quite paranoid argument I expect a confirmation email will be cast in doubt, too. 2) I expect Mr. Reischuk to be pretty upset about such a overbureaucratic request. You and the others are hungry for OTRS confirmation, so you should be the first ones who try to obtain one. PS: IMO the fact that the the account has the same name that Mr. Reischuk uses on other sites is more than enough evidence. It would be astonishing for a user violating copyright to be so diligent as to carefully create a fake account with the correct alias and upload a photo that Mr. Reischuk never published before. You are claiming that you were the photographer who made these original photos years ago. We do not believe this and require you to provide evidence for your claims and you failed to do so. Providing false information as well as reuploading deleted images is against Wikimedia Commons policies. If you provide correct information about these photos (who made them, when and what is their copyright status) there is a chance that they are restored.   • I NEVER claimed that I was the photographer of this picture is simply a lie. At upload time you claimed:
And that you, as the author, grant anybody a license to use the photo with the requirement that any reuser must attribute you as the author. If you are not the author (author of a photo is the photographer), that this is not only against Wikimedia Commons rules, but also illegal.
  • If you are not the photographer nor the photographer's heir nor you have appropriate copyright transfer contract with them, then you are no way legally authorized to grant any license to the photo. And our rules strictly forbid hosting copyrighted photos without a free license.
  • Any photo is copyrighted unless it falls under some exception in copyright law (I see no such exception in Algerian law) and until its copyright expires (you already quoted the expiration terms from my message)
  • reupload of deleted images is against Wikimedia Commons rules: the deleted photos are permanently stored in the database and can be restored if needed. Uploading copies is just wasting of resources so they should be deleted on sight and uploaders blocked to protect the service from further reuploads. So my deletions were fully justified.
  • If you provide the required evidence that the photo copyright expired or that the actual copyright holder (presumably the photographer) granted a free license or (as an exception) that it is more than 120 years old anonymous photo then I can restore it.
  • per our rules (see COM:PCP) we cannot host photos with unclear copyright status (the goal is to save reusers).
  • scanning / copying / retouching and similar operations are considered technical, non-creative operations, so no copyright / authorship is related to them.
  • for copyright issues, it is irrelevant who is the subject of the photo; this should be considered while analyzing COM:SCOPE issues. Images hosted in Wikimedia Commons must be both: legally free and in scope.

@Gdarin: Być może są one PD, ale trzeba by się namęczyć, by to wykazać, na co niespecjalnie mam ochotę.
Nowy15 się podłożył podając bzdurne informacje (np. autor=brak, który udzielił licencji CC0, albo autor=brak zmarł ponad 70 lat temu, albo autor=domena publiczna). Jim założył, że te zdjęcia są utworami pochodnymi filmu. Nie wiem czy tak jest, możliwe, że nie są to kadry z filmu a niezależne zdjęcia z planu (ale ciężko to wykazać, a działa COM:PCP). Podobnie, możliwe, że film jest PD (trzeba by wykazać że co najmniej reżyser i autor scenariusza zmarli ponad 70 lat temu). Ankry (talk) 19:13, 10 December 2019 (UTC)

1925 Polish translation of TurgenevEdit

Came across some sloppily uploaded djvus. Turgenev is obviously public domain, but I don't see a named translator for this 1925 Polish translation File:PL Turgeniew - Ojcowie i dzieci.djvu. Przessłałem plik z całością książki, a następnie nadpisałem wersją z wyciętymi autorami, którzy nie są w domenie publicznej - w miejsce stron z utworami nie w PD jest tzw. zaślepka. Czy możesz, jako administrator, ukryć tę pierwotną wersję, aby móc później przywracać autorów, którzy przeszli do domeny publicznej? To są autorzy, których usunąłem: Ostap Hrycaj zm. 1954 Petro Karmańskyj zm. 1956 Księżniczka N. Koczubej (ur. na rosyjskiej Ukrainie) zm. ? Głosy prasy W głosach prasy są najczęściej pseudonimy lub brak autorstwa, jest jeden autor bez daty śmierci. Potraktowałem to jako reklamę i stąd ukryłem. Mogę to przywrócić, ale przynajmniej jedną recenzję (tego autora bez daty śmierci) trzeba będzie usunąć ze strony.

Yet the picture description says that it is "awaiting processing" and "If a valid permission is not provided within 30 days of the first response by an OTRS volunteer, this file will be deleted" and it also mentions your username. @Geagea: COM:UDR is not the right place for community guidance. In controversial cases a response depends on responding admins and cases are expected to be closed in 24h.
As you can see in the discussion you linked, there was no clear consensus there. Personally, I do not support such cases as COM:PCP #4, but I do not really care what other admins/OTRS members do in such cases. Ankry (talk) 13:11, 22 March 2020 (UTC)

Dzień dobry. Piszę gwoli wyjaśnienia metadanych do zdjęcia Ewy Drzyzgy, które ma być skasowane. Otóż wspomniane metadane mogły zaciągnąć się z mediów społecznościowych, bo często (gdy np. nie mam przy sobie kabla USB) przerzucam zdjęcia z telefonu na Messengera, bo tak mi najprościej - wówczas zapisuję je i wrzucam do Commons. @Jakubkaja: Mi to w sumie obojętne. Po prostu zwracam ci uwagę, że brak takiej informacji może spowodować, że za kilka czy kilkanaście lat wszystkie fotki z NAC mogą wylecieć z Commons jako copyvio, a tobie przypaść łatka "copyvio uploader". Bo prawa autorskie do nich poza Polską prawie na pewno istnieją i nie wygasły. Osobiście nie mam zamiaru inicjować takich działań, ale jeśli ktoś się kiedyś do tego przyczepi, będzie mu trzeba przyznać rację. NAC nie opublikowało tych zdjęć przed 1950, Tygodnik Ilustrowany zapewne też. A w przypadku zdjęć anonimowych kluczowa jest data pierwszej publikacji, nie data powstania zdjęcia. Takie mamy prawo. @Matlin: Jeśli fotograf jest znany, to sprawa jest raczej oczywista. Ale większość zdjęć podpisanych "Ilustrowany Kurier Codzienny. Archiwum ilustracji." jest anonimowa. I z tymi jest problem. Inny przykład: to zdjęcie ma ewidentnie nieprawidłową licencję, bo odwołuje się ona do daty śmierci fotografa, którego nie znamy. Jednak zgłaszanie takich zdjęć do poprawki / usunięcia poprzez Deletion Request to nie jest coś, co mi sprawia satysfakcję. A w końcu wszyscy jesteśmy tylko wolontariuszami? Carol Stephenson and I were working together at the time of the preparation of the article and I now can see from the way that their image uploader works that there is some confusion about copyright ownership. That being the case there will also be an issue in relation to File:Cherub Sailing 02.jpg. Rather than trying to resolve the copyright ownership and reprocessing the permission I would suggest that you also delete File:Cherub Sailing 02.jpg. @Leyo: The file was deleted due to procedural reasons (the permission processing did not finish in 30 days period); it may be still undeleted if a proper permission is receved and processed. And I can do this if an OTRS agent handling the appropriate ticket requests so. I do not speak French, so I am generally not acting on requests in French. If you think that the other file(s) needs to be deleted, feel free to act yourself. I generally disagree with an opinion that a Wikipedia article requires an illustration. Unless the image was initially published under a free license (evidence needed if so). This is policy, not my personal opinion. Prośba o rozwiązanie problemuEdit

Witam. Może Mógłbyś pomóc ? Problem jest chyba natury technicznej a dotyczy wikidata-infoboxów. We wszytkich poniższych kategoriach user z UKR usunął "defaultsorty" skutkiem czego te hasła są szeregowane w nadkategoriach według imion a nie nazwisk, powstaje niezły bajzel a nawet i burdel. Zupełnie tego nie rozumie. Ten proceder w jego wykonaniu ciągnie się już od miesięcy i chyba nie ma szans żeby do niego dotarło że szkodzi i niszczy pracę innych. Kategoryzuję pliki i tworzę konkretne kategorie, niestety często czuję się dzięki jego "współudziałowi" jak Syzyf za którym biega uparty pies ogrodnika. Najlepiej by było gdyby usuwał defaultsorty dopiero wtedy gdy "wikidata-infobox" poprawnie szereguje według nazwisk ... tylko co zrobić żeby to do niego dotarło ? Sorry, że Tobie tym głowę ale sam nie podołam. pozdr.

@ Zalecam jednak założenie konta i uzupełnianie odpowiednich elementów w Wikidanych oraz tworzenie kategorii imion i nazwisk na Commons. Do tworzenia nowych elementów z imionami i nazwiskami pomocne może być narzędzie: Cradle. Działa jak formularz, który tworzy nowe elementy. Sorry for not replying to requests for info for a couple days. Someone was not paying attention to their driving and ran into the only power pole that supplies this entire area. We have been "enjoying" the sound of absolutely nothing for several days. As much as I would have liked to say "sure go ahead, put it back," I wasn't able to. Thank you, I know what is written on the back of the photo. The photo was sent to my grandfather in 1967 from Jordan, however the photo was taken in the Russian Empire. In the photograph, the Tagirovs Zainal-Abid and Abdurakhman bought the photograph from a photographer between 1911 and 1913 (usually a photographer who photographs for money). It is also known that the photo was published there, the link is on the file page. Now I have the original photo, I got it from my grandfather as an inheritance. It seems to me that the Photographer who took the photo does not have the right to it because it was bought and I inherited it. Photo print ownership and the place where it was taken are irrelevant for copyright. Also the payment is irrelevant if no copyright transfer contract was signed. If the photo was initially published in Jordan, we need to determine the copyright status in Jordan and in US (the latter depends on copyright status in Jordan in 1996). It's a big headache, because a lot of big media organizations started using this image. I assume, that user is not going to respond back to you. @Adamt: Z opisu wynika, że autorem zdjęcia jest Użytkowniczka Kazaczok, która zażyczyła sobie w przypadku tego zdjęcia atrybucji "Jessica Toman". Według mnie, równie dobrze mogłaby sobie zażyczyć atrybucji Donald Trump czy Edward Gierek. Nie wiedzę żadnego dowodu, ze autorką zdjęcia jest ta lub inna identyfikowalna osoba. @Ankry: Nie Kazaczok to pseudonim Pauliny Studniczki. Ona sama jako Kozaczok wstawiła to zdjęcie jako praca własna, choć sama je nie wykonała. Faktycznym autorem jest Jessica Toman. Jessica Toman nie wyraziła zgody na publikacje tego zdjęcia (nie ma na OTRS) na wolnej licencji więc takie zdjęcie powinno zostać usunięte. W OTRS jest masa tego typu spraw: ktoś wstawia własne zdjęcie choć wiadomo że to nie on je zrobił ale uważa je za własne i że ma do niego prawa. To jest ten sam klasyczny przypadek--Adamt 05:34, 28 September 2020 (UTC)
@Adamt: Takiej wiedzy nie miałem. W związku z tym, skoro to nie jest selfie, możesz (skoro tę wiedzę posiadasz) albo zgłosić zdjęcie do usunięcia (podając powyższe wyjaśnienie), albo zgłosić "No permission" (czyli żądanie przysłania przez właściciela praw zgody na OTRS w ciągu siedniu dni). Może to zrobić każdy. BTW, sugerujesz, że User:Kazaczok i User:Fokaczino to jedna osoba? Masz na to jakieś dowody? Weryfikacja praw autorskich chyba nie jest podstawą do CU. @Ankry: and @Túrelio: Thank you. I am the user who posted a username policy violation warning on the uploading account user talk page two weeks ago. I also discussed the issues (impersonation and copyright violations) on a usernames request for comment page in order to understand how the real person (who is known to me and does not have a Commons user account) could request action. Based on that discussion, the real person sent an email into OTRS three days ago to flag a few examples of copyright violation and to inquire how she can prove her identity is not that of the uploading account which mimics her name. OTRS proposed an identity verification method which is difficult for the real person, so she proposed some alternatives, and she is waiting for a response on that. The real person is hoping to avoid having to post something about this problem on her Facebook page to verify she is not the Commons user with the same name, because she has nearly 5000 Facebook friends and many followers, so it would likely create a storm. But, if that's the only option, of course she'll do it. In the mean time, yesterday I also sent an email into OTRS identifying a separate set of Commons images uploaded from the same account which are my personal creations, some of which were downloaded from the website of an NGO the real Marla Raucher Osborn and I co-founded; those web pages and images were captured by the Internet Archive before the images were uploaded to the Commons. So this second set of copyright violations are independent of the identity question, as neither the real person nor the impersonating account can claim "own work". These sample violations are only the tip of the iceberg. Anyway, now we wait for OTRS response; we appreciate that there is a long queue. Thank you again.
