Hello Omphalographer,
This is the same reply as on the deletion request so if you've read the other, no need to read this one.
Thank you for getting a conversation started on this topic and thank you for giving me a chance to respond. I am personally against the deletion of these photos and prefer that these photos remain in place both on Wikimedia Commons and on the various articles they’ve been placed.
You note that the potential educational value of these photos are not outweighed by issues of privacy. I will speak to the point about privacy violations later but first I would like to discuss the educational value of the files. The 2000s and the early 2010s, when these photos were taken, was a time when young women in the Western World regularly exposed thong underwear. For those of us who remember the era, I do not think that this is a point of contention (Please let me if anyone reading would like to discuss this further). Regardless of what you believe about the so-called whale tale phenomenon, it was a part of life in Western countries.
We should note that this time period is quickly becoming history to the younger generations. In an effort to help them understand life during this time period, and understand all aspects of this time period, I believe the photos should remain as a visual aid for students to understand that young women “whale-tailing” was a part of life. While I understand reservations regarding these “creep shots,” these photos, and the very fact that they exist, represent a slice of the dynamics of life during this time period. Young women were exposing thong underwear and there were individuals, probably mostly men, taking photos. Eliminating these photos does not change the past.
In terms of the violation of the privacy of these individuals, you are both correct and incorrect depending on what jurisdiction is the focus of our discussion. In the United States, where many of these photos were taken, the act of taking a photo of an individual in a public location is not a violation of one’s privacy. This is also the case in Canada. In other words, if North American standards are being used here, these photos are not violations of privacy.
I would also like to point out in none of these photos, with the exception of perhaps the “2011 Milan Whale Tail” file, none of the women who are inadvertently showing their underwear are identifiable. This was the logic used for the inclusion of another file that shows a woman revealing her thong underwear (link: https://commons.wikimedia.org/wiki/User:Brianjd/Old#Identifiability).
This then leads to the next point I would like to make on precedence. Speaking further on that same whale tail photo, https://commons.wikimedia.org/wiki/File:Whale_tail_display.jpg, this photo has been on Wikipedia and has been used and currently is being used by a number of Wikipedia sites. It has, for example, been used by the Russian Wikipedia version of the whale tail article for many years (and no I am not the one who posted it on their Wiki site). At least in this situation, there appeared to have been some agreement that the educational value of the photo outweighed any other issues.
For these reasons, I would like to keep these files up. Thank you for your time. Please allow me at least 24 hours to get back to any responses.
