They're not the same image. It's a recreation and has a valid license.

In addition, I noticed that you've made a malformed deletion request, also here: not creating the subpage, naming the subpage badly, and not transcluding. Here, {{Delete}} is not for speedy deletion, please see COM:DP. I didn't create the subpage because I don't think a deletion request is needed at all and was waiting for Omphalographer to see my comment.

@Emdosis This is your problem. You uploaded Kenny Belue's photo without asking him for permission. So, I tag it with "No permission" in order to give you one week to contact the author for permission. Instead of doing that, you overwrited that file with an AI image, which violates our rule. I process dozens of images everyday, and I can't keep an eye on everyone's talkpage to see what they relied. @0x0a: If it's going to be deleted anyway I might as well replace it, no? It's not my fault Wikimedia websites are so restricted that people can't even delete images they uploaded themselves. Sure, now that I think about it, I could have requested a move before uploading (which I'll do next time). But I don't understand why you can't just delete the first image... @0x0a: Yes, I wanted to keep the filename (logically so, otherwise I'd have to change the link manually wherever this image is used). Now that Sreejithk2000 split the image and named the new image cute_hedgehog. I'll have to change the image when it invariably gets deleted (it was uploaded after 2018 so it has the revised pexels license which disallows it being uploaded to 'other stock photo or wallpaper platforms'). I'm giving the plainest example. The same would go for a novel image created from several CC-BY images, etc. If someone wanted to combine various CC-BY works and CC-BY-NC licence the result under their own name (in addition to the sources), we'd respect that rather than erasing the new name and treating it as CC-BY because the original works were already freely licenced. If you actually had gone through the effort of going case by case through all messages on my talk page, you'd have realized that I never actually uploaded anything that contributed a "copyright violation". At worst, I uploaded sth that was unclear whether it had copyright protection or not, and the other uploads had various licenses to share, just not good enough for commons. File:CuteHedgehog.jpg was deleted because it was uploaded 2 years to late (obscure pexels rule because their license changed post 2018).
File:Dramaticchip.jpg was deleted because when I realized that the CC-BY license also mentioned Non-commercial/no derivatives I removed it. Once again, not a copyright violation in the slightest.
I take back that you didn't do your due diligence, but throwing around warnings like this when they're wholly unnecessary is going to lead to uncomfortable situations like this.

When the designer of File:Dramaticchip.jpg sues the WMF and you personally for having that file on this site without a free license, you may sing a different tune. See also COM:LJ. I think you're highly overestimating the possibility that an inactive Deviantart user is going to sue the WMF for Death Note fanart being on commons but leaving that aside for a moment:
I didn't "have the file on wikimedia commons without a free license" for a week. I uploaded a work with a CC-BY license. Then realized later that it was released as non-commericial/no derivatives so I changed it. Because I'm honest. I could have easily left the CC-BY license and no-one would have noticed, probably for years, but I changed it to CC-BY-ND (which isn't valid on commons), and it got deleted 7 days later as a result.

I'm sorry but that part (on their website) about databases is easily overlooked. And you think I new about the pexels template? Seriously?
I didn't even know about this page all together. Let alone about Bad sources. Why on earth would I assume there are special licenses for specific websites? Or specific templates? That template isn't even linked on any Commons guideline page! The only way to know about that template is too look at other uploads that have the tag...
