Thanks for uploading File:Fotdella, a musical instrument.jpg. I notice that the file page either doesn't contain enough information about the license or it contains contradictory information about the license, so the copyright status is unclear.

If you created this file yourself, then you must provide a valid copyright tag. For example, you can tag it with {{self|GFDL|cc-by-sa-all}} to release it under the multi-license GFDL plus Creative Commons Attribution-ShareAlike All-version license or you can tag it with {{PD-self}} to release it into the public domain. (See Commons:Copyright tags for the full list of license tags that you can use.)

If you did not create the file yourself or if it is a derivative of another work that is possibly subject to copyright protection, then you must specify where you found it (e.g. usually a link to the web page where you got it), you must provide proof that it has a license that is acceptable for Commons (e.g. usually a link to the terms of use for content from that page), and you must add an appropriate license tag. If you did not create the file yourself and the specific source and license information is not available on the web, you must obtain permission through the VRT system and follow the procedure described there.

Note that any unsourced or improperly licensed files will be deleted one week after they have been marked as lacking proper information, as described in criteria for deletion. If you have uploaded other files, please confirm that you have provided the proper information for those files, too. If you have any questions about licenses please ask at Commons:Village pump/Copyright or see our help pages. Thank you.

It's a pity you deleted this as I had permission from the copyright holder, an auction house, to use it. I made that clear in the caption. Perhaps a human editor could have contacted me about the templates issue, I'm not so experienced in such matters. JasperWare (talk) 16:49, 21 August 2023 (UTC)Reply
Re: this one - I'll look into it. DS (talk) 17:33, 22 August 2023 (UTC)Reply
Thank you once again for offering to look into this. I must admit that despite having the permission, I wasn't sure what licence applied and wasn't sure how to find out. I can see I need to improve my navigation & skills on WP. Best wishes, JasperWare (talk) 18:58, 22 August 2023 (UTC)Reply
Hello JasperWare
A "permission to use this image on Wikipedia and related media" is not sufficient. We require any image uploaded here to be Free content. It must be possible to use it by anyone for any purpose. If someone wanted to print an article with that image, it must be ok. If a teacher wanted to make their pupils to color such image, that must be allowed. Even if someone wanted to sell a postcard with a collage of different instruments that included this one!
The most common licenses used here are the Creative Commons ones, such as Creative Commons Attribution and Creative Commons Attribution-ShareAlike which do require that the author is attributed for the work.
In fact, in this kind of cases we request that the copyright owner sends to the Volunteer Response Team an email such as this template to ensure they know what they are agreeing to.

Hello Platonides, Thank you very much for taking the trouble to explain this and my apologies to you and your colleagues for the extra work this has caused. I shall be very careful not to include any materials in future unless I am sure they fully meet the criteria. I absolutely understand the need to preserve WP as a trustworthy source of information and that is the main reason I support it in my small way. Best wishes, JasperWare (talk) 16:12, 24 August 2023 (UTC)Reply

edit

File:Donald Chisholm Towner.jpg has been marked as a possible copyright violation. Wikimedia Commons only accepts free content—that is, images and other media files that can be used by anyone, for any purpose. Traditional copyright law does not grant these freedoms, and unless noted otherwise, everything you find on the web is copyrighted and not permitted here. For details on what is acceptable, please read Commons:Licensing. You may also find Commons:Copyright rules useful, or you can ask questions about Commons policies at the Commons:Help desk. If you are the copyright holder and the creator of the file, please read Commons:But it's my own work! for tips on how to provide evidence of that.

The file you added has been deleted. If you have written permission from the copyright holder, please have them send us a free license release via COM:VRT. If you believe that the deletion was not in accordance with policy, you may request undeletion. (It is not necessary to request undeletion if using VRT; the file will be automatically restored at the conclusion of the process.)

  • This file is a copyright violation for the following reason: photograph of a photograph in a book with no provenance for the original image
Warning: Wikimedia Commons takes copyright violations very seriously and persistent violators will be blocked from editing.

Thank you for raising your concern. This is a photograph of a book resting on a table and bearing the author's signature, and is not merely a photograph of a photograph as you suggest. I believe it has been sufficiently modified to qualify as my own work and is not therefore a copyright violation. The book is in my own personal library and its public source is referenced in the bibliography of the article. However, to improve the image information, I have extended the caption. Naturally I do not wish to violate any copyright matter and so therefore await your further opinion. JasperWare (talk) 17:08, 21 August 2023 (UTC)Reply
If we were to crop the image of Towner out of your photo, or pixelate it into unrecognizability, would your photo still be useful? I submit that it would not. The image of Towner is the central focus of your photo, and is not merely a de minimis component.
Regardless of whether it has been modified sufficiently to count as your own work, it is still based on the original image by... whoever the photographer was, and as such the original copyright still applies. Provenance is important: it's not impossible that the original copyright has already expired (in which case the image can be un-deleted; 'deleted' content on WMF servers is simply made inaccessible to the general public), but we can't assess that without knowing who took the photo and/or when the book was published.
Ultimately, copyright is complicated. For any image that is based on a creative work by someone else, you should assume that it is copyrighted (and thus, not acceptable on Commons) unless you know the exact reason otherwise. If you're not sure, ask! Remember, the people who contribute to Commons are motivated by sharing their knowledge. DS (talk) 16:55, 22 August 2023 (UTC)Reply
Thank you very much for replying on this point and I really appreciate your explanation. I absolutely don't want to break any rules! I shall follow your advice and ask next time if I have any doubts. All the best, JasperWare (talk) 18:55, 22 August 2023 (UTC)Reply
