Hi. Sorry for 8 years delay in reply. This file (several lines of a satirical poem) is not my work. But it was published in 1910 in the Polish satirical weekly "Mucha" and therefore it is not copyrighted and was not copyrighted 8 years ago (all material before 1924 is on public domain and the first Polish copyright law was published in 1926) The link to this poem is here
https://polona2.pl/item/mucha-szkice-satyryczno-humorystyczne-zebrane-przez-f-kostrzewskiego-i-h-pillatego,ODA1NzA3Mw/1/#info:metadata
The name I gave to this file "flatau_michal_mucha1910paz28.png indicated that it was published in 1910 on 28 of October,
You can see that it is designated as being on Public Domain by the Polish National Library "Polona" (you can see this by observing crossed PD sign on the right in the link I provided). I still have this file on my computer and can resubmit it, but meanwhile I realized that I do not need to use it in my Wikipedia article and probably this was the reason that I did not reply sooner. Thanks. Puncinus (talk) 06:26, 25 August 2024 (UTC)Reply

Hi. Sorry for the late reply. As I indicated in 2016 I downloaded better version of this file on August 24, 2016. This file is still being used on Wikipedia. It is named
500mb_geopotential_height_wavenumber_4_Rossby_wave_(planetary_waves)_pattern._October_9-21,_2010_daily_average.jpg
It is marked as my own work. They way I created it was by generating graphics using US Government server which uses public domain meteorological reanalysis data of NOAA. Therefore it is not copyrighted. Puncinus (talk) 06:42, 25 August 2024 (UTC)Reply

Sorry for late reply. This file was in my family and I mentioned about it in the discussion. However, in retrospective I can state that it is not copyrighted because it is in the public domain because according to the Art. 3 of copyright law of March 29, 1926 of the Republic of Poland and Art. 2 of copyright law of July 10, 1952 of the People's Republic of Poland, all photographs by Polish photographers (or published for the first time in Poland or simultaneously in Poland and abroad) published without a clear copyright notice before the law was changed on May 23, 1994 are assumed to be in the public domain in Poland. This is a first page of a publication written by Piotr Lenartowicz, a Jesuit priest. I will ask his Catholic Jesuit Order in Cracow to give permission. Puncinus (talk) 23:07, 24 August 2024 (UTC)Reply
I just wrote an email to Cracow Ignatanium where Lenartowicz was a professor. However, in this 1970 publication - which is a dictionary of shanties (sailing songs) he doesn't list himself as an author, rather it is his "opracowanie" (he is an editor). The songs themselves were not his (hence he is an editor) and were most probably on public domain. He also list his mother (K. Lenartowicz) and 2 other people as his collaborators. So, even if I get permission from Jesuits in Cracow I do not know how to contact his collaborators. Puncinus (talk) 23:38, 24 August 2024 (UTC)Reply
You need to challenge this by using the button on the file page. And you need to send details to COM:VRT. This is the same for the files below. Challenging migrates this to a full deletion discussion and allows you to put your arguments forward. Sending details to COM:VRT proves that you have the right to upload them here.

Hi Timtret. Regarding your comment about my other submissions. I have been submitting to Commons following, according to my best knowledge, the copyright rules. Sometimes I am puzzled by these chalenges because Polish laws are different. The most difficult case for me was 1943 picture of Szpital Starozakonnych becuse it was on public domain in the US and not in Germany. In any case, I hope to resolve your recent challenges. Thanks for uploading File:Medal Brodowskiego i Paszkiewicza.jpg. This media is missing permission information. A source is given, but there is no proof that the author or copyright holder agreed to license the file under the given license. Please provide a link to an appropriate webpage with license information, or ask the author or copyright holder to send an email with copy of a written permission to VRT (permissions-commons@wikimedia.org). You may still be required to go through this procedure even if you are the author yourself; please see Commons:But it's my own work! for more details. After you emailed permission, you may replace the {{No permission since}} tag with {{subst:PP}} on file description page. Alternatively, you may click on "Challenge speedy deletion" below the tag if you wish to provide an argument why evidence of permission is not necessary in this case.

Please see this page for more information on how to confirm permission, or if you would like to understand why we ask for permission when uploading work that is not your own, or work which has been previously published (regardless of whether it is your own).

The file probably has been deleted. If you sent a permission, try to send it again after 14 days. Do not re-upload. When the VRT-member processes your mail, the file can be undeleted. Additionally you can request undeletion here, providing a link to the File-page on Commons where it was uploaded ([[:File:Medal Brodowskiego i Paszkiewicza.jpg]]) and the above demanded information in your request.

Timtret. I do not know where I should respond to your request for deletion of this. But I did some search of Polish copyright law. This document, together with the medal, was given to me in 2018 in recognition of achivements of my grandfather Edward Flatau. Such documents seems to be exempted from copyright because according to paragraph 4 of the Polish cooyright law that https://legalnakultura.pl/pl/prawo-w-kulturze/prawo-w-praktyce/news/3388,czego-nie-chroni-prawo-autorskie#gsc.tab=0 which states that excluded from copyright protection are:
legislative acts or their official drafts
official documents, materials, signs, and symbols
published patent or protection descriptions
simple press information
My understanding is that as this is an official document it is excluded from copyright in Poland and everywhere else. Only translation of this document is copyrighted. Anyway, I did write to official institution (Towarzystwo Lekarskie Warszawskie). that granted to me this document. Puncinus (talk) 06:05, 26 August 2024 (UTC)Reply
You responded correctly by challenging the process, which starts a full deletion request. I have offered an opinion at that discussion.   Welcome to Wikimedia Commons. While everyone is welcome to contribute constructively to the project, one or more of your file uploads had missing or false information regarding its source and copyright status. Please note that Wikimedia Commons takes copyright rules and infringement very seriously. Files may only be uploaded and included if their copyright status meets the conditions stated in our licensing policy, and if their source is clearly documented. Files that fail to meet those conditions may be deleted, and users who fail to meet them may be blocked. Please follow our first steps, if you haven't already. If you have questions, feel free to ask at the Village Pump copyright question page or on my talk page. Thank you. --Yann (talk) 11:40, 25 August 2024 (UTC)Reply

I replied to the recent challenges using reply button the same way as I am doing now to you. I own these files (note from P. Please respond either at the full deletion discussion, if there is one, or by challenging any speedy deletion process on the page of the file itself (where there is a big grey button to press, close to the notice of speedy deletion).
Only using your own talk page is useless; it does not form part of any discussion. Any formal challenge must be made either by the challenge button or by offering an opinion in the full discussion.
Ownership of an item does not mean you own the copyright. I own a Harry Potter book. The copyright is owned by the author.
If you know, or genuinely believe, that you are the owner of the copyright, or if you have received formal permission to upload material where others own the copyright, please liaise with COM:VRT who will help you resolve this. Part of that process is the restoration of relevant deleted files here.
@Yann: please will you clarify this if you feel I have been unclear, or incorrect, or if you have more to add. 🇺🇦 Timtrent 🇺🇦 talk to me 🇺🇦 15:59, 25 August 2024 (UTC)Reply

"Own work"

edit

You seem to have a missunderstanding of when "own work" is sufficient for an image to be acceptable on commons.

There's a distinction between the image itself and the subject of an image. If you made the image yourself then you can claim "own work" of said image. If the subject of the image is something artistic (e.g. a statue, a painting, etc.) then you also need permission to use that. That is called a derivative Work. To upload such an image, you therefore additionally need permission to use an image of said subject, except if that object is free for some other reason. One such reason is that the object is out of copyright. This is certainly true for Roman statues, because their creator has certainly died more than 70 years ago. Thus your images of a Roman Statue are fine to upload, because they're a derived work of something that is no longer under copyright.

I know this is quite confusing, but please ask if you need further assistance. PaterMcFly (talk) 13:04, 26 August 2024 (UTC)Reply

I agree with you. However, I am aware of copyright issues, and I have been uploading images that I assumed are not copyrighted (either because it was a Roman Statue, or because they were mosaics on public buildings (freedom of panorama), or because I asked verbally an artist for permission). But it seems that I should not have used "my own" work. Therefore, today I went over all puncinus files and requested that most of them are deleted, including Roman Statues as, in this particular case, I do not know if perhaps LACMA museums may claim copyright. Thanks. Puncinus (talk) 16:55, 26 August 2024 (UTC)Reply
I would like to thank you for your diligence in doing something that must have caused you pain and annoyance, and been distasteful to you.
For what my opinion is worth, I am going quietly through your DRs, suggesting deletion of some, retention of others, and commenting on those where I am also unclear. There is a silver lining. Any file of yours that is deleted may have that deletion overturns if proofs of the right to upload are sent to COM:VRT, even if some time has elapsed 🇺🇦 Timtrent 🇺🇦 talk to me 🇺🇦 17:21, 26 August 2024 (UTC)Reply

I looked just now at they deletion process for that file - the person who nominated it for deletion decided that it should not be deleted. I do not think that by looking at a picture you can deduce that its copyright was or not extended. The reason I gave why this picture is not copyrighted is that it was done using Work Progress Administration money. It was US project to help artists during the recession of 1930'. Such projects supported by US tax money are not copyrighted. Puncinus (talk) 16:48, 27 August 2024 (UTC)Reply
