Uploading paintings
editI see that you have been uploading paintings by various authors to Wikimedia Commons, marking them as "courtesy of Steven Stern Fine Arts". I appreciate your contributions, but there is a serious question whether or not you are actually allowed to do this.
The most important is that Wikimedia Commons only accepts material which is either in public domain (i.e. either the copyright has expired, or the work is excluded from copyright by law such as in case of works of the U.S. government), or under a free license. In order for the license to be considered free, it must allow third-party use and redistribution, modification/creation of derivative works, redistribution of the derivative works, and commercial use of the work itself or the derivative work. A license which e.g. only extends to Wikipedia or prohibits commercial use is not free enough, and images under such a license cannot be uploaded to Wikimedia Commons.
You have marked the images as under the CC-BY-SA license (which expressly permits the above-mentioned use; the only conditions are that the author is credited and that any work that makes use of the licensed image is itself under the same license). The question is: are you in a position to publish the paintings under this license? Was their copyright actually transferred to the Steven Stern Fine Arts gallery? If so, this needs to be verified; please see en:Wikipedia:Donating copyrighted materials for further instructions. If not, then the copyright is probably held by the painter himself or his/her heirs. In some cases the artist has died more than 70 years ago, and the image is now in public domain. (I have corrected the copyright tag for some of the images which you have uploaded.) In other cases, the images are still under copyright: File:ClarkALSON.jpg is a painting by Alson Clark, who died in 1949 - the copyright of his works will expire in 2019; on the other hand, File:PAULWONNER.jpg was made by Paul Wonner, who died in 2008, and his paintings will be under copyright for almost 60 years. In such cases - excluding clear evidence to the contrary - the images must be considered unfree. - Mike Rosoft (talk) 08:51, 15 June 2017 (UTC)
You didn't respond to my message here or at Commons:Administrators' noticeboard/User problems. So here's a follow-up:
- It is a reasonable assumption that you aren't actually a representative of the 'Steven Stern Fine Arts gallery'; you just upload images that they have published. In some cases this can be done (if the author has died more than 70 years ago and the painting is in public domain); but you can't mark the uploaded images as "your own work" and as under the CC-BY-SA license, because you are not the copyright holder. You need to mark them as public domain.
- It is good that you now only upload paintings whose author has actually died more than 70 years ago, but there's a catch: in most countries (according to Wikipedia:Public domain), copyright lasts until the end of the year and not until the anniversary of the author's death. (This means that paintings by Carl Oscar Borg should not be uploaded before 1 January 2018.)

Source of derivative work is not properly indicated: File:Fortune feeding time frame.jpg
editThis file may be deleted. |
A file that you have uploaded to Wikimedia Commons, File:Fortune feeding time frame.jpg, is a derivative work, containing an "image within an image". Examples of such works would include a photograph of a sculpture, a scan of a magazine cover, or a map that has been altered from the original. In each of these cases, the rights of the creator of the original must be considered, as well as those of the creator of the derivative work.
While the description page states who made this derivative work, it currently doesn't specify who created the original work, so the overall copyright status is unclear. If you did not create the original work depicted in this image, you will need to specify the owner of the copyright. Please edit the file description and add the missing information, or the file may be deleted. If you created the original content yourself, enter this information as the source. If someone else created the content, the source should be the address to the web page where you found it, the name and ISBN of the book you scanned it from, or similar. You should also name the author, provide verifiable information to show that the content is in the public domain or has been published under a free license by its author, and add an appropriate template identifying the public domain or licensing status, if you have not already done so. Please add the required information for this and other files you have uploaded before adding more files. If you need assistance, please ask at the help desk. Thank you! |

Great photos, but....
editGreetings Califpaint: You take great photos of other people's paintings, however you don't do such a good job describing, licensing and categorizing. I have gone through your contributions on William Wendt paintings today and fixed all those, but it is on you (based on COM:EVID) to provide this information - admins really should not have to follow users around fixing these things! If you need help, please ask. If you don't ask and you keep uploading everyone else's paintings as your own with incorrect licenses, I'm afraid a large chunk of your uploads may have to be discussed. Again, if you need help, contact me. Cheers! Ellin Beltz (talk) 20:11, 25 October 2017 (UTC)
- Hi Ellin..Thank you very much for writing me...I own 99% of the works posted and the other 1% are image I have sold to private institutions...Pleas help me understand how to properly do this so as not to cause any confusion.. I am a large gallery owner and have over 1000 paintings...Thank you again!! :) — Preceding unsigned comment added by Califpaint (talk • contribs) 17:50, 27 October 2017 (UTC)
- Can you disclose the terms you typically reach with the painters or their heirs when you acquire one of their paintings? Put another way, what would keep them from suing you for selling t-shirts, mugs, and whatnot with images of their paintings? — Jeff G. ツ 18:58, 29 October 2017 (UTC)
Hi Jeff, these paintings are in public domain and not the copyright of the heirs of the family. After I purchase these painting I have the previous owners sign a transfer of title over to me and i have a bill or sale. — Preceding unsigned comment added by Califpaint (talk • contribs) 17:27, 3 November 2017 (UTC)
- As an example, William Wendt painted in California and died in 1946 per http://www.williamwendtgallery.com/williamwendtbiography.html. Presumably, most of his paintings were shown/published in public during his lifetime. Were they shown/published with copyright notice? Was copyright renewed? What facts do you use to determine that "these paintings are in public domain and not the copyright of the heirs of the family"? — Jeff G. ツ 04:41, 7 November 2017 (UTC)
Image copyright
editOnce again, please be careful when uploading images. For example, File:EdgarPayneDivide.jpg is not an image made by you and under the CC-BY-SA license (in particular, just because you or your gallery owns the physical copy of the image, it doesn't necessarily mean that you are the holder of its copyright). It is a painting whose copyright has expired (because the author died more than 70 years ago) and is now in public domain. (Please don't summarily upload images under the default license, but choose the correct copyright status in the upload wizard.) Incorrectly marking images only creates unnecessary work for the other users who need to correct them (or, when the image was not in fact in public domain, to nominate them for deletion). - Mike Rosoft (talk) 09:45, 2 April 2018 (UTC)
File copyright status
editWelcome to Wikimedia Commons. While everyone is welcome to contribute constructively to the project, one of your recent file uploads had missing or false information regarding its source and copyright status. Please note that Wikimedia Commons takes copyright rules and infringement very seriously. Files may only be uploaded and included if their copyright status meets the conditions stated in our licensing policy, and if their provenance is clearly documented. Files that fail to meet those conditions may be deleted, and users who fail to meet them may be blocked. Please follow our first steps, if you haven't already. If you have questions, feel free to ask at the Village Pump copyright question page or on my talk page. Thank you. — Jeff G. ツ please ping or talk to me 16:59, 2 April 2018 (UTC)
Potential copyright violations
editI noticed that you’ve been uploading photos of paintings here. Even if you yourself took the photos, they may be violations of international copyright law, which is followed very strictly here. I’ve posted a question at Commons:Administrators' noticeboard/User problems because I don’t understand much copyright law myself, and more experienced users will be able to assess if there are any problems. Warning
editI see that you continue summarily uploading paintings under the default license, despite multiple warnings and a week-long block. I ask you to *immediately* stop doing that; otherwise, you will be liable to being blocked for an extended amount of time, possibly indefinitely.
Instead, you need to provide correct information when uploading images. Usually, when the author has died more than 70 years ago, the work is in public domain; however, there are some subtle rules depending on when (and if) the work has been published. See Commons:Public domain for more details. This is why we need as accurate information as possible; we certainly don't want Wikipedia or its users to use the images in a way which would be contrary to law. - Mike Rosoft (talk) 08:59, 16 June 2018 (UTC)

editNext time time it will be indefinitely. Yann (talk) 11:20, 16 June 2018 (UTC)
Contacting me
editIn general, you should not edit another user's user page. Instead, you should create a new section on the user's talk page (such as User talk:Mike Rosoft). (You have accidentally added my user page to the nonsensical category Category:Hi, i do not know how to reply to you..I hope this work?; because I wasn't notified of the edit, I have only now discovered that you were trying to contact me.) - Mike Rosoft (talk) 20:51, 2 January 2019 (UTC)
