Your Deletion request to William Macadam edit

Hi, Ellen, I understand you wonder if you can delete duplicate photos I uploaded. Yes the ones not being used in the various Wikipedia pages and I do apologise for the duplication upload. I was lightening the photos as appeared to dark. If in doubt can you just e-mail me at w.macadam@norfolk-international.com as I am too rusty on figuring out how to talk to you on Wiki. I own copyright of all the photos and am making them available to Wikipedia Commons as in my upload info. The ones that should not be deleted from Wikipedia Commons are the ones i have used in the information box of Stevenson Macadam lighter image of two used) and William Ivison Macadam Wikipedia pages and the one of Caroline Ladd Corbett Macadam (lighter image of the same darker image) inserted in the Ivison Macadam page (his wife)

Pay attention to licensing
Wikimedia Commons only accepts free content: images and other media files that can be used by anyone, for any purpose.

File:Front of Elliott R. Corbett (original house N. front) 1915.jpeg seems to be free (or it would be proposed for deletion), but it was identified as having a wrong license. Usually, it is because a public domain image is tagged with a free license, or because the stated source or other information is not sufficient to prove the selected tag is correct. Please verify that you applied the correct license tag for this file.

If you believe this file has the correct license, please explain why on the file discussion page.

The reason given by the user who added this tag is: You have not provided any evidence that the photo was published before 1923. Use of the PD template requires evidence that a photo was published before 1923, not merely taken before 1923. To use that license, you need to cite name of publication, date, author, page no., etc. as evidence of pre-1923 publication.

(Unlike the previous instance, I decided to post my reply to your 8 March question on your talk page, instead of mine. You should post any reply to this message here, and I'll temporarily keep your page on my watchlist, so that I'll see any reply you post.)

Thanks for replying promptly and trying to fix the issues. However, your change to the File:Front of Elliott R. Corbett (original house N. front) 1915.jpeg page is insufficient. You have not removed the claim that the file has been "published", whereas none of the info. you wrote on the file page after "original publication" is evidence of publication. Being in an archive is not a form of publication. Second, if being the official archivist of a collection gives you the authority to release a photo into the public domain, simply stating such on the file page is not sufficient as far as I know (that does not mean that it doesn't happen on Commons; it happens a lot, but it's running afoul of Wikimedia's rules). As far as I know, every photo that was taken by someone other than the uploader has to include proof that the author released it under one of the few licenses Commons allows. For U.S. images, if you are unable to prove this by (e.g) providing evidence of publication (i.e., in a book, magazine, newspaper) before 1923, I believe you technically are required to use the OTRS system on Commons, which can be time-consuming, but I'm just the messenger and someone always who tries to do what is legal. Please read the OTRS page, but if you have questions, use the Commons:OTRS/Noticeboard, because I know very little about the OTRS process myself.

I only tagged those two photos, and did not check your other Oregon-related image uploads for possible copyright or license issues, because I don't want to spend the time to do so. Speaking more generally, I don't think I'll be able to help you any further with this, because (1) I don't know enough about it and often have great difficulty finding appropriate substitute licenses on Commons that might apply when I "tag" someone's upload as having the wrong license (before writing this message to you, I checked here and here, among others, but could not find one that might fit the house file), and (2) I just don't want to spend the time, as I have a long list of Wikipedia editing and Commmons editing and other activities I am hoping to do in the not-too-distant future.

Please don't take this the wrong way, but I hope you accept that the responsibility to ensure that your image uploads are legal (e.g. that they don't assert false claims of publication) and marked with the correct Commons license falls on you. Figuring it out can be very time-consuming, but I'm just the messenger, and should you choose to take no action, I don't plan to keep checking. I hope you'll understand that I am just trying to do the ethical thing, by pointing out the issue. If you need further help, the Commons:Help desk and (more relevant to copyright questions) Commons:Village pump are available, where you can ask questions. The main reason that I know relatively little about this subject is that nearly 100% of the many (more than 1,000; probably more than 2,000) images I have uploaded to Commons were either (1) taken by me, were (2) from a Flickr page where the author released it under one of the relatively permissive licenses Commons accepts (and where it seemed clear that the Flickr user took the photo himself/herself), or (3) were published in the U.S. before 1923 and where I know the title, date, publisher, page no., etc. of the publication.

Please do not infer criticism from this. So far, you seem to be attempting to do the right thing, and I am assuming your use of the wrong license templates on some of your image uploads was just due to inexperience. Steve, thanks for this. I much appreciate your sharing.
I have been meticulous in only uploading images that our mine, I have written permission to do so, or in the public domain. As an 80 year old historian with an interest in Portland and Oregon's fascinating past going back to the early discoveries by the Europeans and with some valuable historically important files I am trying to put what I can up on Wikipedia and the public domain while I am still kicking. I plan to have this Archive ultimately go to the Oregon Historical Society. It has taken a lot of work, research and my time.
I have wanted to improve the history section of the Wikipedia entry on [Portland, Oregon], which could do with some improving but whether I can tackle that or not I am not sure yet with my other workloads.
As a past international television documentary and film producer and a production company owner I am very familiar with copyright laws. The problem is probably my uploading into the right Wikipedia category. There is obviously one to upload historic photographs that have not been published in a newspaper, magazine or online-site. It seems that you think I may have used the wrong licence or upload. I appreciate your flagging this. I will try and have a word with OTRS to make sure that I have given them what they want under the correct license. I have e-mailed various prermissions to Wikipedia in the past (I believe that would be OTRS?) and they have been very helpful.
It is going to take me a few days to get my head around this. Phew, there are a lot of hoops to jump through to get things right after all years of research to get the entry right. It does make one want to give up with the sands running out on one but I will get a second wind. Thanks for all your help now, rather now than down the line. It has been found that you've added in the image's description only a Template that's not a license and although it provides useful information about the image, it's not a valid license. Could you please resolve this problem, adding the license in the image linked above? You can edit the description page and change the text. Uploading a new version of the file does not change the description of the file. This page may give you more hints on which license to choose. Thank you.
