Nutzungsrechte edit

File:Belkina Katerina, For Petrov-Vodkin.jpg edit

File:Belkina Katerina, For Petrov-Vodkin.jpg has been listed at Commons:Deletion requests so that the community can discuss whether it should be kept or not. We would appreciate it if you could go to voice your opinion about this at its entry.

If you created this file, please note that the fact that it has been proposed for deletion does not necessarily mean that we do not value your kind contribution. It simply means that one person believes that there is some specific problem with it, such as a copyright issue. Please see Commons:But it's my own work! for a guide on how to address these issues.

Please remember to respond to and – if appropriate – contradict the arguments supporting deletion. Arguments which focus on the nominator will not affect the result of the nomination. Thank you!

If you want to see the document that I attached on this email you can have a look here: https://www.dropbox.com/s/ybmmp4ffr6tv0o2/160329%20Urheberschaft%20Nutzungsrechte%20Wikipedia.pdf?dl=0 --Katerina Belkina (talk) 17:22, 30 March 2016 (UTC)Reply

Edit warring edit

You've been told not to revert and yet you've reverted, So revert one more time and I will have you blocked and all of your images deleted, Comprende?. –Davey2010Talk 03:32, 18 December 2016 (UTC)Reply

Dear Davey, I saw your warning but also you wrote before that you are not an expert of this issue. Thats why decided to change it back because this size of artworks was not from CC licensed and the user who upload this pictured was taken from my website. This is restricted and illegal. Now I am working together with an professional mentor who will assist me with this issue and tomorrow morning I will contact the wikimedia support team here in Berlin to inform me about this issue. Kind regards --Katerina Belkina (talk) 14:18, 18 December 2016 (UTC)Reply

Nope I'm not an expert however that doesn't give you any right to revert - You went to FORUMS whch is the correct thing to do however the next thing you should do is wait, As I said if you've released those images under the above license then that wold also include the higher res images, Okie dokie that's probably the best thing, I apologise for the harsh warning which I've partially struck but I would advise you don't revert as edit warring can get you blocked. Thanks. –Davey2010Talk 14:26, 18 December 2016 (UTC)Reply

Dear Davey2010, please show me the weblink that explain exactly this fact. Because in the regulations of this CC licenses is written that its possible to share and to modify the offered picture. But not to exchange it with and stolen one. In fact the user who uploaded all this highres pictures never shoot them with an camera he is using material from a other source. I think you read the CC licenses wrong and interpretate it as you like. --Katerina Belkina (talk) 14:31, 18 December 2016 (UTC)Reply

Hi Katerina, Although I deal with copyright violations I've never dealt with this before so I would have no idea but I would assume the license would cover the originals?, As I can't find anything that says this can be exchanged (and as I'm not entirely knowledgable with this) I've reverted for now however these may be reverted again by anyone and maybe admins too, Thanks, –Davey2010Talk 14:50, 18 December 2016 (UTC)Reply

Dear Dave, when you deal already a while with copy rights I would like to explain you following different situation and than you maybe understand better

Situation A: there is a Museum lets say the Rijksmuseum Amsterdam and a Wikipedia user is going there and shoot on a tripod and a good digital camera the artwork of Van Gogh and upload it on Wikimedia. He proof that he was shooting the artwork with his camera on date X and offer his photo to the community under a license of CC. Now appear a other Wikipedia user and comes in the same museum with an even better camera also he is using a tripod but he ask the museum to use a special lighting show the colours much better and closer on the original. Later he is uploading the picture on wikimedia and is exchanging the existing one because his is much betters as the picture of the first unser. Situation is The original artwork is always in the museum and because the artist Van Gogh is already since more than 70 years death its possible to use the artwork without problems in print and online media.

Situation B: the artist Katerina Belkina is still alive and working and artist live is always a risky live. Katerina is working digital so her artworks created on the computer in a high resolution. This artworks she is offering to her collectors as an fine art pigment print on Hahnemühle paper in small editions. So the files that she is using for the fine art prints and the files that she is using on her website and here on wikimedia as the same source file. It means it was made with reason when Katerina Belkina uploaded the small pixel resolution pictures on wikimedia for bringing some visual content to the public. So for example if somebody is stealing the high resolution data from somewhere (from website of the artist or from print lab or from...) is the source data in wrong hands and it provide to every body to produce copies like originals. Because the original is a digital one. But when somebody upload better photos of the picture from Rijksmuseum it will be never a original Van Gogh. --Katerina Belkina (talk) 15:18, 18 December 2016 (UTC)Reply

Hi Katerina, With Situation A that could never happen as you're not allowed to reupload an image over another especially if it's different from yours, You can only crop images and repload but never reupload with a different image,
With Situation B I totally understand where you're coming from no one wants their work taken but if the the editor had got a hold of it then it's obviously easily accessible and you may want to do something about that as I think this could happen again,
Thanks, –Davey2010Talk 15:36, 18 December 2016 (UTC)Reply
Hi again, I had completely forgot to say above but inre to my comment yesterday specifically "I mean ofcourse if you were to pay me £1,000 I would have them removed now  " - This was simply a joke and my attempt at lightening the mood - I'm in no way trying to bribe you or get money or anything like that - It was simply a joke! So if this gets (or has got) mentioned to the WMF then I would hope they would know this but anyway I apologise if you took this as some sort of threat or whatever - Wasn't the case at all, Thanks, –Davey2010Talk 23:14, 18 December 2016 (UTC)Reply

Notification about possible deletion edit

Some contents have been listed at Commons:Deletion requests so that the community can discuss whether they should be kept or not. We would appreciate it if you could go to voice your opinion about this at their entry.

If you created these pages, please note that the fact that they have been proposed for deletion does not necessarily mean that we do not value your kind contribution. It simply means that one person believes that there is some specific problem with them, such as a copyright issue. Please see Commons:But it's my own work! for a guide on how to address these issues.

Please remember to respond to and – if appropriate – contradict the arguments supporting deletion. Arguments which focus on the nominator will not affect the result of the nomination. Thank you!

I hope from now all is fine. if you still have some requests please let me know and please offer me also a way how to solve it. I am not a expert of this website here. Kind regards Katerina Belkina Katerina Belkina (talk) 11:18, 5 March 2018 (UTC)Reply

  • Katerina, as far as I understand, you are the author of paintings on photos. That's perfect, it means we have the artist's permission to license them freely. However, that's not all: we need another permission, from the photographer. Please provide a link to an appropriate webpage with license information, or send an email with copy of a written permission to OTRS. Sealle (talk) 11:43, 5 March 2018 (UTC)Reply
    • Dear user Sealle, yes it is right that I am the artist (Katerina Belkina) who created the artworks in the uploaded photos. In the 5 photos below on which I am portraited the photographer was my husband Karsten Meißner. He shooted this 5 photos based on my clear instruction and with my personal camera. Thats why I see my self as a author of the the photos. Not the press on button is the creative work of an photography its who leaded it (position, cropping, vertical or horizontal, lens and so on. Also I used the permission assistent here on Wikimedia and put the information in that they (this 5 portraits) was shooted by Karsten Meißner and I have the full used rights and also I published his privat email in the form. So its possible for the Wikimedia redactors to contact him and ask him. There exist no website of Karsten Meißner where he publish photos. I am open to discuss this issue further if you have any questions. My interest is it to have this photos soon full integrated in the database of Wikimedia. It would be great if we can close this issue today. Thank you in advance. Katerina Belkina Katerina Belkina (talk) 12:00, 5 March 2018 (UTC)Reply
      • Well, you see yourself as an author, but we on Commons don't, and this policy is not a subject to discussion. Please ask your husband to follow COM:OTRS procedure to confirm his permission to distribute these photos under a free license. Sealle (talk) 12:21, 5 March 2018 (UTC)Reply

Dear user Sealle, Ok its not a problem to do this. But still if for me and my husband not clear how to do it practical: Which exact weblink we have to use and where to write this permission for free use on wikimedia? I clicked with my mouse on the weblink that you wrote in the text COM:OTRS but there was for me noting to find about a permission from my husband. This website here is not really user friendly designed and its so difficult thats why we have here so a endless discussion about this issue. Its not because of not willing. So please letz me know how my husband can provide to Wikimedia the permission of a free use of this 5 photos where I am to see as a person.

1. I need to visit a special website where my husband need to write something? 2. Is there a email address to send the permission from him?

I hope you next answer will lead to success. Kind regards Katerina Belkina Katerina Belkina (talk) 12:29, 5 March 2018 (UTC)Reply

  • Please open COM:OTRS page once again, start reading the text on it, scroll it down and go on reading. Everything you need including e-mail address and a form to fill you will find on this particular page. Sealle (talk) 12:53, 5 March 2018 (UTC)Reply

Commons:OTRS/ru. --A.Savin 14:39, 5 March 2018 (UTC)Reply

Dear user A.Savin, all uploaded photos are now in the permission process. It means I used this weblink for sending the permission of all the photos. In parallel I ask my husband Karsten Meißner who was shooting the photos with me in the frame and also he send to the Wikimedia permission team the emails of his photos. I think and hope now its just a question of time until the photos will be mark as approved by the Wikimedia team. Lets see. Thanks for uploading File:Direktorenhaus Berlin, Februar 2017, Ausstellung Katerina Belkina (2).jpg. This media is missing permission information. A source is given, but there is no proof that the author or copyright holder agreed to license the file under the given license. You may still be required to go through this procedure even if you are the author yourself; please see Commons:But it's my own work! for more details. Please see this page for more information on how to confirm permission, or if you would like to understand why we ask for permission when uploading work that is not your own, or work which has been previously published (regardless of whether it is your own).
