Bonjour,

Au sujet du fichier La cabane à sucre l'automne.jpg, je vois que le fichier est en possibilité de suppression pour cause de license insufisante. Je n'ai pas accès au système des courriels de Wikimedia (OTRS), mais je suppose que le contenu du courriel qui avait été envoyé à Wikimedia utilisait une formulation semblable à celle de la note que vous avez incluse dans la page de description du fichier, c'est-à-dire [l']«héritière du peintre Octave Bélanger, m'a accordé le droit de photographier et de reproduire les oeuvres de son père sur Wikipedia». Je ne sais pas si le volontaire OTRS qui a traité votre courriel a pris le temps d'expliquer exactement ce qui manque pour valider ce fichier et ce qui est attendu par Wikimedia dans ce genre de situation. Voici donc quelques suggestions à ce sujet. Au pire, je me trouverai à répéter ce que vous savez peut-être déjà.

L'essentiel est que la vocation fondamentale de Wikimedia est d'utiliser et d'offrir du contenu qui peut être repris et réutilisé légalement par toute personne. Ainsi, Wikimedia ne demande pas aux propriétaires de droits d'auteur d'accorder à une personne en particulier ni à Wikimedia une permission privilégiée ou exclusive pour que Wikimedia puisse publier le contenu en question exclusivement sur un ou plusieurs sites de Wikimedia. Plutôt, Wikimedia accueille le contenu que les propriétaires de droits d'auteur veulent offrir pour réutilisation possible par n'importe qui, y compris à l'extérieur de Wikimedia. Le propriétaire des droits d'auteur exprime cette volonté par l'offre d'une licence libre (ou l'équivalent). Une telle licence, par définition, s'adresse à toute personne du public en général et n'est pas exclusive. Pour donner un exemple parmi d'autres de licence libre, une licence libre souvent mentionnée est la licence CC-by-sa 3.0. Il en existe aussi de nombreuses autres.

On voit donc en quoi la permission précitée de Mme Marcelle Bélanger Bordeleau ne correspond pas à une licence libre. En effet, cette permission est accordée exclusivement à une seule personne (vous), plutôt que d'être disponible pour toute personne, et elle est accordée pour une utilisation exclusivement à un seul endroit (Wikipedia).

Maintenant, que faire ? Tout dépend de ce que Mme Bélanger Bordeleau souhaite vraiment faire. Si elle ne souhaite pas offrir de licence libre, il ne reste qu'à supprimer le fichier de Commons. Dans ce cas, je suggérerais de demander vous-même la suppression immédiate du fichier, car alors il serait inutile de laisser ce fichier affiché sur Commons comme étant un fichier à statut précaire. Si elle souhaite offrir une licence libre, alors dans ce cas il s'agirait de faire parvenir à Wikimedia un nouveau courriel qui inclut une déclaration de licence libre spécifique, déclaration faite par la propriétaire des droits d'auteur. Les détails et un exemple de déclaration sont mentionnés dans le guide Commons:OTRS/fr. L'exemple de déclaration doit bien sûr être adapté selon les spécificités du cas particulier. La déclaration devrait spécifier si la licence concerne, par exemple, une image spécifique, ou l'ensemble des images qui seraient téléversées depuis votre compte, ou l'ensemble des oeuvres d'Octave Bélanger. Notons que dans le cas où Mme Bélanger Bordeleau ne serait pas l'unique héritière des droits d'auteur d'Octave Bélanger, il faudrait alors s'assurer d'obtenir aussi l'accord des autres copropriétaires des droits d'auteur.
