@Swastik Mridha: Where does it say it's a free for use image? It literally says "rights managed", meaning there are restrictions and price scales based on how it's used. It's very much not free. And an image that's "free for use except any advertisement purpose" is not allowed on Commons because that's not a free license.
Anyway, it looks like you misunderstood the "for editorial use" restriction. It means that editorial outlets (i.e. news websites) can use the image by paying the licensing fee. Non-editorial users (like advertisers) can use the image with certain restrictions and permissions. It is not a free-to-use image. Ytoyoda (talk) 14:01, 5 May 2020 (UTC)

This files were originally created by the Government of Chile and as far as my understanding of law goes they all fall within Attribution-ShareAlike 3.0 Chile (CC BY-SA 3.0 CL).

www.temuco.cl is the official website of the government of the city of Temuco

www.chileestuyo.cl is a website operated by the National Service of Turism (Servicio Nacional de Turismo; abbreviated as SERNATUR) which is part of the Ministry of Economy, Development and Tourism.

www.municipalidaddecamiña.cl is the official website of the government of the town of Camiña

www.fcalp.cl is the official website of the Arica-La Paz Railway (Ferrocarril Arica–La Paz) which is operated by EFE (Empresa de los Ferrocarriles del Estado) which is owned by the government of Chile.

www.goretarapaca.gov.cl is the official website of the Government of the Region of Tarapaca.

That is my understanding of Chilean copyright law, if I'm mistaken then I apologize for wasting your time and won't do anything to contest your final decision regarding the matter.

The Chilean government was not the original creator of Mejillones.jpg, the website of the national service of turism that hosted the picture was taken down, the original image does have a Editorial Use Only license, so I'd really appreciate if you could take a look at it and determine whether the copyright is correct and if the picture should be deleted or not. @AtomsRavelAz: Thanks. In general, please add links to the pages where you find your images, not just the website (like this). That makes it so much easier for other users to verify that the license is correct. Though a question - the {{CC-GobCL}} applies to the works of Chile's national government, it's not clear to me if it also applies to the works of city governments or the EFE, a company that's funded and operated by the government, but not the government itself. Regarding {{CC-GobCL}}, I read ordinance 112/14 (Link in Spanish) issued by the Ministry General Secretariat of Government regarding this matter. On item II (p.1) it states that the ordinance applies to "informative websites of the administration of the state(i.e the country), dependant or related to the central government". City governments in Chile are part of the administration of the state and are dependant and related to the central government, EFE is dependant of the central governemnt. Unfortunately, the Flickr public domain mark isn’t accepted at Commons, as it’s not an actual license - it’s a way for Flickr users to claim that an image is in the public domain for another reason, such as work whose copyright has expired.   1. I didn’t edit the page. Not sure what gave you the impression.
  2. Even if I did, there’s nothing wrong - no one owns Wikipedia content. It doesn’t belong to the subject or any particular editor.
  3. Remember to assume good faith. Even if you disagree with something, please don’t question other editors' intent.
  4. What I did do was point out copyright issues with photographs you’ve uploaded. Copyright for photographs generally belongs to the photographers, not the person in the photographs. You’ll need written permission from the photographers to keep them here.

@Ytoyoda: Oh man, If I wanted to make screenshots, I would make them with much better quality. Today, everything is on YouTube. I am a former journalist photographer, I worked for a newspaper in France for 20 years and I give you these pictures that were not used because they were of poor quality, for this other one I did not know it was published, now I see it for the first time. Maybe I gave it to someone I don't remember. In journalism, photos are often exchanged with colleagues. But as you wish, I will not explain anymore, in the end I certainly have none of this. Hi Ytoyoda, I noticed the warnings regarding the images that I uploaded, and I tried in every way to find a suitable solution as new in the sector.

I have tried every way to find a solution, but unfortunately it has been in vain.

@Dominikcapuan: Thank you for leaving a message. So here's the deal — all images on Commons have to be free. Not free as in free of cost, but free of copyright restrictions — we need users to be able to take any content from the site and use or modify for any purpose. Now, almost every photographs you find on the internet are copyrighted, because that's the default — if you take a picture on your phone, you own the copyright to that picture unless you declare it's in the public domain. Now, there are resources for license-free photographs, but like I said, most of what you find online are copyrighted and aren't accepted here. Your best bets are:
  • Asking photographers to relicense their photographs under a Creative Commons license, like {{CC-BY}} or {{CC-BY-SA}}
  • Taking photographs of people yourself (I realize that's difficult now with the pandemic)
Otherwise, you just have to deal with some articles not having decent photographs. I know that's frustrating — I'm having trouble finding images for articles I edit, too. Hope that helps. 23:07, 31 May 2020 (UTC)

@Ytoyoda: Incorrect , by "data" they mean photo, audio, text, video... Anything that license applies to.

Quoting from the pdf of GODL India (3rd link in here: https://commons.m.wikimedia.org/wiki/Template:GODL-India): “Data” means a representation of information4, numerical compilations and observations, documents, facts, maps, images, charts, tables and figures, concepts in digital and/or analog form, and includes metadata.

Hello. Please be careful when categorizing files by User:MaedaAkihiko. He often uses the retouching software PicsArt and it seems to delete original dates of photos from their Exifs. A question before uploading a photo

Hi Ytoyoda,

I am planning on creating a Wikipedia bio on Julie Chavez Rodriquez (political activist and granddaughter of American civil rights activitst Caesar Chavez). She has a photo on the Obama White House website. [3]] I believe this image to be public domain, as it is produced by the U.S. government. Am I correct? @MauraWen: Hi, I think the image is perfectly fine, though you might want to work off the version at https://www.nbcnews.com/news/latino/white-house-julie-chavez-carries-grandfathers-public-service-legacy-n331446, since it’s at a much higher resolution. It depends. Like your link says, FBI mugshots are in the public domain, but copyright for booking photos from other agencies depends on the copyright policies of their jurisdictions. So it wasn't obvious from your description who took the photo (you only provided the Bleacher Report link). But it looks like he was arrested by the Miami Beach PD, so the picture looks fine.
Though in the future, please make sure to provide the agency that took the photo, not just the article link, and fair use is not allowed on Commons. Thanks for checking in though. Ytoyoda (talk) 14:09, 8 August 2020 (UTC)

@Dor-astra: Yes. The key phrase there is "provided that the entire item is reproduced". That means the European Parliament does not allow end users to modify images. All photos on Commons must allow derivative works. @Ablasaur: Thanks for reaching out. You could upload a photo from an Instagram account, but a couple of important things.
  1. The copyright owner needs to verify permission through the process described at COM:OTRS
  2. The copyright owner probably is not the subject/Instagram account owner. You'd most likely need to get permission from the photographer.
Though it looks like the Getty Images photographer has given permission to publish the photo freely, so the existing photo seems fine. Ytoyoda (talk) 14:16, 18 August 2020 (UTC)

Well, while I may be wrong and you may be right here, I do not think that such a doubt qualifies as speedy as it is not just an obvious copyvio. And Flickreviewr is efectively a speedy nomination that cannot be even contested, as the declared license template ({{PD-old-100}}) is incompatible with Flickr and a failed Flickrreview cannot be even converted to a DR. Wrong RD

Hi. You made Category:Model an RD to Category:Models. Category:Models is not a cat but a disam page; therefore the RD does not serve anything good. It will only cause people to add their out of scope images to a disambiguation page, where they will pile up. Who will clean up there, yourself? OTOH, Category:Model is the legitimate cat for a Turkish musical group. How will people know that they have to look for it as "Category:Model (band)? When you write "Category:Model" into the search box, there is no indication of the band whose name is "Model"! This is unacceptable. Find a solution or say "I was wrong". @E4024: I changed the redirect back to going back to the band. Though I wonder if it make more sense to redirect to Category:Models (people). The category without the disambiguation was clearly causing confusion, as inexperienced users were putting modeling photos in the band category.
I believe the best practice is for the Commons cat name to match the English wiki name when possible. In this case, it’s en:Model (band). That’s pretty common when a band name is also a common noun. The first sentence of the license template says "This is a logo of an organization, item, or event, and is protected by copyright" and it literally says "Any other uses of this image, on Wikipedia or elsewhere, may be copyright infringement"! If an en-wiki image has a fair use rationale, it cannot be uploaded to Commons. Also, modifying or vectorizing an image does not make you the copyright holder. "Building exteriors"

I see that you are adding nonexistent categories like Category:Building exteriors in Washington (state) and Category:Building exteriors in Connecticut. Are you planning to create these categories?

You might want to think twice about this: I'm sure that a solid majority of pictures we have of buildings are of their exteriors. I would guess that over 90% of the images directly in, for example, Category:Buildings in Washington (state) are of exteriors. I created the "Building exteriors in..." subcats as a way to organize the various exteriors subcategories like Category:Exteriors of museums in the United States or for specific buildings, like Category:Exterior of the United States Capitol where the building categories require subcategorization. @Phillypaboy123: I'm not sure what you mean by "their website", but you should know that almost every photo you find on the web is copyrighted and cannot be uploaded to Commons. There are a few exceptions (some photographers license their photos with Creative Commons licenses), but unless you see specifically stated that the work is in the public domain or CC-BY/CC-BY-SA, then you should assume that you can't upload it here. That does not mean you can do whatever you want with the photographs. Chances are, the websites you go to say "All Rights Reserved." I assume this is @Phillypaboy123: ? That's a good question, and I didn't know about Getty Images doing that so thanks for the link. But it looks like Getty Images' "free" program is about "free of cost", not "freely licensed", which is what we mean by "free images". In the article, it talks about Getty Images requiring users to embed images using Getty links. That means end users can't freely edit the photos — they have to use the original Getty Images photos without modifications. Any images on Commons has to allow modifications and derivative works. Also, it looks like the free use program only applies to Getty's stock photos (the "creative" photographs that you see in ads and in blog articles), and not the news photographs. But I and my company hold the copyright to the actual photo(s). One photographer was on set JV and the other photographer AG was hired for an event at the Mann's Chinese Theater that we held. I will go back to IMDB and correct the actual Ownership of the photo as on IMDB you are given the right and ability to upload your own work. I am a victim of a cyber-crime right now that's being investigated outside of this program and "daily" individuals are making drastic changes to this page with my film career information on it. Not blaming you but may I ask what alerted you to the page with my name on it in particular? And sadly, I actually so own "both" photos factually and can prove as such through a private link on at minimum one of these photos (they are both old), the other I have work contracts to prove ownership. So, often a image may in actuality belong to someone or an entity/company even though you cannot locate the actual ownership on the internet. Would a better policy be to check with the Wiki-User first to see if they own the photo or not first rather than delete it and state that there is a copyright issue? I am not being mean by stating this, please know. But if this was done to me this must be happening to many, many other individuals who are editing as fairly as they possibly can and then they are knocked down. @Vallee01: Because being from 1938 does not make the image free. The license you chose, {{PD-old-70-expired}} says the image is in the public domain if it was published before 1925 or the author has been dead for 70 years or longer. Neither of those is true. 1938 is after 1925 and the photographer died in 1982, which is less than 70 years ago.
Now, if you remember, you initially claimed the image was from 1923 even though the source says 1936 and the Spanish Civil War didn't start until 1936. After I corrected your mistakes and presumably realized that the license was not valid, you added a non-free license, and you then presumably realized the image would be speedy-deleted. It's doubtful, since there's already a version of the image on Wikipedia. There should not be more than one copy of a non-free image. Also, the Flickr link says who colorized the photo, but the copyright always belongs to the original photographer. Ytoyoda (talk) 14:48, 18 November 2020 (UTC)

In the United States anything created in the Spanish Civil war from 1936-1939 are licensed freely: https://www.loc.gov/rr/print/res/245_spcw.html "Posters in this collection were published in Spain between 1936 and 1939. There are no copyright notices or symbols on the posters." I am nearly certain the copyright status is gone, but I can't appear to find it, I will keep digging and won't stop until I get this photo on Wikimedia, I don't care if I need to track down the family of Marina to get permission, I don't care if I need to travel to Spain (Well I won't do that). It's such a good photo that tells a million words, it's criminal for the world not to see it, it's just an amazing piece of work and for it to be removed is a disservice to the world.
I also want to say how absurd this is, Marina was a known anti-capitalist and communist and who's photo is a universal symbol of anti-capitalism. Who's photo is currently being discussed for who owns the copyright status, to me that is extremely depressing. Nobody would care if this image was used. Well you have to defend intellectual property rights which simply push humanity back. Good luck with that? Though a couple of things:
  • The link you provided says ...if the posters were copyrighted and the copyrights were renewed, they are protected for 95 years from the copyright date. Simply being from the 1930s isn't enough to strip its copyright. Since we know the photographer and that he lived until 1982, the copyright protection remains.
  • Your best bet is to contact the photographer's estate. Copyright belongs to the creator, not the person pictured (the subject has some personality rights, though that's not what we're discussing here). Ytoyoda (talk) 17:44, 18 November 2020 (UTC)

@StrangeTraveler: Hi, paying Getty Images only gives you a license for a specific use. It does not make the image copyright-free. To upload an image to Commons, the owner (in this case, Getty Images and the photographer) must relinquish all rights, and all users must be able to modify, republish or sell the image without restrictions. I thought I had added these images correctly but it seems not, but I am not sure how to add the images correctly, please can you advise what I need to do differently?

To confirm: Southall Football Club own both of the images and have sent both of the images to me by email and have given me permission to add them to the Southall F.C. Wikipedia page (https://en.wikipedia.org/wiki/Southall_F.C.).

Therefore there is no issue with permission, the only issue is correct procedure for adding the images, so can you please confirm what I need to do, as I seem to be running into issues with the way I am uploading images, when I have permission to use them.
