Please review

Please take a look at this close. I fail to see how OTRS would manage copyrights on newspaper articles and I'm concerned about the way it was handled esp. due to abusive behavior from uploader. Ellin Beltz (talk) 18:20, 29 November 2016 (UTC)

@Ellin Beltz: I'm not familiar with the closer, but if they want to take over full responsibility for this user's uploads, there's not much you can do since OTRS is involved. The uploader is a representative of a small GLAM (the Bronx County Historical Society), and is rather obviously quite frustrated... ToAruShiroiNeko is attempting to engage in some 'education' of the uploader, and salvage a possible relationship with someone who probably has much usable material in their collections... it's rather obvious that stuff like NYT and NYDN articles are not going to be licensed, tho. The files you took down from the English Wikipedia article en:Moody Pedestrian Bridge have been uploaded again by the same user, with no further indication of ownership than they had before. I'm not familiar with the process for marking them again for review and possible removal, but I thought I'd let you know. They're good images and I wish we could use them, but if they had to be taken down the first time, then they're probably still not permissible. @Bryanrutherford0: Ok, I have refreshed my memory, and looked at the old files. The images in the article now are 'not' actually the same images, but instead different ones of the same structure... see Commons:Deletion requests/Files related to Rosales and Partners for history.
The current images have been taken from http://www.archdaily.com/791866/moody-pedestrian-bridge-rosales-plus-partners-architects-engineers where they are shown as copyrighted, again, as the copyrighted work of multiple photographers... and Nionoodle cannot possibly be two different people, of course. Both of the photographers are 'known' professionals in the Austin area, and that they have licensed their material to Commons is highly unlikely. I've speedied the images. Good block. Talk page removal

Your edit indicates this uploader is bad but the image in question is a cropped version of File:Secretary Tim Geithner and Finance Minister Pranab Mukherjee 2010.jpg which is a good image, so could have been given a good review. It could be restored as there are not a large number of headshots of him so it would not be redundant. Ww2censor (talk) 14:42, 30 November 2016 (UTC)

Thanks for the heads up. I normally review the Flickr account quite carefully including the profile and their other images before making a decision, but will ask if I have concerns. It seemed quite odd to get an out-of-the-blue review request from someone I had never encountered previously. Maybe I'll just do a crop (with the CropTool) of the original which preserves all the original information. BTW, you seem to be deleting many of my nominations, so thanks for that, and this info too. Hello ! Some days ago, you delete this map [1], deletion required by Sealle because "copyviol". Just for your information, my map were, from the aesthetic side exclusively, derivative since this one [2] but, from the side of content, completely different and in accordance with the books and articles cited, which did not contain maps. Concerning this deleted map, no one can find another identic map on the web. My question : when I draw a map as this one, derivative from another from the aesthetic side and according with some scientific sources from the contents side, must I ask the permission (a sending to OTRS) of all the authors of the aesthetic model, and of the scientific sources ? The original file isn't available to you where you live. The video is still up, but you need to be on a Central or South American IP to see the video. If Discasto says it's ok, I'd believe him. Hi all, I'm not actually aware of YouTube providing contents only to specific locations (I assume it should be a regional filter, but the rationale provided is pretty clear: "this video is not available in your country"). AFAIK, @Victuallers: is based in Europe. Both @Cookie: and myself are based in Spain. The video works for Cookie and for me and, I assume (otherwise he hadn't been able to extract the frames), for Victuallers. I'm really intrigued with the fact that neither you nor @1989: are able to watch the video. For the sake of clarity, here you have the web page from LaComarca.Tv that embeds the YouTube video (provided through the LaComarca.Tv YouTube channel). May I assume that you can access the web page but not the video? --Discasto talk 11:08, 2 December 2016 (UTC) PS: on the other hand, I assume that trusted reviews is what the community was looking for when the reviewer role was created. Victuallers made some mistakes when (not) including the {{LicenseReview}} template for all the pictures. I fixed it (but without actually carrying out the review) and, in at least one case, I acknowledged the screenshot status (see here) before the deletion request was opened. 1989 was unable to provide any rationale but an undefined "The channel is fake". When asked about what he actually meant he simply answered that it was fake because he said it was fake, and sort of threats ("or I have to take further actuon"). Eventually, he opened a regular deletion request with the same unsubstantiated rationale, even if I had, as trusted reviewer, acknowledged the status of the source. Therefore, what 1989 was actually claiming was that I'm not a trusted reviewer any more. And I'm still wondering why.
I wouldn't worry too much about it. This is probably the first such video 1989 has run into. As I said, when I've seen them in the past, and it's only been a handful, I just hooked up an open proxy from Venezuela, and I was able to access the video. There's no issue of trust here, just a YouTube channel that is restricted in the USA. I'm sure 1989 will learn from this. lNeverCry 21:10, 2 December 2016 (UTC)

"File in use" is not a reason for overriding a community decision to delete. It's not a "good thing" to substitute your own judgement - that's not what we have admins for. You couldn't even give me a link to the COM:INUSE policy, which states "A media file that is in use on one of the other projects of the Wikimedia Foundation is considered automatically to be useful for an educational purpose, as is a file in use for some operational reason such as within a template or the like. Such a file is not liable to deletion simply because it may be of poor quality: if it is in use, that is enough" {my emphasis}. The reason for deletion was not that it was poor quality, but that it was incorrect - Commons:Deletion requests/File talk:Quick Interpretation of Cardiac Axis on ECG.png. If you want to play at policy-wonking, take a look at the parent of INUSE, COM:EDUSE: "Must be realistically useful for an educational purpose ... The expression 'educational' is to be understood according to its broad meaning of 'providing knowledge; instructional or informative'." An image that provides incorrect information is thoroughly useless for educational purposes, wouldn't you say? The base image is GreatCircleMapper, the same platform used by other members to create the same map style of the other Brazilian airports. As GCMapper is the platform I used to create my map, and not the source of it, I didn't find it to be a complication, in the same way that someone who rather would have used MS Paint or Photoshop wouldn't put it as the source. I'm not familiar with GreatCircleMapper, but my question is where do the satellite images themselves come from? Very few entities own satellites. The ones we see here most are copyrighted Google Earth material, or Government material such as NASA images. It looks like a pretty stock Blue Marble image, maybe with some sharpening. Not sure I can identify the exact source though (they released monthly pictures for a while). I would just credit it to NASA's Blue Marble, via the GreatMappingCircle tool. Carl Lindberg (talk) 05:27, 29 November 2016 (UTC)
I think we need to be a little wary about assigning NASA copyright to any image from a NASA created tool/telescope, just like we wouldn't recognize an ArcSoft copyright claim just because they made the tool/webcam. This was also a potential issue with last year's POTY winner (cf the OTRS ticket). That said, absent any specific claims of third party authorship, I don't think it would be an issue with these files or any other files that were likely taken fully automatically. @Storkk: NASA has a pretty firm commitment to releasing their scientific data (including images from their missions) to the public domain. Yes, if a third party rents time on a satellite like the Hubble, that would be different, but their space missions are usually all PD material, whether by NASA employees or not -- pretty sure that is generally part of the contracts when participating. See meta:Wikilegal/NASA images. It's certainly possible there could be additional expression added later by third parties, of course, though automated processing would usually not count. @ArthurBaz: I don't think adding radiating lines amounts to creating a new copyrightable work, so I would suggest {{PD-USGov-NASA}}. @Clindberg: Understood, and thanks for that link to Wikilegal's analysis... I do think it's important to be aware of the concerns they acknowledge in the section on collaborative works, but it's good to know that many such contracts will explicitly remove copyright protection. And in any case these satellite images, which were likely created fully automatically and therefore wholly by NASA are unlikely to be a concern. I was (admittedly, perhaps in the wrong place) trying to point out that we often blindly assume NASA has wholly created an image, whereas I think we should be a touch more cautious. "pathological dishonesty"

I had missed that you used this term with regards to Fae, and warned Colin about using it as a section heading. The simple fact is that describing the behavior of another editor as pathological 'whatever', instead of simply as 'whatever', is a personal attack that implies the person suffers from some kind of mental illness that compels them to do so. Colin used it in a section heading at AN:B, and when I warned him for it he objected that you had used the same language and I had not warned you (I had not even read it, but whatever). He's right about that, and so I am now doing so. Don't use terms that imply the person you are referring to is mentally ill, or I will have to block you. Thanks. Deleted Files

Hello INeverCry! you've undeleted the above mentioned files, as I requested some time ago. Unfortunately you've deleted them again right afterwards saying "otrs member confirmation of ticket needed to restore". Im not sure I understand what is wrong with these files or how i can get the ticket confirmed. Is there anything I can do to help solve this issue? Thanks for getting back to me.

A less stressful work

hi INeverCry, I am sorry to read that you're stopping being a sysop, particularly for health issues; you were kind of a reference for me on Commmons, especially now that I am using the new functions I obtained, which was eventually thanks to you. In any case, helping in Wikimedia projects should be funny and relaxing, so you're totally right in leaving stressful tasks if you don't enjoy them anymore!

That's why I am proposing you some more relaxing stuff :) I would like you to review from time to time my admin actions, so I can understand well certain mechanisms. I am not dealing with all the DR or UNDEL because I reckon that some cases are complex for my actual experience, but fell free to guide me in certain discussions, if you think that it's necessary. On the other hand, if you prefer to give a full stop to all sysop operations, it's not a problem at all, and I'll happily follow the learning curve regularly. @Ruthven: You'll do fine as an admin. Remember, I was new myself once too. Just about any mistake you make can be repaired. If you mess up a deletion, you can restore the file and use https://tools.wmflabs.org/commons-delinquent/ to repair usage of the file. Blocks can be easily removed. I would advise you to start with deletion requests by myself, EugeneZelenko, and others, that have to do with scope, and are simple and uncontested. I do DRs for out of scope unused personal images, so your chances of running into problems closing them are very slight. Hi INC, I was away in Periyar National Park for a butterfly survey for four days. It is a huge forest of 295 km2 with no disturbance from the world. When returned, I saw you resigned from the admin team. I hope it is good for your health. Keep enjoy yourself and choose more comfortable work. I remember your physical weakness that you shared in an early post. I too not very healthy; but can able to walk and climb forest with the colleagues. @Jkadavoor: It's nice to hear from you. If you can walk on an expedition, you've got me beat. I've taken maybe 3 or 4 walks in the past year, and never more than a mile. I usually only leave the house to go to the doctor or dentist. This disability hurts a bit, but I know that its purpose is to wear away my pride and my ego and let my soul shine through.

As for adminship, it's not a big deal. I've done it so long that there's really no more excitement in it for me. When you've done over 400,000 log actions, things start getting repetitive. The complaints at your talkpage about deleted images especially start to be tiresome. I'm going to be working on images from now on, which is why I started editing. Second, it is not known if the trinkets is in the Public Domain or not, since the uploader does not describe the authors, and they don't look old to me. Third, the purpose of the images is likely promotional, the uploader even made a gallery and category page. -- MCMLXXXIX 20:29, 23 December 2016 (UTC)
  • @Ellin Beltz: The uploader is a long time editor with 168,000 edits, so I would advise being gentle with any action taken. These keychains are in scope since they advertise notable name brands/companies. These are also utilitarian objects made and distributed by the companies to be used to hold keys, so the copyright issue/s may not be cut and dry. You might ask Jameslwoodward or Clindberg about these. I would stress again that the uploader, Alfvanbeem, is a highly active member of the community, so this needs to be handled carefully and correctly. lNeverCry 21:16, 23 December 2016 (UTC)
  • INC, Ellin, I don't think scope is a problem, but I glanced through them using VFC and I think most of the first hundred are copyvios, so they need to be gone over carefully. One big mass DR may be seen as too unwieldy. There may also be pins in there that are PD due to age. I was up into 600+ uploads and the pins were still going. This would be a perfect collection for Flickr. I don't know if I feel like dropping the delete hammer on several hundred files on Christmas Eve. Jim, it may be better for you too go through these. I think you'd do a more precise job of it than I can. Also, since this is a collection uploaded by an NL editor with many Dutch pins, maybe an opinion from @Jcb: would be helpful. It might be good to give the uploader a heads-up that so many of his uploads may need to be deleted, and he's a native Dutch-speaker. At all concernig this subject. I am not offended if you think my uploads are copyviolations. I sometimes am in doubt of if an object i photograph and upload on commons is copyvio. In those cases i always add a trademarked licence to it. If other people with more expertise of the subject think differently about such an upload, i appreciate it and let them decide what to do with it. Only note that there are also a lot of pins that i think are certainly not copyvio like Münster Dusseldorf Ungarn speldje.JPG or Schutter speldje.JPG for example. Also a lot of brands are only shown by name and not by their official logo's. Furthermore, I have no other objective than to enrich wikimediacommons. Alfvanbeem, thank you for your very constructive attitude. Although deletions for copyright violations are never good -- they remove content that we would like to have -- they are much harder when the uploader fights them. It would be helpful it you went through them and added {{Delete}} tags to those that you think are possibly copyvios. As for the two you mention above, the first is probably OK, but the second, which you say is "Advertising pin of an old (Dutch) product or brand" is probably a copyvio unless it is pre-WWII. Remember that copyright exists even if the brand is gone.

    As regards adminship, I'm one of the ten most active admins in WMF history, with 450,000 log actions between here and the 6 months I was an admin over on Wikipedia. It gets tiresome after a while. Most sockmasters are so predictable it's painfully boring to deal with them. But the worst part of being an active admin is the deletion-related questions you get on your talk all the time. As for the 5,000+ people -- I find it amazing in real life that there are people who, while dealing all the time with the public, have to put up with the 10% of the public who can be really difficult. Many years ago, I ran a small retail business -- we built boats -- and vowed never to do retail again. The abuse from the 10% far outweighed the good friendships from the 10% on the other end of the scale. On the other hand, here on Commons, I am more or less insulated from direct contact and have a supportive group of colleagues around me, so I find it easy to put up with the difficult ones who want to argue endlessly about black letter law. .     Jim . . . . @Srittau: Nah, I'll leave it to you lucky admins (though I did speedy-nom his little sandbox template). Jhony's going to be around for a long time, and so you may see hundreds of further socks from him. I personally just nuked his uploads and deleted any pages he'd created when I was dealing with him, but it's all the same in the end. The thing to watch out for with him is Flickrwashing. I personally blacklisted a dozen or so Flickr accounts of his. Otherwise he's just a minor problem compared to sockmasters like Starship9000 and Wikinger. lNeverCry 21:25, 28 December 2016 (UTC)

PD-old question

Hello! I was wondering if there is a community consensus on after how much time we can accept file whose author is unknown. Take for instance File:Jean-Baptiste Nouvion.jpg: after 140 years one could consider that it is PD. Any advice? --Ruthven (msg) 09:58, 29 December 2016 (UTC)

  • @Taivo: Thanks for reminding me!   I had to give it a shot, but I had a sneaking suspicion you'd be right. Adminship wasn't nearly as enjoyable this time around for me as it was back in 2012/2013/2014. Not having checkuser was a big disadvantage too. In the end, A.Savin was absolutely right in saying that I do good as a regular editor but not so good as an admin. Being a regular editor is more free and less stressful. I tended to take on too much as an admin, and get too intense and confrontational. But so what? No big deal now. My mental and physical well being are much more important than anything I can do here. Anyways, I hope you and your family and friends have a happy and healthy 2017! I wish the same to A.Savin and his family and friends, and I mean that a lot more than the dumb shit I said to him earlier in the year. lNeverCry 23:04, 30 December 2016 (UTC)

It's hard for me to say since I can't see the uploads of R.Zwierzyniecki. If Pesell has a shared upload or uploads, I guess you could block that account too, though from what I'm seeing, they haven't edited in 3+ months. lNeverCry 22:37, 30 December 2016 (UTC)
